Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Low Income Home Energy Assistance Program (LIHEAP) Quarterly Performance and Management Reports

Key Information

Abstract

OCS implemented LIHEAP quarterly reporting helps strengthen the program and improve our ability to highlight the impact LIHEAP is having on households across the program. The quarterly reports help OCS track key information in near real time. Previously, OCS did not receive comprehensive performance and management data until approximately three months after the end of each federal fiscal year. The LIHEAP Quarterly Report assists OCS in receiving data and information about LIHEAP during the federal fiscal year. This almost real time data is particularly important this year as LIHEAP grant recipients both administer historical levels of LIHEAP funding and develop and implement plans to reach the most vulnerable households amidst ongoing energy price increases. These reports are critical in helping us address challenges in a timely manner including unmet T/TA needs, approaching obligation deadlines, and challenges related to outreach and intake such as reaching newly eligible populations. The LIHEAP Carryover and Reallotment Report (CRR) is used for the collection of data about timely obligation of LIHEAP regular block grant, reallotted, and supplemental funds and reporting funds for carryover and reallotment. ACF is working to submit a revision request for the LIHEAP CRR (OMB #0970-0106) but will not be able to submit it before its current expiration date of June 30, 2025. ACF is in the process of getting the first notice published in the Federal Register, once HHS approves publication. The next CRR report is usually due from grant recipients on August 1st. Since the 60-day comment period has not begun, we will not have approval for the reinstatement of the CRR by that date. The August 1st requirement for this data submission is part of the statute and cannot be moved. ACF would like to propose an interim solution for this year that allows us to gather necessary information in a timely way, meet statutory requirements, and reduce burden on grant recipients. The Office of Community Services currently receives the Unobligated Balance for LIHEAP funds based on the Q4 submissions of the LIHEAP Quarterly Report (0970-0589). ACF would like to make an update to the Q3 report to add an element for respondents to provide the Estimated Unobligated Balance of Funds through September 30th. The purpose and use of the information would be in line with the purpose and use of information collected for the Quarterly Reports, which is for the purpose of Training and Technical Assistance.

Abstract

The Emerging Infections Programs (EIP) is to 1) detect and monitor emerging pathogens, the diseases they cause, and the factors influencing their emergence, and respond to problems as they are identified, 2) integrate laboratory science and epidemiology to optimize public health practice, 3) strengthen infrastructure to support surveillance and research and to implement prevention and control programs, and to 4) ensure implementation of prevention strategies and communication of public health information about emerging diseases. Surveillance efforts of the core EIP activities generate reliable estimates of the incidence of certain infections and provide the foundation for a variety of epidemiologic studies. This Non-Substantive Change Request is submitted to make minor modifications to approved instruments including revised formatting, rewording, new answer options, and the addition/subtraction of a limited number of questions. In considering the expanded format for collecting race and ethnicity information, which includes minimum categories, multiple detailed checkboxes, and write-in response areas with example group categories, we determined that such specificity is not required for our purposes. The primary goal of this information collection is to obtain feedback to learn more about how people hear about and respond to flooding in their community. By simplifying the Race and Ethnicity Question with Minimum Categories (that is format 3, Race and Ethnicity Question with Minimum Categories Only) we can streamline the data collection process and focus on obtaining valuable insights from individuals who have experienced a severe water hazard. This approach allows us to prioritize the feedback and opinions that will directly contribute to improving public outreach and communication.

