What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This is a request for revision and extension of an existing information collection. NOAA is submitting this request for OMB approval to modify two forms that are currently in use but which have changed very slightly. 1) Send2NCEI has been modified to add a ‘License Type’ selection field. 2) InPort has been modified to replace the ‘File Type’ free text field with a ‘Distribution Format’ drop down value picker. Neither of these modifications will impact the time burden. The National Oceanic and Atmospheric Administration (NOAA) provides several digital forms-based tools enabling data producers to create geospatial metadata conforming to International Standards Organization (ISO) standards. These tools collect very similar information but provide specific assistance for different scientific communities across the diverse spectrum of earth, ocean, atmospheric, and fisheries resources. In 1994, Executive Order 12906 established the National Spatial Data Infrastructure and directed each agency to “document all new geospatial data it collects or produces… using the standard under development by the FGDC...”. In 2010, the FGDC adopted the ISO 19115/19139 suite of standards for use by Federal agencies to document geospatial data. The voluntary information collection using these tools facilitates NOAA and others in Federal, State, or local governments, academic institutions, and others to provide clear descriptive information (metadata) about geospatial data. Metadata requested in the tools identifies the data provider, data collector(s), data collection dates, and other information that make the described data useful to other researchers and future users of the described data. Each tool reorganizes descriptive information into an XML file that conforms to the ISO19115-2 Geospatial Metadata standard and the ISO19139 Geographic information Metadata XML schema implementation. A significant advantage for a data provider using one of these tools is that the information is collected through a series of short form-based pages that provide suggestions for entries from established keyword lists and other standard responses. Data providers may opt to use suggested entries or to enter free text into the forms.

Abstract

As required by the Federal Alcohol Administration Act (FAA Act) at 27 U.S.C. 205(e) and (f), the Alcohol and Tobacco Tax and Trade Bureau (TTB) has issued regulations regarding the labeling and advertising of wine, distilled spirits, and malt beverages, which are contained in 27 CFR parts 4, 5, and 7, respectively. The FAA Act provides that these regulations should, among other things, prohibit consumer deception and the use of misleading statements on labels and ensure that labels provide the consumer with adequate information as to the identity and quality of the product. Under those TTB regulations, bottlers and importers of alcohol beverages must provide certain mandatory information, conform to regulatory requirements regarding certain voluntary disclosures, and adhere to certain presentation standards for statements made on labels and in advertisements of alcohol beverages. Those regulations ensure that consumers are provided with adequate, legible, and non-deceptive or misleading information as to the identity and quality of such products. The information collection requirements related to the required alcohol label and advertising disclosures are approved under OMB No. 1513-0087. Under TTB's FAA Act authority, TTB is issuing two proposed rules affecting this information collection: Notice No. 237, Alcohol Facts Statements in the Labeling of Wines, Distilled Spirits, and Malt Beverages (RIN 1513–AC93), and Notice No. 238, Major Food Allergen Labeling for Wines, Distilled Spirits, and Malt Beverages (RIN 1513–AC94). In the first proposed rule, TTB is proposing to require disclosure of per-serving alcohol, calorie, and nutrient content information in an “Alcohol Facts” statement on all alcohol beverage labels subject to TTB’s regulatory authority under the FAA Act. In the second proposed rule, TTB is proposing to require a labeling disclosure of all major food allergens used in the production of alcohol beverages subject to TTB’s regulatory authority under the FAA Act. Under the proposed regulations, unless an exception applies, labels must declare milk, eggs, fish, Crustacean shellfish, tree nuts, wheat, peanuts, soybeans, and sesame, as well as ingredients that contain protein derived from these foods, if used in the production of the alcohol beverage. In each proposed rule TTB is proposing a compliance date of 5 years after the date of a related final rule’s publication in the Federal Register.

