Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

FCC rules require the display and advertising of radio frequency (RF) devices prior to equipment authorization or other determination of compliance with the rules, provided that the advertising or display contains a removable label as specified by the subject rules. In addition, any RF devices offered for sale in this matter must be accompanied by a written notice that is disclosed to third parties that the equipment is subject to, and will comply with, the FCC rules prior to delivery. Moreover, importing manufacturers will be required to maintain, for a period of 60 months, records identifying the recipients of RF devices imported for pre-sale activities.

On July 13, 2021, the Commission released a Second Report and Order and Second Further Notice of Proposed Rulemaking, Promoting Technological Solutions to Combat Contraband Wireless Devices in Correctional Facilities, GN Docket No. 13-111, FCC 21-82, in which the Commission took further steps to facilitate the deployment and viability of technological solutions used to combat contraband wireless devices in correctional facilities. In the Second Report and Order, the Commission adopted a framework requiring the disabling of contraband wireless devices detected in correctional facilities upon satisfaction of certain criteria. The Commission further addressed issues involving oversight, wireless provider liability, and treatment of 911 calls. Finally, the Commission adopted rules requiring advance notice of certain wireless provider network changes to promote and maintain contraband interdiction system effectiveness.

Evaluation of the REL Appalachia Teaching Math to Young Children Toolkit

Key Information

Abstract

Mathematics knowledge acquired in early childhood provides a critical foundation for long-term student success in math as well as reading (Duncan et al., 2007; Watts et al., 2014), but the professional development (PD) and curricular support for preschool teachers often lack specific content and training on high-quality math instruction delivered by math content experts. To address this problem, the REL Appalachia toolkit development team is developing a toolkit to provide preschool teachers with support in implementing core teaching practices essential to promoting early math skills and knowledge in children. The toolkit is based on the Teaching Math to Young Children IES practice guide (Frye et al., 2013) and is being developed in collaboration with state and district partners in Virginia. The study will assess the efficacy of the professional development resources included in the toolkit. The evaluation will also assess how teachers implement the toolkit to provide context for the efficacy findings and guidance to improve the toolkit and its future use. The evaluation will take place in 50 schools across approximately 10 school divisions in Virginia and focus on mathematics teaching practices and student mathematics knowledge and skills in preschool classrooms. The purpose of this study will be to measure the efficacy and implementation of the REL AP–developed toolkit designed to improve teacher practice and preschool students’ math learning outcomes. The toolkit evaluation will produce a report for district and school leaders who are considering strategies to improve math learning in preschool. The report will be designed to help them decide whether and how to use the toolkit to help them implement the practice guide recommendations. This is a non-substantive change request. The study team proposes to revise question two of the implementation checklist to replace the word “Which” with “How much,” so that the wording is “How much of the following toolkit learning activities did you implement?” In addition, the study team proposes changing the response options to None/Some/All, to encourage honest responses and reflect that it is acceptable that some teachers may not have completed all components of all toolkit learning activities.

Section 203 of the Veterans’ Benefits Act of 2010, Public Law 111-275, amended chapter 21, title 38, United States Code, to establish the Specially Adapted Housing (SAH) Assistive Technology Grant program. 38 U.S.C. 2108 states that a person or entity seeking an SAH technology grant shall submit an application for the grant in such form and manner as the Secretary shall specify. VA published regulations to outline the process, the criteria, and the priorities relating to the award of these research and development grants. 36 C.F.R. 4412(d)(2) requires applicants to submit VA Form 26-0967, Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion and VA Form 26-0967a, Specially Adaptive Housing Assistive Technology Grants Criteria and Responses. 36 C.F.R. 4412(d)(3) require applicants to provide statements addressing six scoring criteria for grant awards as part of their application. Lastly, 36 C.F.R. 4412(d)(1) require that applicants submit Standard Form 424, Application for Federal Assistance, which is covered under an existing information collection (OMB Number: 4040-0004). Abstract