Abstract

This collection of information is required by the Trademark Act of 1946, 15 U.S.C. 1051 et seq., which provides for the Federal registration of trademarks, service marks, collective trademarks and service marks, collective membership marks, and certification marks. The Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks (Madrid Protocol) is an international treaty that allows a trademark owner to seek registration in any of the participating countries by filing a single international application. The International Bureau (IB) of the World Intellectual Property Organization (WIPO) in Geneva, Switzerland, administers the international registration system. The Madrid Protocol Implementation Act of 2002 amended the Trademark Act to provide that: (1) The owner of a U.S. application or registration may seek protection of its mark in any of the participating countries by submitting a single international application through the USPTO and (2) the holder of an international registration may request an extension of protection of the international registration to the United States. The Madrid Protocol came into effect in the United States on November 2, 2003, and is implemented under 15 U.S.C. 1141 et seq. and 37 CFR parts 2 and 7. Individuals and businesses that use or intend to use such marks in commerce may file an application to register the marks with the USPTO. Both the register and the information provided in pending applications for registration can be accessed by the public in order to determine the availability of a mark and lessen the likelihood of initiating the use of a mark previously adopted by another.

On March 17, 2023, we received OMB approval to conduct a descriptive case study for the Culture of Continuous Learning Project: Case Study (OMB #0970-0605). The purpose of this project is to document the factors that contribute to the feasibility of implementing the Breakthrough Series Collaborative (BSC) quality improvement methodology in Head Start and child care centers. Abstract

In 2008, TSA initiated a process to amend and supersede the primary Federal guidance for pipeline security, the 2002 Pipeline Security Information Circular, with forthcoming Pipeline Security Guidelines. The new document will include recommendations for the voluntary submission of pipeline operator security manager contact information to TSA and the reporting of security incident data to the Transportation Security Operation Center (TSOC). Security manager contact information will enable TSA to provide security-related information to the appropriate personnel and/or the security operations or control center for natural gas and hazardous liquid pipeline operators. Abstract

This information collection request (ICR) is for a revision to the umbrella Generic for ACF Program Monitoring Activities. The current expiration date is November 30, 2023. The overall proposed purposes, uses, and scope of the umbrella remain unchanged. The only changes are to the burden estimates, as described in sections A12 and A15. The Generic for ACF Program Monitoring Activities allows Administration for Children and Families (ACF) program offices to collect standardized information from recipients that receive Federal funds to ensure oversight, evaluation, support purposes, and stewardship of Federal funds. The information is necessary to ensure compliance with Federal and programmatic requirements, monitor progress on recipient activities, and determine and respond to recipient needs such as Training and Technical Assistance (T/TA). ACF is primarily a grant-making agency that promotes the economic and social well-being of families, children, individuals and communities with partnerships, funding, guidance, T/TA. ACF program offices have evolving monitoring needs, dependent on both internal and external factors, such as but not limited to: current grantee activities, needs; uses of federal funds; changes to aspects of programs based on statutory authority, federal regulations or policy, and/or Congressional appropriations; availability of program office funds for site visits (v. desk monitoring); matters of importance related to national health and safety needs of the public, or other events that lead to program changes. There are times when standardized collections of information would be helpful for program offices as they monitor recipient activities and needs. This generic clearance allows program offices the flexibility to create tailored information collections based on current circumstances and to receive approval for these in a timely manner. Refugee Data Submission System for Formula Funds Allocations (ORR–5)

Key Information

Abstract

The Refugee Data Submission System for Formula Funds Allocations and Service Analysis (ORR-5) is designed to satisfy the statutory requirements of the Immigration and Nationality Act (INA). Section 412(a)(3) of the INA (8 U.S.C. § 1522(a)(3)) requires that the Director of the Office of Refugee Resettlement (ORR) make a periodic assessment of the needs of refugees for assistance and services and the resources available to meet those needs. In order to satisfy statutory requirements, ORR requires each state and replacement designee (hereinafter referred to as “states”) participating in the program to annually submit disaggregated individual records containing certain data elements for eligible ORR populations. ORR utilizes the data collected to assess the number of clients served in each state, resettlement assistance or services clients received, and to determine the corresponding Refugee Support Services (RSS) allocations. ORR also collects data elements to inform evidence-based policy making and program design. New data elements were added in 2021, including additional demographics, primary goals identified, and referrals made to assist clients work towards self-sufficiency, progress made towards achieving said goals, and employment status of employable clients 12 months post-enrollment. This was done to enable ORR and states to monitor implementation of the requirements put forth in ORR Policy Letter 19-07, which provides guidance on RSS family self-sufficiency plans. Individual level data collection enhances ORR and the states’ ability to make data-informed programmatic and policy decisions to strengthen services and best support refugee populations on their path to self-sufficiency and integration. Abstract

