What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Objective Work Plan (OWP) information collection is conducted in accordance with 42 USC of the Native American Programs Act of 1972, as amended. This collection is necessary to evaluate applications for financial assistance and determine the relative merits of the projects for which such assistance is requested, as set forth in Sec. 806 [42 USC 2991d-1](a)(1). The Ongoing Progress Report (OPR) information collection is conducted in accordance with Sec. 811 [42 USC 2992] of the Native American Programs Act and will allow the Administration for Children and Families (ACF) Administration for Native American (ANA) to report quantifiable results across all program areas. It also provides grantees with parameters for reporting their progress and helps ANA better monitor and determine the effectiveness of their projects. This request includes revisions to the currently approved OPR and a request for an extension for the OPR and the OWP; there are no changes proposed to the OWP. ANA would like to coordinate the review and approval of the OWP/OPR and the Project Outcomes Assessment Survey (POAS) (OMB #0970-0379) information collection to align expiration dates in the future. ANA is currently revising the POAS in accordance with Executive Order (E.O.) 14112 (Reforming Federal Funding and Support for Tribal Nations To Better Embrace Our Trust Responsibilities and Promote the Next Era of Tribal Self-Determination) so took the opportunity to review and make updates, as needed, to the materials under this OMB number and is now submitting the updated materials in coordination with a revision request for OMB #: 0970-0379.

Key Information

Abstract

Early research and development work has demonstrated the value of a high-quality panel to improve representativeness and significantly reduce burden on respondents in the interest of collecting high-frequency data. The Military Panel is a national survey panel by the U.S. Census Bureau (Census) and the U.S. Department of Defense (DOD). Data collected from service members and their spouses on a variety of topics through the Panel will be used to improve military life and policies affecting active-service members and their families. The panel will consist of active-duty service members and spouses of active-duty service members that have agreed to be contacted and invited to participate. The goal for the overall panel project is to recruit at least 2,000 panel members (1,000 service members and 1,000 spouses), with data collection taking place once every two months, through fiscal year 2025.

Abstract

Public Law 117-333 Section 11, enacted January 5, 2023, amends title 38 CFR §3672, “Approval of Courses”. This provision of the law required VA to create and design two new uniform applications for approval of courses of educational programs, and for those forms to be available for use by October 1, 2023. These forms will be completed by educational institutions, training establishments and other organizations, as applicable, seeking approval of one or more of their programs of study for the payment of VA Education benefits to eligible beneficiaries. The institutions will submit the forms to the State Approving Agency (SAA) of jurisdiction for their review. By law, each SAA has the authority to make such approvals in their respective state. VA contracts with a SAA in each state for this work. Prior to the new legislative requirement, each SAA used their own application form making it difficult for training institutions operating in more than one state to readily complete the process as different states required different information. The new law ensures uniformity across all states. These forms will be used by educational institutions interested in applying for initial approval of their programs for payment of VA benefits, for revision of existing program approvals or withdrawal of approval for programs no longer offered. The institutions will complete either the VA Form 22-10287 or the VA Form 22-10288, based on the type of training offered at their institution. Institutions of Higher Learning (IHLs) will use the VA Form 22-10287 exclusively, and all other types of educational training establishments will use the VA Form 22-10288. Each institution will use their associated “program list” for adding, revising or removing any program they offer. Some administrative revision(s) may be required that do not involve program approval related matters, will be submitted on their respective application. In these instances, the associated program list will not be required. Administrative modifications include things such as changes of address, banking information, or ownership when all program offerings remain the same. The VA Forms 22-10287 and 22-10288 and their associated program lists will be submitted by the educational institution to the SAA of jurisdiction for review. The SAA makes an approval decision and notifies the institution accordingly. Immediately following, the SAA sends the approval package to the VA Education Liaison Representative (ELR) of jurisdiction. The approval package includes the application from the training institution, the SAA’s findings and additional related information to support payment of GI Bill benefits, as well as a copy of the notification to the training institution. The ELR reviews the approval package for completeness (or requests additional required information). Once the package is deemed complete, the ELR processes the package by entering the required information into WEAMS. Lastly, the ELR provides a report containing the final information to the training institution, with a copy to the SAA of jurisdiction. The approval data in WEAMS is used by Veterans Claims Examiners.

