What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

PBGC’s regulation on Rules for Administrative Review of Agency Decisions (29 CFR part 4003) prescribes rules governing the issuance of initial determinations by PBGC and the procedures for requesting and obtaining administrative review of initial determinations. Certain types of initial determinations are subject to administrative appeals, which are covered in subpart D of the regulation. Subpart D prescribes rules on who may file appeals, when and where to file appeals, contents of appeals, and other matters relating to appeals. Under § 4003.54, an appeal must: (1) be in writing; (2) be clearly designated as an appeal; (3) specifically explain why PBGC’s determination is wrong and the result the appellant is seeking; (4) describe the relevant information the appellant believes is known by PBGC, and summarize any other information the appellant believes is relevant; (5) state whether the appellant desires to appear in person or through a representative before the Appeals Board; and (6) state whether the appellant desires to present witnesses to testify before the Appeals Board, and if so, state why the presence of witnesses will further the decision-making process. Under the regulation, where the appellant believes that another person may be aggrieved if PBGC grants the relief sought, the appeal must include the name(s) and address(es) (if known) of such other person(s).

The Virginia Graeme Baker Pool and Spa Safety Act (VGB Act) authorizes CPSC to grant funding for the PSGP. 15 U.S.C. 8004–8008. The PSGP provides two-year grants to eligible state, local or tribal governments to reduce deaths and injuries from drowning and drain entrapment incidents in swimming pools and spas. Abstract

This is a request for revision and extension of an approved information collection, to which NOAA is proposing to update existing forms and add 5 optional forms to be usable with a new, online platform to manage license actions called the Commerce Licensing and Compliance System for Space (CLCSS). The changes impose no new information collections. The optional new forms are time-saving forms that licensees may use for the existing information collections involving notices of anomalies, disposal of on-orbit components, financial insolvency, and launch or deployment and one form to simplify the submission process for licensee annual compliance certifications required by the regulations. The modifications to existing forms also are intended to streamline communications with the Commercial Remote Sensing Regulatory Affairs (CRSRA) and its upcoming online CLCSS platform to streamline, clarify, and expedite paperwork submissions. NOAA is also removing licensee notification form. That form was initially created to provide a single form for all notification requirements. However, licensees have not used that form and submitted individualized notifications through other means, so NOAA has made the decision to remove that information collection from this OMB Control Number.

Abstract

The development and maintenance of a cumulative database of all CMAQ projects is required by 23 U.S.C. 149(i)(1). This database must include specific information about each project such as name, location, sponsor, cost, and to the extent already measured by the project sponsor, cost-effectiveness based on reductions in emissions and congestion. The database must be readily available for public review either by publication or in electronically accessible format and means. States provide annual reports on all CMAQ obligations and deobligations taking place in each fiscal year. These reports include obligations of program funds; descriptions of individual projects; and potential impacts on air quality and congestion. The data provided in the annual reports and the CMAQ Public Access System allows for transparency, showing that the program continues to provide incremental benefits through enhanced regional and local air quality improvement, and through contributions to congestion relief. In order to populate the database, FHWA division offices, State DOTs, and MPOs develop a process for entering and approving project data in a timely manner. State DOTs submit the annual report to be approved by the FHWA Division by March 1 and FHWA HQ approves it by July 1 following the end of the previous Federal fiscal year (September 30). The annual report covers all CMAQ obligations for that previous fiscal year. Thus, State DOTs and MPOs report the data early enough that FHWA has time to review and comment on the report.

Abstract

The Rural Health Network Development (RHND) program is authorized under section 330A(f) of the Public Health Service Act (42 U.S.C. 254c(f)). The purpose of this program is to support integrated health care networks that collaborate to achieve efficiencies; expand access to, coordinate, and improve the quality of basic health care services and associated health outcomes; and strengthen the rural health care system as a whole. The program supports networks as they address gaps in service, enhance systems of care, and expand capacity of the local health care system. Abstract

The Office of the Assistant Secretary for Health, Office for Human Research Protections (OHRP) is requesting a revision of the currently approved collection for the OMB No. 0990-0278, Federalwide Assurance (FWA) Form. The form is currently approved through October 31, 2026. The purpose of the FWA form is to provide a simplified procedure for institutions engaged in research conducted or supported by the Department of Health and Human Services (HHS) to satisfy the assurance requirements of (1) Section 491(a) of the Public Health Service Act (the PHS Act) (42 U.S.C. 289); and (2) HHS regulations for the protection of human subjects at 45 CFR 46.103. The respondents for this information collection are institutions engaged in HHS-conducted or –supported research involving human subjects. With this revision, OHRP is seeking to remove information from the FWA form to adopt the changes at 45 CFR 46.103 of the 2018 Requirements and reduce burden on respondents. The proposed changes to the FWA form include: 1) removing the Pre-2018 Common Rule requirement that institutions provide a statement of ethical principles; 2) removing the Pre-2018 Common Rule requirement that an institution designate one or more IRBs to review the research to which the FWA applies; 3) removing “check the box”, or the option for U.S. institutions to voluntarily apply the Common Rule, or the Common Rule and subparts B, C, and D of the HHS regulations at 45 CFR part 46, to all of an institution’s nonexempt human subjects research regardless of the source of support; and 4) eliminating the requirement for institutions outside the U.S. to provide procedural standards they apply for human subjects research when assuring compliance with the Terms of the Federalwide Assurance. Updates to the software applications OHRP uses to manage the FWA application process will be deployed to enable such changes.