TSA's Aircraft Repair Station regulations, codified at 49 CFR part 1554, implement a statutory requirement for the Department of Homeland Security (DHS) to ensure the security of aircraft repair stations. See 49 U.S.C. 44924. TSA has determined that the best way to ensure the security of the aircraft repair stations is to require that stations certified by the Federal Aviation Administration (FAA) carry out a standard security program and audit. TSA is proposing to collect repair station profile information, to comply with a legislative mandate and to require that repair stations maintain records of compliance with the required security program. The likely respondents to this collection of information are the owners/operators of repair stations. Currently, the program is doing voluntary outreach in order to gather industry best practices. No information collection form is currently in use.

Abstract

The Electronic Fund Transfer Act (EFTA), 15 U.S.C. 1693 et seq., requires accurate disclosure of the costs, terms, and rights relating to electronic fund transfer (EFT) services and remittance transfer services to consumers. Entities offering EFT services must provide consumers with full and accurate information regarding consumers' rights and responsibilities in connection with EFT services. These disclosures are intended to protect the rights of consumers using EFT services, such as automated teller machine (ATM) transfers, telephone bill-payment services, point-of-sale transfers at retail establishments, electronic check conversion, payroll cards, and preauthorized transfers from or to a consumer's account. EFTA also establishes error resolution procedures and limits consumer liability for unauthorized transfers in connection with EFT services. EFTA and Regulation E impose disclosure and other requirements on issuers and sellers of gift cards, gift certificates, and general-use prepaid cards. Further, EFTA and Regulation E provide protections for consumers in the United States who send remittance transfers to persons in a foreign country. On November 22, 2016, the Bureau published a final rule that amends Regulations E, Regulation Z, which implements the Truth in Lending Act, and the official interpretations to the regulations, to provide comprehensive protections for consumers who use “prepaid accounts.” In addition, it modifies general Regulation E requirements to create tailored provisions governing disclosures, limited liability and error resolution, and periodic statements, and adds new requirements regarding the posting of account agreements. Additionally, the final rule amends Regulations E and Z to regulate overdraft credit features offered in connection with prepaid accounts. Federal agencies and private litigants use the records to ascertain whether accurate and complete disclosures of EFT services and other services covered under Regulation E have been provided and other required actions (for example, error resolution and limitation of consumer liability for unauthorized transfers) have been taken. This information will provide the primary evidence of law violations in EFTA enforcement actions brought by the CFPB and other Federal agencies. Without recordkeeping requirements of Regulation E, the Federal agencies' ability to enforce the EFTA would be significantly impaired. Consumers rely on the disclosures required by EFTA and Regulation E to facilitate informed EFT, gift card, and remittance transfer decision making. Without this information, consumers would be severely hindered in their ability to assess the true costs and terms of the transactions offered. Also, without the special error resolution and limitation of consumer liability provisions, consumers would be unable to detect and correct unauthorized transfers and errors in their EFT and remittance transfer transactions. These disclosures and provisions are also necessary for the agencies to enforce EFTA and Regulation E.