Abstract

The Federal Housing Finance Agency (FHFA) is required to conduct a monthly mortgage market survey under section 1324 of the Housing and Economic Recovery Act of 2008 (HERA). As part of that mandate, FHFA must collect information on the characteristics of individual subprime and nontraditional mortgages, as well as on the characteristics of borrowers on such mortgages, including information on the creditworthiness of those borrowers and information sufficient to determine whether those borrowers would have qualified for prime lending. The National Survey of Mortgage Originations (NSMO) questionnaire is designed to elicit this information directly from borrowers, who are likely to be the most reliable and accessible-and, in some cases, the only-source for this information. In addition, the questionnaire is designed to elicit more complete information on mortgage terms, mortgaged properties, and borrowers' household demographics than can be obtained from the existing sources. FHFA's intention is that the information obtained from the NSMB, in combination with that obtained from the existing sources, will make the National Mortgage Database a high quality, and timely resource for information on developments in the residential mortgage finance market. The NSMB will be especially critical in ensuring that the National Mortgage Database contains uniquely comprehensive information on the range of nontraditional and subprime mortgage products being offered, the methods by which these mortgages are being marketed and the characteristics, and particularly creditworthiness, of borrowers for these types of loans. These data will enable FHFA to fulfill its regulator mandate set out in HERA and support general rulemaking.

This revised information collection request updates addresses the reporting and recordkeeping requirements associated with the proposed rule to update the new chemicals procedural regulations at 40 CFR Parts 720, 721, 723, and 725 under the Toxic Substances Control Act (TSCA). The amendments included under this new chemicals procedural rule cover several goals, including in part to align the regulatory text with the amendments to TSCA’s new chemical review provisions contained in the Frank R. The Environmental Protection Agency (EPA) is finalizing a rule under section 6 of the Toxic Substances Control Act (TSCA) to address the unreasonable risk to human health presented by perchloroethylene (PCE) under its conditions of use. EPA is issuing a final rule under TSCA section 6(a) to: - Prohibit most industrial and commercial uses and the manufacture (including import), processing and distribution in commerce, of PCE for those uses; - Prohibit the manufacture (including import), processing, and distribution in commerce of PCE for all consumer use; - Prohibit the manufacture (including import), processing, distribution in commerce, and use of PCE in dry cleaning and related spot cleaning through a 10-year phaseout; - Require a PCE workplace chemical protection program (WCPP), which would include requirements to meet an inhalation exposure concentration limit and prevent direct dermal contact, for certain conditions of use not prohibited; - Require prescriptive workplace controls for laboratory use and energized electrical cleaner; - Establish recordkeeping and downstream notification requirements; and - Provide a 10-year time limited exemption under TSCA section 6(g) for certain emergency uses of PCE in furtherance of National Aeronautics and Space Administrations (NASA) mission, for specific conditions of use which are critical or essential and for which no technically and economically feasible safer alternative is available.

Abstract

Under several provisions of the OSH Act, employers may apply for four different types of variances from the requirements of OSHA standards. Employers submit variance applications voluntarily to OSHA, and the applications specify alternative means of complying with the requirements of OSHA standards. The four types of variances are: temporary variances (Section 6(b)(6)(A) of the OSH Act; 29 U.S.C. 655); experimental variances (Section 6(b)(6)(C) of the OSH Act; 29 U.S.C. 655); permanent variances (Section 6(d) of the Act; 29 U.S.C. 655); and national-defense variances (Section 16 of the OSH Act; 29 U.S.C. 665). The U.S. Environmental Protection Agency (EPA) makes competitive financial assistance awards to support projects that tackle environmental, public health, and energy challenges across the country. This is accomplished by working directly with community-based organizations (CBOs) and state, local, territorial, and tribal governments that have strong ties to the communities in which they are working. EPA fosters a collaborative approach to tackling some of the most critical challenges in the most overburdened communities by encouraging projects that involve multiple stakeholders including States, local governments, and tribal governments. To help get resources and funding to underserved and overburdened communities EPA offers Environmental Justice Collaborative Problem Solving (EJCPS) and Environmental Justice Government to Government (EJG2G) cooperative agreement programs. With this Information Collection Request (ICR), EPA seeks authorization to collect post-award information in the form of semi-annual progress reports and final reports from each grantee to track their progress, with respect to effectiveness (e.g., the extent to which projects achieved their objectives, goals, and targets), efficiency (e.g., the extent to which projects delivered activities and outputs on schedule and within budget), and equity (e.g., the extent to which investments and benefits flowed to disadvantaged communities that are marginalized, underserved, and overburdened by pollution). Abstract

