What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

The Form ETA 741, the Occupational Code Assignment (OCA), is necessary to help occupational information users relate an occupational specialty or job title to an occupational code and title within the framework of the O*NET-SOC (Occupational Information Network-Standard Occupational Classification) based system. It helps provide occupational codes for jobs where duties have changed to the extent that the published information is no longer appropriate or the user is unable to classify the job on their own. The Occupational Code Assignment helps users obtain an O*NET-SOC code which allows for compatibility and standardization in the area of occupational coding.

Settlement Agreements Between a Plan and a Party in Interest

Key Information

Abstract

This information collection request relates to two prohibited transaction class exemptions (PTEs) that the Department has granted, both of which involve settlement agreements. These two exemptions are described below. PTE 94-71 exempts from certain restrictions of ERISA and certain taxes imposed by the Code, a transaction or activity that is authorized, prior to the execution of the transaction or activity, by a settlement agreement, to which the Department is a party, resulting from an investigation of an employee benefit plan conducted by the Department. The following information collections are among the conditions for the exemption: (1) A party engaging in a settlement agreement arising out of a Department investigation must provide written notice to the affected participants and beneficiaries of the plan at least 30 days prior to entry into the settlement agreement. The notice must contain an objective description of the transaction or activity, the approximate date on which the transaction will occur, the address of the regional or district office of the Department that negotiated the settlement agreement, and a statement informing participants and beneficiaries of their right to forward their comments to such office. (2) A copy of the notice and a description of the method by which it will be distributed must be approved in advance by the regional or district office of the Department which negotiated the settlement. PTE 2003-39 exempts from certain restrictions of ERISA and certain taxes imposed by the Code, transactions arising out of the settlement of litigation that involve: the release by the plan or a plan fiduciary of legal claims against parties in interest in exchange for payment given by or on behalf of the party in interest to the plan; an extension of credit by a plan to a party interest in connection with a settlement; and the plan's acquisition, holding, and disposition of employer securities received in settlement of litigation. The relief is granted provided certain conditions are met, such as the requirement of an independent fiduciary who has no relationship to, or interest in, any parties in the litigation to authorize the settlement and the settlement terms of the agreement and any extension of credit are reasonable and no less favorable than comparable arm's length agreement. The other conditions include the following information collections: (1) The terms of the settlement must be specifically described in a written agreement or consent decree. (2) The fiduciary acting on behalf of the plan must acknowledge in writing that the person is a fiduciary with respect to the settlement of the litigation. (3) The plan fiduciary must maintain records of the transaction for six years and must disclose the records on request to the Department and other interested persons.

Key Information

Abstract

The purpose of the Gaining Early Awareness and Readiness for Undergraduate Programs (GEAR UP) partnership and state applications is to allow partnerships and states to apply for funding under the GEAR UP program. GEAR UP, created in the Higher Education Act Amendments of 1998 (Title IV, Section 404A-404H), is a discretionary grant program which encourages applicants to provide support and maintain a commitment to eligible low-income students, including students with disabilities, to assist the students in obtaining a secondary school diploma and preparing for and succeeding in postsecondary education. GEAR UP provides grants to partnerships and states to provide services at high-poverty middle and high schools. GEAR UP grantees serve an entire cohort of students beginning no later than the seventh grade and follow them through graduation and, optionally, the first year of college. We are requesting a reinstatement without change of the previously approved GEAR UP applications (OMB number 1840-0821). This discretionary grant program falls under the streamlined grant process, 1894-0001, which waives the 60-day comment period.

Federal Railroad Administration Alleged Violation and Inquiry Form

Key Information

Abstract

The FRA Alleged Violation and Inquiry Form is a response to section 307(b) of the Rail Safety Improvement Act of 2008, which requires FRA to “provide a mechanism for the public to submit written reports of potential violations of Federal railroad safety and hazardous materials transportation laws, regulations, and orders to the Federal Railroad Administration.” The FRA Alleged Violation and Inquiry Form allows the public to submit alleged violations, complaints, or inquiries directly to FRA. The form allows FRA to collect information necessary to investigate the alleged violation, complaint, or inquiry, and to follow up with the submitting party. This information collection is voluntary, submitted as needed, and there is no requirement for recordkeeping. Note: FRA has revised the title of OMB Control Number 2130–0590 (formerly titled ‘‘Alleged Violation Reporting Form’’).