Abstract

Under the authority of chapter 51 of the Internal Revenue Code of 1986, as amended (IRC, 26 U.S.C. chapter 51), the Alcohol and Tobacco Tax and Trade Bureau (TTB) regulations in 27 CFR Part 25, Beer, currently require brewers to place certain marks, signs, and measuring devices on their equipment and structures, and to place certain brands, labels, and marks on bulk and consumer containers of beer and other brewery products. The collected information allows TTB to identify the use, capacity, and contents of brewery equipment and structures, and to identify brewery products and the responsible taxpayer. Other collected information allows consumers to identify brewery products, their content, and their producers. In a proposed rule titled “Alcohol Facts Statements in the Labeling of Wines, Distilled Spirits, and Malt Beverages,” issued under its IRC authorities, TTB is proposing to require an alcohol content statement to appear on the labels of consumer containers of domestic and imported beers that are not currently subject to such labeling requirements under the Federal Alcohol Administration Act (FAA Act). The collected information will allow TTB to identify the alcohol content of taxable brewery products currently not subject to such a labeling requirement subject. As such, the required information is necessary to protect the revenue and ensure effective administration of the IRC’s provisions regarding brewery operations and products. The collected information also allows (or will allow) other industry members and the general public to identify the contents of bulk containers of beer and other brewery products and identify the contents and alcohol content of consumer containers of beer. In general, for other than the proposed alcohol content statement, TTB believes that the collection of the required information is a usual and customary practice undertaken during the normal course of business, regardless of any TTB regulatory requirements to do so, for the purposes of inventory control, cost accounting, equipment utilization, and product quality control and identification.

Abstract

The Internal Revenue Code (IRC) at 26 U.S.C. 5041 imposes a per gallon Federal excise tax of varying rates on six classes of wine—three classes of still wines (based on alcohol content), two classes of effervescent wines, and one class of hard cider. Under the authority of the IRC at 26 U.S.C. 5368, 5388, and 5662, the TTB regulations in 27 CFR Part 24, Wine, require wine premises proprietors to correctly identify wines kept on or removed from their premises by placing certain marks, labels, or other information on all production, storage, and consumer containers of wine. In a proposed rule titled “Alcohol Facts Statements in the Labeling of Wines, Distilled Spirits, and Malt Beverages,” issued under its IRC authorities, TTB is proposing to require an alcohol content statement to appear on the labels of consumer containers of domestic and imported wine that are not currently subject to such labeling requirements under the Federal Alcohol Administration Act (FAA Act). Because of the varying excise tax rates on wines, and because different tax classes of wine may be produced at the same premises, the required information is necessary to protect the revenue as it ensures that wines are correctly identified for excise tax purposes. TTB has determined that the placement of the required marks on wine containers, other than the proposed alcohol content statement, is a usual and customary business practice undertaken by respondents regardless of any regulatory requirement to do so. As such, per the OMB regulations at 5 CFR 1320.3(b)(2), the great majority of this information collection request imposes no burden hours on respondents.

Abstract

The Administration on Children, Youth and Families' (ACYF) Family and Youth Services Bureau (FYSB) publishes a notice of funding opportunity (NOFO) to solicit applications from states and territories for the development and implementation of the Title V State Sexual Risk Avoidance Education (SRAE) Program. The purpose of the Title V State SRAE Program is to fund states/territories to implement education exclusively on sexual risk avoidance that teaches youth participants to voluntarily refrain from non-marital sexual activity. States and territories are expected to submit plans for the implementation of sexual risk avoidance education that normalizes the optimal health behavior of avoiding non-marital sexual activity, with a focus being on the future health, psychological wellbeing, and economic success of youth. Further, the plans must address the social, psychological, and health gains to be realized by refraining from non-marital sexual activity and engaging in healthy relationships. This request is to make updates to remove equity-related indicators from the SRAE Performance Progress Report.

Abstract

The Personal Responsibility and Work Opportunity Re¬conciliation Act of 1996 (PRWORA) amended the Social Security Act and created the opportunity under §412 for Federally recognized Indian Tribes to design and operate their own Temporary Assistance for Needy Families (Tribal TANF) programs. Subject to approval by the Federal government of their plans, Tribes can receive block grants from the Federal government for this purpose (Tribal grantees). Indian Tribes and Tribal organizations are defined by PRWORA as having (except for Alaska) the meaning given such terms by section 4 of the Indian Self - Determina¬tion and Educa¬tion Assistance Act (25 U.S.C. 450b). For Alaska, the non-profit arms of the Alaskan Native Corporations and the Metlakatla Indian Community, Annette Island Reserve are specified as the only entities eligible to be Tribal TANF grantees. Section 412(g) of PRWORA imposed on Tribal grantees the data collection and reporting requirements of §411. Section 411(a)(1)(A) specifies the data items to be reported. Additional data collection requirements are imposed by §407 (work participation requirements) as modified by §412(c) ('negotiated' Minimum Work Participation Requirements and Time Limits) and §411(b) (Report to Congress). The data are used to assess Tribal TANF programs to determine if Tribal grantees have met their negotiated work participation rates and to meet Congressional mandated requirements of §411(a)(1)(A) of PRWORA. The data are also used to measure impacts of Tribal TANF for research and program improvement and to provide descriptions of the populations served, which are published annually on OFA’s website and in TANF’s annual report to Congress. Pursuant to the U.S. Office of Personnel Management (OPM) Initial Guidance Regarding Executive Order Defending Women provided on January 29, 2025, OFA proposes a few minor changes to the Tribal TANF Data Report Instructions to ensure alignment with OPM guidance. We are requesting expedited approval of these minor changes.

