Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

In 2006, the Department promulgated a final class exemption, PTE 2006-16, which amended and replaced the exemptions previously provided under PTE 81-6 and PTE 82-63. The final exemption incorporates the exemptions into one renumbered exemption and expands the categories of exempted transactions to include securities lending to foreign banks and foreign broker-dealers that are domiciled in specified countries and to allow the use of additional forms of collateral, all subject to specified conditions outlined in the exemption. Among other conditions, the class exemption requires a bank or broker-dealer that borrows securities from a plan to provide the lending fiduciary with its most recent audited financial statement and its most recent unaudited statement if the unaudited statement is more recent than the audited financial statement. The borrower must also represent, at the time the loan is negotiated, that there has been no material adverse change in its financial condition since the date of the most recent financial statement provided to the plan that has not been disclosed to the lending fiduciary. The exemption also requires the loan be made pursuant to a written loan agreement. Individual agreements are not required for each transaction; rather the compensation agreement may be made in the form of a master agreement covering a series of transactions.

Abstract

Each applicant for an aircraft dispatcher certificate or FAA approval of an aircraft dispatcher course must comply with Part 65, Subpart C and Appendix A. All submissions are provided to the responsible Flight Standards Office of the FAA that oversees the certificates and FAA approvals. The collection of this information is mandatory due to regulatory intent and the respondents are each applicant for an aircraft dispatcher certificate (individual) and each applicant for FAA approval or renewal of an aircraft dispatcher course (course operator). The collection is conducted initially, annually and on occasion and would include the collection of information from instructors, students/applicants, and facilities. This collection of information is required to determine whether the course operator and the aircraft dispatcher/applicant meets the regulatory requirements. The FAA uses the collected information to initially approve a course operator and renew on a bi-annual basis to continually ensure that student applicants have been trained properly. The information collected will not be disseminated to the public. This collection includes both recordkeeping and reporting requirements. The information is collected according to the regulatory requirements. The information is shared with the FAA (DOT).

Abstract

10 USC 504, 505, 508, and 12102 established minimum standards for entry into the Armed Forces. This information collection is necessary to gather data on applicants for military enlistment. The DD Form 369, Police Record Check, is used to screen and identify applicants who may have a discreditable involvement with the police or other law enforcement agencies. It is used to identify those applicants who may be undesirable for military service or required a waiver to enlist. It is initiated whenever an applicant indicates any type of criminal involvement or arrest record other than a minor traffic violation.

Incident Reporting for the Unaccompanied Alien Children Bureau

Abstract

The ORR Unaccompanied Alien Children Bureau (UACB) provides care and custody for unaccompanied alien children until they can be safely released to a sponsor, repatriated to their home country, or obtain legal status. ORR funds residential care provider facilities that provide temporary housing and other services to children in ORR custody. Generally, care provider facilities are State- licensed (with the exception of those located in states unwilling to consider them for licensure and temporary influx care facilities) and must meet ORR requirements to ensure a high-level quality of care. Services provided at care provider facilities include, but are not limited to, education, recreation, vocational training, acculturation, nutrition, medical, mental health, legal, and case management. ORR uses several forms directly related to the care of unaccompanied alien children. The forms in this information collection allow ORR to ensure that serious issues are elevated to ORR and that all incidents, and responses to such incidents, are documented and resolved in a way that protects the interests of unaccompanied alien children. ORR is in the process of reorganizing its information collections to better manage its large portfolio of forms. As part of that reorganization effort, ORR is submitting this request to transfer six existing forms (with revisions) currently approved under OMB# 0970-0547 under a new OMB control number.