This clause requires the contractor to submit an adequate final indirect cost rate proposal to the contracting officer and the auditor within the 6-month period following the expiration of each of its fiscal years. The proposed rates shall be based on the contractor’s actual cost experience for that period. Paragraphs (d)(2)(iii) and (iv) of this clause provide a list of the data required to be submitted. The data is customary business financial information that the contractor can access from its automated business systems. b. FAR 52.216-15, Predetermined Indirect Cost Rates. This clause repeats the requirement in the clause at FAR 52.216-7, paragraph (d), for the contractor to submit an adequate final indirect cost rate proposal, however it does not impose any additional reporting requirements. c. FAR 52.242-4, Certification of Final Indirect Costs. This clause requires the contractor’s final indirect cost rate proposal to be certified to establish or modify the rates used to reimburse the contractor for the costs of performing under the contract. The supporting cost data are the cost accounting information normally prepared by organizations under sound management and accounting practices. This clause is incorporated into all solicitations and contracts that provide for establishment of final indirect cost rates, but the Department of Energy may provide an alternate clause for its Management and Operating contracts. d. FAR 52.242-5, Payments to Small Business Subcontractors. This clause requires the prime contractor to self-report to the contracting officer when the prime contractor makes late or reduced payments to small business subcontractors. The notice shall include the reason(s) for making the reduced or untimely payment. e. FAR 52.242-13, Bankruptcy. This clause requires contractors to notify the contracting officer within five days after initiating the proceedings relating to bankruptcy filing.

The NSF Partnership for Research and Education in Materials (PREM) program provides significant support ($0.5-0.6 million / year) for research, education, and infrastructure with a renewable term of 5 years, for a total investment of $2.5-3.0M. Because of the duration and size of these awards, it is necessary for the NSF to ensure that its substantial investment is spent appropriately, that each of the PREMs meets the goals stated in its strategic plan, and that each PREM's activities satisfy the goals and objectives of the PREM program. The PREM program currently funds a total of 32 active awards, For effective oversight of these substantial investments, the NSF requires that each currently funded PREM submit an annual progress report that describes all its activities. Each PREM is expected to submit a final report at the end of the award. Data contained in these reports are also submitted to a website managed by a contractor for NSF. This clearance covers the information that contractors may be required to submit to comply with the following FAR clauses: o 52.246-2, 52.246-3, 52.246-4, 52.246-5, 52.246-6, 52.246-7, 52.246-8, and 52.246-12. These FAR clauses require the contractor to provide and maintain an inspection system that is acceptable to the Government, and to keep complete records of all inspection work performed and make it available to the Government. These clauses give the Government the right to inspect and test all work. Records required under these clauses are kept as a part of a contractor’s normal business operations. To ensure they provide a quality product or service, every business must have standards and methods for reviewing or inspecting the quality of their product or service. These standards will differ by industry and the complexity of the product or service provided. The Government relies on a contractor's existing quality assurance system for contracts for commercial products. The Government relies on the contractor to accomplish all inspection and testing needed to ensure that acquired commercial services conform to contract requirements before they are tendered to the Government. See FAR 12.208 and 46.202-1. Likewise, when the contract amount is expected to be less than the simplified acquisition threshold (SAT), these clauses do not apply. The FAR “inspection clauses” are used for quality assurance depending on the type of contract, or the product or service being provided. These clauses do not require the transmittal or sending of documentation to the Government, but they have record keeping requirements. The Government may review these records to confirm the contract quality requirements are being met. This review is risk-based and may or may not include the review of all quality assurance records. Generally, the records are more likely to be reviewed when the contractor is not meeting quality standards or as part of Government Contract quality assurance surveillance for complex requirements. Subject matter experts estimate these records are requested from 10% or fewer of contractors. ● FAR 52.246-15, Certificate of Conformance. This clause requires the contractor to complete and sign a certificate of conformance (CoC). This clause requires certain contractors to submit a report to the Government-Industry Data Exchange Program (GIDEP) system at www.gidep.org within 60 days of becoming aware or having reason to suspect, such as through inspection, testing, record review, or notification from another source (e.g., seller, customer, third party) that an item purchased by the contractor for delivery to, or for, the Government is counterfeit or suspect counterfeit.

The Nicholas and Zachary Burt Memorial Carbon Monoxide Poisoning Prevention Act of 2022 (NZB Act) authorizes CPSC to provide funding for the Carbon Monoxide Poisoning Prevention Grant Program (COPPGP). 15 U.S.C 2090. The COPPGP provides two-year grants to eligible state, local or tribal governments to reduce deaths and injuries from carbon monoxide poisoning. The grant awards can range from $50,000 to $400,000 per applicant. Prospective applicants will be able to access the grant application on Grants.gov and apply electronically through GrantSolutions.