Abstract

CMS uses the risk adjustment data to develop individual risk scores for risk adjusted payment under Part C. As required by law, CMS also establishes the risk adjustment methodology and annually publishes the risk adjustment factors for MA organizations and other interested entities in the Advance Notice of Methodological Changes for MA Payment Rates (every February) and the Announcement of Medicare Advantage Payment Rates (every April). Risk adjustment data in particular is used to calibrate the CMS-HCC risk adjustment models using MA patterns of diagnoses, utilization, and expenditures. While establishing a risk adjustment model appropriate for the MA program is the paramount reason for collecting MA risk adjustment, there are other important uses of the data that will improve other key functions undertaken by CMS. Data is used for the calculation of Medicare Disproportionate Share Hospital (DSH) payments. CMS collects inpatient stay information for the Medicare managed care enrollees. In particular, we collect the admission date, discharge date, Health Insurance Claim Number (HICN), and Medicare hospital number/CCN. Further, we also use the data for quality review and improvement activities. For example, MA risk adjustment data may be used in the development and calculation of quality measures for MA organizations. Other uses for the data include geographical acuity studies, utilization trends and detection of abuse as defined in the False Claim Act. Additional uses for the data include verifying the accuracy and validity of the reasonable costs claimed on Cost Reports submitted by section 1876 Cost HMOs/CMPs and section 1833 HCPPs. Finally, as stated in the regulation, we use the data for Medicare coverage purposes. For example, we can use risk adjustment data for the determination of whether day limits have been exhausted and, if not, how many such days are left.

ACF Performance Progress Report - Program Indicators

Abstract

The Office of Grants Management (OGM), in the Administration for Children and Families (ACF) is proposing the continued collection of program performance data for ACF’s discretionary grantees. In 2016, OGM developed the ACF-OGM-SF-PPR-B to collect this data based on the basic template of the OMB-approved reporting format of the Program Performance Report. The form was renewed in 2019 with no changes. OGM now seeks to renew the ACF-OGM-SF-PPR-B for continued use by ACF with minor changes to improve the function of the form and utility to the federal government. This includes the addition of a program indicator to collect information on activities recipients conducted during the reporting period to address or advance equity. Addition of this program indicator supports the Biden-Harris Administration’s equity agenda as outlined in Executive Order 13985, Advancing Racial Equity and Support for Underserved Communities Through the Federal Government. Other minor updates are described in A15 of Supporting Statement A. The requirement for grantees to report on performance is OMB grants policy. Specific citations are contained in: (1) 2 CFR 215 Uniform Administrative Requirements, cost Principles, and Audit Requirements for Federal Awards and (2) 45 CFR 75, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Department of Health and Human Services Awards. The Office of Grants Management (OGM), in the Administration for Children and Families (ACF) is proposing to update the form used for the collection of program performance data for ACF’s discretionary grant recipients. In 2016, OGM developed the ACF-OGM-SF-PPR-B to collect this data based on the basic template of the OMB-approved reporting format of the Program Performance Report and has renewed approval since implementation. OGM has made updates to the instructions to ensure they are current and clear and revised a program indicator in response to Executive Order 14151, Ending Radical and Wasteful Government DEI Programs and Preferences. This is a request for revisions to reword the submission instructions, change of the term grantee to recipient and remove an equity-related activity program indicator.