Comprehensive Child Welfare Information System (CCWIS) Data Collection: Automated Functions List Update & Data Quality Plan Update

Key Information

Abstract

The statute at 42 U.S.C. 674(a)(3)(C) and (D) provides the authority for title IV-E funding for the planning, design, development, installation, operation, and maintenance of an optional child welfare data collection and information retrieval system and the requirements a title IV-E agency must meet to receive a more favorable cost allocation for federal financial participation (FFP). The statute at 42 U.S.C. 674(c) further specifies the expenditures eligible for FFP. In response to these laws, the Administration for Children and Families (ACF) published regulations at 45 CFR 1355.50 – 57 in 1993 providing states with enhanced funding to build a single comprehensive system supporting all child welfare case management activities for public and private child welfare workers in the state. In response to 42 U.S.C. 679c(b) ACF amended these regulations in 2012 to apply to an Indian tribe, tribal organization, or tribal consortium (tribe) that elect to operate a program under a plan approved by the Secretary under section 671. Child welfare practice and technology changed considerably since the regulations were published in 1993. To address these changes, ACF published the Comprehensive Child Welfare Information System (CCWIS) Final Rule on June 2, 2016 with an effective date of August 1, 2018. This final rule removes the requirement for a single comprehensive system. With this flexibility, title IV-E agencies can build less expensive, modular based, child welfare information systems that more closely mirror their practice models while supporting quality data. Each agency may determine the size, scope, and functionality of their CCWIS. For example, a tribe may use this flexibility to build a smaller system at a reasonable cost. To help title IV-E agencies implement these more flexible requirements while ensuring appropriate Federal oversight, the final rule specified two new reporting requirements that agencies must annually submit over the life of the CCWIS project: • Automated Function List updates (annual submission during the life of a CCWIS project pursuant to 1355.52(i)(2)) • Data Quality Plan updates (annual submission during the life of a CCWIS project pursuant to 1355.52(d)(5))

ORR funds residential care provider facilities that provide temporary housing and other services to children in ORR custody. Generally, care provider facilities are State-licensed, except those located in states unwilling to consider them for licensure and temporary emergency or influx care facilities and must meet ORR requirements to ensure a high-level quality of care. In order to adequately provide for the safety and wellbeing of children in ORR care, ORR conducts assessments of the child upon admission and at routine intervals while in ORR custody. Concurrently, ORR must identify and assess the suitability of potential sponsors and household members to ensure safe and timely release of the child to vetted and adult, qualified to provide for the child’s physical and emotional wellbeing. ORR uses several instruments to carry out its responsibilities with respect to UAC. These instruments are used, for example, to evaluate the child’s physical and mental health status, capture important biographic data, determine risk of sexual abuse or victimization, and enable ORR to track high-level milestones in the child’s case up through release. ORR has also developed an instrument to identify and screen potential sponsors. The instruments in this proposed information collection allow ORR to document the findings of these assessments as required by the Homeland Security Act of 2002 (6 U.S.C. 279); the Trafficking Victims Protection Reauthorization Act of 2008 (8 U.S.C. 1232); the Foundational Rule, 45 C.F.R. Part 410; and the Prevention of Sexual Abuse Interim Final Rule, 45 C.F.R. Part 411. Forms transferred from the Services information collection (OMB # 0970-0553) were last approved by OMB on August 22, 2024 and expire on April 30, 2025. Abstract

Section 1123A [42 U.S.C. 1320a-1a] of the Social Security Act (the Act) and regulations at 45 CFR 1355.33(b), 45 CFR 1355.33(c) and 45 CFR 1355.35(a) govern the Child and Family Services Reviews (CFSR). The CFSR looks at both the outcomes related to safety, permanency and well-being of children served by the child welfare system and the assessment of seven systemic factors. The systemic factors refer to systems within a state that, if well-functioning, will support the outcomes. This regulated monitoring process allows ACF to determine whether states are complying with federal child welfare requirements; determine what is happening to children and families; and assist states to enhance their capacity to help children and families achieve positive outcomes. Ultimately, the goal of the CFSR is to help states improve child welfare services by identifying their strengths and areas needing improvement. Three activities are associated with the CFSR collection: a statewide assessment, which is the state’s evaluation of its performance on CFSR outcomes and systemic factors and is used to guide the focus of the onsite review; an on-site review, which involves case record reviews and a joint federal-state team interviewing stakeholders in the state to inform the Children’s Bureau’s (CB) determination of the state’s functioning on the seven systemic factors; and a program improvement plan, which addresses areas in which states are found to be out of conformity with any one of the seven outcomes or seven systemic factors under review. The following ICR has been updated with non substantive changes in response to the Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government Executive Order (Defending Women EO) and recent Presidential Actions related to diversity, equity, and inclusion (DEI), such as those covered under the EO Initial Recissions of Harmful Executive Orders and Actions.