The U.S. Environmental Protection Agency (EPA) makes competitive financial assistance awards to support projects that tackle environmental, public health, and energy challenges across the country. Historically, these investments have not reached communities and groups who are overburdened by the effects of pollution, environmental hazards, and climate change. To help get resources and funding to underserved and overburdened communities, the Inflation Reduction Act (IRA) created the Environmental and Climate Justice Block Grant Program (ECJP)the largest investment in environmental and climate justice in U.S. historywhen it was signed into law by President Biden on August 16, 2022. The Community Change Grants (CCG) are the final and most comprehensive piece of EPAs implementation of ECJP IRA funding. The CCG program will provide funding to communities and their partners to design, develop, and implement multi-faceted, community-driven projects to protect public health and the environment. Abstract

E.O. 13873, “Securing the Information and Communications Technology and Services Supply Chain,” (May 15, 2019) delegated to the Secretary of Commerce broad authority to prohibit or impose mitigation measures on any information and communications technology and services (ICTS) Transaction with a foreign adversary nexus that is subject to United States jurisdiction and poses undue or unacceptable risks to the United States. This request for a new information collection is necessary due to a regulation focused on Connected Vehicles. Declarations and Specific Authorizations will be used as tools to ensure compliance with our regulation and are integral to the success of this program. All VCS Hardware Importers or Connected Vehicle Manufacturers must submit a Declaration annually to attest that they are not knowingly engaging in an otherwise Prohibited Transaction.

TSCA Existing Chemical Risk Evaluation and Management - Generic ICR for Surveys (Renewal)

Abstract

The purpose of this ICR is to help fill data gaps for EPAs risk evaluations and risk management of existing chemicals under section 6 of TSCA. In accordance with TSCA section 26, EPA must make TSCA section 6 risk evaluation and risk management decisions consistent with the best available science and based on the weight of the scientific evidence. To carry out its statutory obligations, EPA needs sufficient information about chemicals undergoing risk evaluation and risk management, including information related to the chemicals conditions of use, hazards, exposures, potentially exposed or susceptible subpopulations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information. The collection of such information is subject to TSCAs strict statutory timeframes (set forth in section 6). Therefore, EPA is seeking approval for a generic information collection request (ICR) to conduct surveys of chemical users, processors, distributors, manufacturers (including importers), and recyclers, chemical waste handlers, consumers of chemical-containing products, employees who may be exposed to the chemical evaluated, state and local regulators, non-governmental organizations, industry experts, and knowledgeable members of the public (including potentially exposed or susceptible subpopulations) related to information collection for TSCA chemical risk evaluation and risk management. Surveys are defined as the collection of information from a common group through interviews or the application of questionnaires to a representative sample of that group. These information collection efforts are intended to supplement other reasonably available information on chemicals in commerce and will provide support for the Agencys policy and regulatory activities regarding existing chemicals under TSCA section 6. By learning more about the conditions of use, hazards, exposures, potentially exposed or susceptible subpopulations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information for chemicals being evaluated or regulated, EPA would be able to more precisely and effectively carry out its risk evaluation and risk management obligations under TSCA.

Medical Source Statement of Ability to Do Work-Related Activities

Abstract

When a claimant appeals a denied disability claim, SSA may ask the claimant to have a consultative examination at the agency’s expense, if the claimant’s medical sources cannot, or will not, give the agency sufficient evidence to determine whether the claimant is disabled. The medical providers who perform these consultative examinations provide a statement about the claimant’s state of disability. Specifically, these medical source statements determine the work-related capabilities of these claimants. SSA collects the medical data on the HA-1151 and HA-1152 to assess the work-related physical and mental capabilities of claimants who appeal SSA’s previous determination on their issue of disability. The respondents are medical sources who provide reports based either on existing medical evidence or on consultative examinations. We are submitting this Change Request to include two CFR citations from the rule-related ICR for 0960-0804 under this OMB approval. We will also submit the Discontinuation for 0960-0804 at the same time as we submit this Change Request. The addtion of these CFR ciations will increase the burden for this information collection.

Abstract

The Food and Drug Administration is proposing to establish tobacco product standards, including product standards that include provisions for nicotine yields and for the reduction or elimination of other constituents (including smoke constituents) or harmful components. The proposed rule, if finalized, would set forth the requirements to limit nicotine yield by setting a maximum nicotine content level for finished cigarettes and certain other finished combusted tobacco products not to exceed 0.70 mg of nicotine per gram of total tobacco. The information collection requirements support the need for the FDA to assure that the public health is protected, and tobacco products are in compliance with the requirements of the FD&C Act.