State Court Improvement Program

Abstract

Authorizing legislation makes clear that an application is required in order for State courts to receive CIP funding. A copy of the statute is attached with this submission for review (Attachment A - SSA Section 438). There are two parts of the application, which are necessary to properly administer the State Court Improvement Program (CIP): an annual year-end self-assessment report with an updated strategic plan. A complete application is required from state courts every five years which includes the self-assessment and new strategic plan. Annually, the self-assessment should thoroughly be updated to reflect progress and challenges over the prior year. The strategic plan is to be written as a five-year plan which looks forward and is updated as needed annually. Because it is a high-level summary, and the two documents work in tandem, the primary burden annually is completing the more detailed self-assessment and updates to strategic plans are often minor notes that flow out of that review. These documents are required to monitor progress of the program according to statute. Both the self-assessment and strategic plan template were developed with in-depth grantee input and feedback. The goal has been to design a process and tools that meet reporting requirements but also serve as helpful documents to grantees in conducting their work. The Self-Assessment had one optional Diversity, Equity, Inclusion, and Accessibility question and one bulleted item in another question that we request be removed to comply with the above Executive Orders. The Strategic Plan template did not have any items relevant to the following Executive Orders: Ending Radical and Wasteful Government Diversity, Equity, and Inclusion Programs and Preferencing and Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government

Abstract

The Trafficking Victims Protection Act (TVPA) of 2000, as amended, directs the Secretary of the U.S. Department of Health and Human Services (HHS), upon receipt of credible information that a foreign national minor may have been subjected to a severe form of trafficking in persons and is seeking assistance available to victims of trafficking, to promptly determine if the child is eligible for benefits and services to the same extent as refugees. In 2015 HHS delegated this authority to the Office on Trafficking in Persons (OTIP). OTIP developed a form (Request for Assistance (RFA), OMB Control Number 0970-0362) for case managers, attorneys, law enforcement officers, child welfare workers, and other representatives to report these trafficking concerns to HHS in accordance with the TVPA of 2000, as amended, and allow for OTIP to review the concerns and determine eligibility for benefits. The information provided through the completion of the RFA form is essential for OTIP to make prompt determinations regarding a foreign national minor’s eligibility for assistance, to facilitate the required consultation process should the minor receive interim assistance, and to assess and address potential child protection issues. Without a form, OTIP would be limited to notifying potential requesters about the assistance the law permits and providing a phone number or email address at OTIP for further information. An OTIP Child Protection Specialist would then have to describe to each potential requester the information sought in the form, which would likely require multiple follow-up calls, and possibly multiple interviews with the child, which could re-traumatize the child. Furthermore, the absence of a form to collect information necessary to process a request for assistance could result in errors in the information collection causing a child that should be eligible for benefits and services as a victim of trafficking to be denied access to assistance. ACF has implemented changes to update gender collected data to denote sex as a biological variable in current approved information collection requests to comply with recent presidential directives.

The Administration for Children and Families (ACF) is requesting an extension with no changes to this information collection, which was originally approved in October 2023 through an emergency review, as authorized under 44 U.S.C. 3507 (subsection j). The forms under this request enable ACF’s Office of Human Services Emergency Preparedness and Response (OHSEPR) to provide case management support during disasters. The Disaster Human Services Case Management (DHSCM) program is authorized through appropriations language under the Children and Families Services account. It is operated by the Administration for Children and Families' (ACF) Office of Human Services Emergency Preparedness and Response (OHSEPR). OHSEPR is the lead in the Department for Health and Human Services (HHS) for human service preparation for, response to, and recovery from, natural disasters. The SOAR (Stop, Observe, Ask, Respond) to Health and Wellness Training (SOAR) Demonstration Grant Program was developed in response to the Trafficking Victims Protection Act of 2000 (Public Law 106-386), § 106(b), as amended (22 U.S.C. 7104(b)(1) and 22 U.S.C. 7105(b)(1)(B), which calls on agencies to “increase public awareness of the dangers of trafficking and the protections that are available for victims of trafficking” and provide “services to assist potential victims of severe forms of trafficking in persons.” The program’s goal is to fund the implementation of SOAR trainings and capacity building efforts to identify, treat, and respond to patients or clients who have experienced severe forms of human trafficking as defined by the Trafficking Victims Protection Act (TVPA) of 2000, as amended, among their patient or client population. SOAR is a nationally recognized, accredited training program delivered by OTIP’s National Human Trafficking Training and Technical Assistance Center (NHTTAC) and designed to help target audiences identify and respond to those who are at risk of, are currently experiencing, or have experienced trafficking and connect them with needed resources. This information collection will enable OTIP to measure grant project performance, provide technical assistance to grant recipients, assess program outcomes, inform program evaluation, respond to congressional inquiries and mandated reports, including required contributions to the annual Attorney General’s Annual Report to Congress on U.S. Government Activities to Combat Trafficking in Persons. National Human Trafficking Hotline (NHTH) Performance Indicators