Tribal Maternal, Infant, and Early Childhood Home Visiting Program Community Needs and Readiness Assessment Guidance and Implementation Plan Guidance

Abstract

As part of the Consolidated Appropriations Act, 2023 (Public Law 117-328). Section 511 of Title V of the Social Security Act authorizes the Secretary of the Department of Health and Human Services (HHS) to award grants to Indian tribes (or a consortium of Indian tribes), tribal organizations, or urban Indian organizations to conduct an early childhood home visiting program. The legislation sets aside 6 percent of the total Maternal, Infant, Early Childhood Home Visiting (MIECHV) appropriation for grants to tribal entities and requires that the tribal grants, to the greatest extent practicable, be consistent with the requirements of the MIECHV grants to states and territories and include conducting a needs assessment and establishing benchmarks. The goals of the Tribal MIECHV program are to support healthy, happy, successful American Indian and Alaska Native (AI/AN) children and families through a coordinated, high-quality, evidence-based home visiting program, and to continue to build the evidence base for home visiting in tribal communities. The Administration for Children and Families (ACF) and the Health Resources and Services Administration (HRSA), the agencies collaborating to implement the MIECHV program within HHS, also intend for the program to result in a coordinated system of early childhood home visiting in tribal communities that has the capacity to provide infrastructure and supports to assure high-quality, evidence-based practice. The Tribal Home Visiting discretionary grants support cooperative agreements to conduct community needs assessments; plan for and implement high-quality, evidence-based home visiting programs in at-risk tribal communities; establish, measure, and report on progress toward meeting performance measures in six legislatively mandated benchmark areas; and participate in rigorous evaluation activities to build the knowledge base on home visiting among AI/AN populations. The ACF Office of Early Childhood Development (ECD) developed the Tribal MIECHV Implementation Plan (IP) Guidance and the Community Needs Readiness Assessment (CNRA) guidance to assist grant recipients in developing their home visiting programs and meet the requirements of their cooperative agreements. This request includes proposed revisions that were identified to streamline the reporting process, eliminate unnecessary items, and clarify the requests.

Abstract

This request is for an extension of an approved information collection: Voluntary Acknowledgement of Paternity and Required Data Elements for the Paternity Establishment Affidavit (OMB #0970-0171). The Administration for Children and Families (ACF) is proposing minor changes to the burden estimate as last updated in 2020. Section 466(a)(5)(C) of the Social Security Act requires States to enact laws ensuring a simple civil process for voluntarily acknowledging paternity via an affidavit. The State must provide that, before a mother and putative father can sign a voluntary acknowledgment of paternity, the mother and putative father must be given notice, orally and in writing of the alternatives to, the legal consequences of, and the rights (including any rights, if one parent is a minor, due to minority status) and responsibilities of acknowledging paternity. One affidavit needs to be filled out for each paternity established and the information cannot be provided any less frequently than once to each mother and putative father. The development and use of an affidavit for the voluntary acknowledgment of paternity would include the minimum requirements specified by the Secretary and to give full faith and credit to such an affidavit signed in any other State according to its procedures. The STD Surveillance Network provides critical clinical, demographic and behavioral information through enhanced and sentinel surveillance among people diagnosed with gonorrhea, syphilis and those persons seeking care at STD clinics in order to enhance STD surveillance data, to inform a more comprehensive understanding of epidemiologic trends and determinants of STDs of interest, monitor public health program impact and provide a more robust evidence base for directing public health action. This change request is to adhere to recent executive orders.