Patent and PTAB Pro Bono Programs

Key Information

Abstract

The Leahy-Smith America Invents Act (AIA), Public Law 112–29 § 32 (2011) directs the USPTO to work with and support intellectual property law associations across the country in the establishment of pro bono programs designed to assist financially under-resourced independent inventors and small businesses (also referred to as “regional hubs”). To support this, the USPTO works with and supports various non-profit organizations to operate a series of autonomous regional hubs that endeavor to match low-income inventors with volunteer patent practitioners across the United States. The regional hubs comprise law schools, bar associations, innovation/entrepreneurial organizations, and arts-focused lawyer referral services that are strategically located to provide access to patent pro bono services across all fifty states, the District of Columbia, and Puerto Rico. To support the purposes described above, the Patent Pro Bono Survey collects information regarding the activity of the regional hubs. The USPTO works with the Pro Bono Advisory Council (PBAC) to determine what information is necessary to evaluate the effectiveness of each regional hub’s operations. The PBAC is a well-established group of patent practitioners and thought leaders in intellectual property who provide support and guidance to the regional hubs across the country. The data collected provides the USPTO with valuable information, including the number of inventor inquiries, referral sources, number of pro bono applicants successfully matched with patent practitioners, and types of patent filings. The USPTO, PBAC, and the regional hubs, are responsible for the quarterly collection of this data. The USPTO’s Patent Trial and Appeal Board (PTAB), collaborates with the PTAB Bar Association (PTAB Bar Assoc.), a non-profit organization focused on helping secure the just, speedy, and inexpensive resolution of every PTAB proceeding and serves the public by coordinating pro bono opportunities. The PTAB and the PTAB Bar Assoc. established a national clearinghouse that acts as a matchmaker to connect under-resourced inventors with volunteer patent practitioners across the United States for assistance in preparing and arguing ex parte appeals before the PTAB. The PTAB Bar Assoc.’s national clearinghouse provides nationwide access to legal representation for pro bono ex parte appeal services. The PTAB Pro Bono Program supports the purposes described above by facilitating the availability of pro bono services for proceedings before the PTAB, which the USPTO believes can help reduce the financial burden on under-resourced inventors seeking ex parte appeal assistance, especially those impacted by the pandemic.

These interim final regulations set forth rules implementing revisions to the Public Health Service (PHS) Act section 2719 for internal claims and appeals and external review processes to implement Section 110 of the No Surprises Act (NSA), which protects participants, beneficiaries, and enrollees in group health plans and group and individual health insurance coverage from receiving surprise medical bills when they receive emergency services, non-emergency services from non-participating providers at participating facilities, and air ambulance services, under certain circumstances. Specifically Section 110 of the NSA amends section 2719 of the PHS Act to require the external review process to apply to participants, beneficiaries, and enrollees of such plans with respect to any adverse determination by a plan or issuer under section 2799A-1 or 2799A-2 of the PHS Act. These protections also extend to grandfathered plans.

Section 10201(i) of the Affordable Care Act (ACA) added provisions under Section 1115 of the Social Security Act to require the Secretary to publish no later than 180 days after the enactment of this act, regulations that establish application requirements for demonstration projects. Under section 10201(i) of ACA the Secretary must establish a process for public notice and comment at the State level, and at the federal level after an application for a demonstration project is received by the Secretary. Abstract

The North American Breeding Bird Survey (BBS) assists in fulfilling the Secretary of Interior's responsibilities under the Fish and Wildlife Conservation Act by collecting avian population data for numerous migratory nongame birds in the United States. The BBS is a long-term, large-scale avian monitoring program to track the status and trends of North American bird populations. Volunteers conduct avian point counts once per year during the breeding season (primarily June). Volunteers skilled in avian identification listen for 3 minutes at 50 stops along the route recording all birds seen or heard. Data are submitted electronically via the Internet or on hard copy. These data are used to estimate population trends and abundances at various geographic scales and assist with documenting species distribution.

Abstract

The Patient Protection and Affordable Care Act, Pub. L. 111-148, was signed into law on March 23, 2010, and the Health Care and Education Reconciliation Act of 2010, Pub. L. 111-152, was signed into law on March 30, 2010 (these are collectively known as the "Affordable Care Act"). The Affordable Care Act amends the Public Health Service Act (PHS Act) by adding section 2715 "Development and Utilization of Uniform Explanation of Coverage Documents and Standardized Definitions." Section 2715 directs the Secretary, in consultation with the National Association of Insurance Commissioners and a working group comprised of stakeholders, to develop standards for use by a group health plan and a health insurance issuer in compiling and providing to applicants, enrollees, and policyholders and certificate holders a summary of benefits and coverage (SBC) that accurately describes the benefits and coverage under the applicable plan or coverage. Section 2715 also directs the Secretary to provide for the development of standards for the defintions of terms used in health insuance. Finally, section 2715 requires 60-days advance notice of any material modification in any of the terms of the plan or coverage that is not reflected in the most recently provided SBC. To implement these disclosure requirements, the final rule would require a collection of information by health insurance issuers in the group and individual markets and third-party administrators. SBA received funds under the American Rescue Plan Act of 2021 (ARP Act), Pub. L. 117-2, title V, sec. 5003 (March 11, 2021), to provide direct funds to Eating and Drinking establishments that meet certain conditions. Specifically, Section 5003 of the ARP Act establishes the Restaurant Revitalization Fund (RRF) program to provide direct funds of up to $10 million dollars and limited to $5 million dollars per location to certain eligible persons or entities: a restaurant, food stand, food truck, food cart, caterer, saloon, inn, tavern, bar, lounge, brewpub, tasting room, taproom, licensed facility or premise of a beverage alcohol producer where the public may taste, sample, or purchase products, or other similar place of business in which the public or patrons assemble for the primary purpose of being served food or drink. Abstract