Abstract

Section 107(b)(1)(B)(ii) of the Trafficking Victims Protection Act of 2000 (TVPA), as amended at 22 U.S.C. § 7105(b)(1)(B)(ii), authorizes the Secretary of Health and Human Services to make a grant for a national communication system—the National Human Trafficking Hotline (NHTH)—to assist victims of severe forms of trafficking in persons in seeking help, receiving referrals, and reporting potential trafficking situations. The Office on Trafficking in Persons (OTIP) made an award in the form of a Cooperative Agreement to a single, competitively selected grant recipient to maintain and support operation of the NHTH throughout the United States and U.S. territories. The NHTH is a toll-free hotline, that operates 24 hours a day, every day of the year. National Human Trafficking Hotline Performance Indicators (OMB #0970-0598) is an active and approved collection of aggregate information about signalers (individuals who contact the NHTH) and from signalers regarding potential victims of a severe form of trafficking in persons and potential human trafficking situations. The information collected is reported on a monthly, semi-annual, and annual basis, and is necessary to support the monitoring of work done through the cooperative agreement, to ensure signalers receive the information and support requested, and to provide appropriate technical assistance (TA) to the grant recipient. To address performance issues and streamline internal signal processing procedures, the NHTH has audited its data collection practices and has identified indicators that are no longer in use, relevant, or otherwise necessary that can be removed to reduce the data collection and reporting burden on Hotline Advocates, the individuals employed by the grant recipient organization to operate the NHTH. This process included efforts to collapse, condense, or otherwise simplify lists of data elements for clarity. Per the Supporting Statement, this information collection does not seek to collect any information from signalers (respondents) that they would not otherwise provide to Hotline Advocates in order to seek help, receive referrals, or report potential trafficking cases. None of the proposed changes impact front-end data collection, or the questions that Hotline Advocates ask to ascertain the purpose of a signal and the signaler’s desired response (i.e. to issue a referral or make a tip). By contrast, each of the proposed changes impact only the solely-awarded grant recipient and the changes are being informed by efforts by the recipient described above. This request aims to bring the collection into alignment with the grant recipient’s back-end data collection practices (i.e. what Hotline Advocates record in their case management database to summarize the signal and actions taken in response). Each of the changes proposed seek to improve data capture and data quality.

The Low Income Home Energy Assistance Program (LIHEAP) block grant (42 U.S.C. 8621) was established under Title XXVI of the Omnibus Budget Reconciliation Act of 1981, P. L. 97-35. The Office of Community Services (OCS) within the Department of Health and Human Services' (DHHS) Administration for Children and Families (ACF) administers LIHEAP at the Federal level. The LIHEAP Household Report is an annual data collection effort conducted by OCS to collect information from LIHEAP grantees to meet statutory requirements and program objectives. The LIHEAP statute requires the collection of data on the number of households assisted, their income levels, and vulnerability group, by type of LIHEAP assistance, for inclusion in the Secretary’s annual LIHEAP Report to Congress. The data are collected through the LIHEAP Household Report, which consists of the following: (1) a Long Format for state grant recipients, the District of Columbia, and select territory grant recipients, and (2) a Short Format for tribal grant recipients and select territory grant recipients. The purpose of the Mental Health Assessment is to collect standardized health information on unaccompanied children during evaluations with mental health providers. The following two Administration for Children and Families (ACF) Office of Refugee Resettlement (ORR) information collections capture health data on children in ORR care: • Medical Assessment Form and Dental Assessment Form • Mental Health Assessment Form and Public Health Investigation Form: Active TB, and Public Health Investigation Form: Non-TB Illness. ORR has recently identified a specific need to share data collected on ORR’s health assessment forms that falls outside of the stated limitations with the Department of Homeland Security (DHS). The need to communicate with DHS occurs when a newly referred child arrives at an ORR facility ill or requires emergent/urgent healthcare services shortly after placement and ORR was not notified in advance. For DHS to investigate the event, ORR must share confidential and sensitive health information including the child’s alien number, name, signs/symptoms, diagnoses, and date of diagnosis. The goal of this data sharing effort is to identify areas of potential improvement in delivery of healthcare services and continuity of care for children transferred from DHS to HHS custody.