Unaccompanied Refugee Minors Program: ORR-3 Placement Report and ORR-4 Outcomes Report

Abstract

The Refugee Act of 1980, 8 U.S.C. 1522, amended the Immigration and Nationality Act to create a domestic refugee resettlement program that provides assistance and services to refugees resettling in the United States. With the enactment of this legislation, the Office of Refugee Resettlement (ORR) issued a series of regulations at 45 CFR Part 400 to establish comprehensive requirements for a State-administered refugee resettlement program including child welfare services to unaccompanied refugee minors (URMs). Originally, the program provided services for refugee youth arriving from overseas unaccompanied by a parent or adult relative. Over the years Congress passed laws making other special populations already in the United States eligible for the URM program. The URM program currently operates in 14 states and the District of Columbia and provides the same range of child welfare benefits and services available to other foster children in those states and the District as well as services required by ORR regulation. URM benefits and services are provided in accordance with State Title IV-B and IV-E child and family service plans, Federal and State regulations, and ORR policy guidance. Participants in the URM program are placed with licensed providers by the state or local government agencies based on the provider’s licensed capacity and the minor’s specific needs. The Director of ORR is required by the Refugee Act of 1980 to prepare and maintain a list of unaccompanied children who have entered the United States; the names and last known residence of their parents (if living) at the time of arrival; and the children's location, status, and progress. Additionally, the Act requires ORR to submit a report to the Congress each year which summarizes the location and status of unaccompanied refugee children admitted to the United States. ORR regulations at 45 CFR 400.120 describe the specific URM program reporting requirements prescribed by the Director, and these requirements are implemented through the ORR-3 and ORR-4 Reports. In January 2025, the current Administration released multiple Executive Orders (EO) and memoranda requiring updates to information collections that request gender and/or gender identity, to only request “Sex” with the options Male/Female. Additionally, presidential actions focused on the removal of diversity, equity, and inclusion (DEI)-specific activities. To be responsive to the new administration, ACF is submitting change requests for a number of implicated information collections. This request is specific to updates related to a recent presidential action, as detailed in the accompanying Justification for a NonSubstantive Change Memo.

Abstract

The Annual Survey of Refugees (ASR) helps the Administration for Children and Families (ACF) Office of Refugee Resettlement (ORR) meet its congressional reporting requirements, as specified in The Refugee Act of 1980 (Section 413 of the Immigration and Naturalization Act, [8 U.S.C. 1523]). From the time of their arrival in the United States, refugees are eligible for social services, including means-tested public assistance, according to eligibility criteria established by the locality in which they are resettled. Following an initial 90-day reception period funded by the U.S. Department of State, ACF, through ORR, provides transitional resettlement assistance through a network of national non-profit grantees and their local affiliates. In many cases, these services are expected to end after an 8-month resettlement period. By that time, refugees are expected to be transitioned to mainstream social services or to self-sufficiency. The design of the resettlement program means that ORR has limited administrative information on refugees’ experiences after the 8-month resettlement period. The information collected through the ASR generates national population estimates of refugee labor force participation, public benefits receipt, English language acquisition, and conversion to legal permanent residency to meet Congressional reporting requirements. Given that ORR does not have access to cross-program administrative data on refugees’ participation in state-provided services, a representative survey is the most resource-efficient way to meet ORR’s annual reporting requirements, laid out in the Refugee Act of 1980. In particular, descriptive information from the survey is used to meet the requirement of 413(b)(1): “an updated profile of the employment and labor force statistics for refugees who have entered the United States within the five-fiscal-year period immediately preceding the fiscal year within which the report is to be made.” Descriptive information from the survey is also used alongside quantitative and qualitative data collected during program administration to meet the requirements of 413(b)(5): “the extent to which (A) the services provided under this chapter are assisting refugees in achieving economic self-sufficiency, achieving ability in English, and achieving employment commensurate with their skills and abilities.” This request covers the following administrations of the ASR: ASR 2023 (to be fielded spring 2024), ASR 2024 (to be fielded spring 2025), and ASR 2025 (to be fielded spring 2026). In order for a State or Replacement Designee (RD) to receive refugee resettlement assistance funds, it must submit a plan that meets the requirements of 8 U.S.C. 1522 of the Immigration and Nationality Act (the Act) [Title IV, Sec. 412 of the Act] for each state agency requesting federal funding for refugee resettlement under 8 U.S.C. 524 [Title IV, Sec. 414 of the Act]) and 45 CFR Part 400.