The Medicare Current Beneficiary Survey (MCBS) is a continuous, multipurpose survey of a nationally representative sample of aged, disabled, and institutionalized Medicare beneficiaries. MCBS, which is sponsored by the Centers for Medicare & Medicaid Services (CMS), is the only comprehensive source of information on the health status, health care use and expenditures, health insurance coverage, and socioeconomic and demographic characteristics of the entire spectrum of Medicare beneficiaries. The purpose of this revision is to seek approval for CMS to add new items related to beneficiary-centric provisions of the Inflation Reduction Act (IRA) of 2022 to the MCBS Community Questionnaire beginning in 2025 . The new items cover improved measures, streamlined content, and the addition of important IRA-related topics as requested by OMB in their terms of clearance specified in the approval of the 2024 MCBS.

Examining the Effectiveness of Lane Departure Warning and Lane Keep Assist Advanced Driver Assistance Systems for Improving Driver Response

Abstract

This information collection request (ICR) from the National Highway Traffic Safety Administration (NHTSA) of the U.S. Department of Transportation is to seek approval to conduct 11 voluntary information collections as part of a one-time research study involving up to 80 licensed drivers of various ages. The purpose of the research study is to examine the effectiveness of lateral control advanced driver assistance systems (ADAS) for improving driver response, with specific focus on Lane Departure Warnings (LDW) and Lane Keep Assist (LKA). The respondents will participate in two separate driving data collection sessions. Within this study, NHTSA’s contractor, the Virginia Tech Transportation Institute (VTTI), will instrument two research vehicles with data acquisition systems (DAS). The DAS includes video cameras and sensors that allow for collecting continuous data that encompasses driver behavior and vehicle performance. The completion of the two drives will take place on different days. Recruitment of study respondents is from southwest Virginia, specifically the New River Valley and surrounding areas (Roanoke, Salem, etc.). The target for the study is 50 participants, completing both sessions and with valid data collected for each; therefore, the research team will contact up to an estimated 340 potential research participant, to identify approximately 85 respondents who will be eligible for participation and complete the informed consent process, estimating that up to 80 respondents will participate in the driving sessions. Since the research study involves driving sessions on two different days, recruitment of up to 80 respondents is needed to account for attrition and potential replacements to ensure that the research study includes 50 participants who complete both the Session 1 and Session 2 drives. This ICR includes the following information collections: (1) a pre-screening questionnaire; (2) an informed consent form; (3) a vision and hearing evaluation; (4) Knowledge and Opinions Questionnaire; (5) the Session 1 controlled drive; (6) the Session 1 post-condition questionnaire; (7) the Session 1 post-drive questionnaire; (8) the Session 2 naturalistic drive, LDW subset; (9) the Session 2 LDW subset post-drive questionnaire; (10) the Session 2 naturalistic drive, LDW/LKA subset; and (11) the Session 2 LDW/LKA post-drive questionnaire. The purpose of the research study and its associated information collections is to help NHTSA better understand the effectiveness of lateral control systems, the human factors that affect the performance of lane departure warning (LDW) and lane-keep assistance (LKA) systems, and about the system characteristics that will favor better acceptance. This will, in turn, help NHTSA to develop, implement, and maintain effective countermeasures that meet the agency’s mandate to reduce the number of deaths, injuries, and economic losses resulting from motor vehicle crashes on the U.S. highways. The planned data collection activities discussed herein have been approved by Virginia Tech’s Institutional Review Board (IRB). NHTSA will use the information collected to produce a technical report containing summary statistics and tables. No identifying information or individual responses will be reported. The technical report will be made available to a variety of audiences interested in improving highway safety through the agency website and the National Transportation Library. This is a new information collection that is estimated at 272 annual burden hours.

Post Enrollment Data Collection for Job Corps Participants

Key Information

Abstract

The 2014 Workforce Innovation Opportunity Act (WIOA) required the Office of Job Corps to collect and report specific post enrollment outcomes for eligible Job Corps participants beginning in Program Year (PY) 2016. The WIOA performance reporting requirements, which replaced those of the 1998 Workforce Investment Act (WIA), are designed to provide a common set of metrics to be reported by similar programs. WIOA substantially changed many outcome metrics for Job Corps compared to those required under WIA and provided new guidance on the definition of high performing and low performing centers. In order to collect the necessary information to meet the new WIOA reporting requirements, the Office of Job Corps revised its post enrollment data collection system (PEDC) in 2019, which primarily collects data through survey instruments.