FINAL RULE - Non-Power Production or Utilization Facility License Renewal (10 CFR Parts 50 and 51) The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations that govern the license renewal process for certain production or utilization facilities. In this final rule, the NRC collectively refers to these facilities as non-power production or utilization facilities (NPUFs). This final rule revises the definitions of “non power reactor,” “research reactor,” and “testing facility.” This final rule also eliminates license terms for licenses for facilities used for medical therapy or research and development, other than testing facilities; these licenses are issued under the authority of Sections 104a or 104c of the Atomic Energy Act of 1954, as amended (AEA). This final rule defines the license renewal process for licenses issued to testing facilities under the authority of Section 104c of the AEA or commercial or industrial NPUFs (including testing facilities) under the authority of Section 103 of the AEA. This final rule requires all NPUF licensees to submit to the NRC final safety analysis report (FSAR) updates at intervals not to exceed 5 years. The information collections are being conducted to create a more efficient licensing process that continues to protect public health, safety, and the environment. Information will be used by the NRC to ensure that licensing bases remain up-to-date and that adequate protection of public health and safety is maintained. NOTE: This supporting statement includes burden associated with information collection changes to 10 CFR Part 50 (3150-0011). Due to the pending submission of the Part 50 renewal, the information collection changes to Part 50 associated with this final rule are being submitted as a new clearance. The NRC staff intends to transfer the burden associated with these information collections to the Part 50 clearance via nonsubstantive change request. In addition, due to the submission of another rule affecting Part 51, the clarifying changes to the Part 51 information collections cannot be submitted under the Part 51 clearance (3150-0021). State Plan for Child Support Collection and Establishment of Paternity Under Title IV-D of the Social Security Act

Abstract

The requirement for submission of a state plan and plan amendments for the Child Support Services program is found in legislation at sections 452, 454 and 466 of the Social Security Act (the Act). These sections are implemented by regulations at 45 CFR 301, 302, 303, 305, 307 and 308. States and territories are provided with instructions for completing the automated state plan and plan amendments in OCSE-AT-15-02. The Office of Child Support Services (OCSS) has approved a IV-D state plan for each state and territory. Federal regulations require states and territories to amend their state plans only when necessary to reflect new or revised federal statutes or regulations or material change in any state law, organization, policy, or IV-D agency operations. According to 45 CFR 301.13, “After approval of the original plan by the Office, all relevant changes, required by new statutes, rules, regulations, interpretations, and court decisions, are required to be submitted currently so that the Office may determine whether the plan continues to meet federal requirements and policies.” The Office of Management and Budget (OMB) previously approved the IV-D state plan forms, OCSE-100 and OCSE-21-U4. All states have had IV-D plans in place for years. Plan amendments that states submit now are normally specific preprint plan pages that are required by changes in state laws or processes, or required by federal law, regulations, or policies. Each state and territory submit, on average, 12 preprint state plan pages (OCSS-100) and 12 transmittals (OCSS-21-U4) annually to notify OCSS of relevant changes required by new state statutes, rules, interpretations and court decisions. The State Plan for Child Support Collection and Establishment of Paternity Under Title IV-D of the Social Security Act information collection was approved by OMB for a 3-year extension on May 30, 2023. However, on May 31, 2024, OCSS published a Notice of Proposed Rulemaking (NPRM) (89 FR 47109; RIN 0970-AD00) proposing to allow Federal financial participation (FFP) for certain optional and nonduplicative employment and training services for eligible noncustodial parents in the child support program. The proposed rule will permit states, at their discretion, to use FFP to provide any or all of the following services: job search assistance; job readiness training; job development and job placement services; skills assessments; job retention services; work supports; and occupational training and other skills training directly related to employment. On December 13, 2024, OCSS published the Employment and Training Services for Noncustodial Parents in the Child Support Program final rule (89 FR 100789; RIN 0970-AD00). To incorporate changes resulting from this rule, we’re requesting approval to revise and extend this currently approved collection for 3 years. Attachments include the OCSS-100 and the OCSS-21-U4.

Abstract

The requirement for submission of a tribal plan and plan amendments for the Child Support Services program is found in legislation at sections 455 of the Social Security Act (the Act). These sections are implemented by regulations at 45 CFR 309. Tribes are provided with instructions for completing the tribal plans and plan amendments. The Office of Child Support Services (OCSS) has approved a IV-D tribal plan for each comprehensive tribal child support program. Federal regulations require tribes to amend their plans only when a tribe or tribal organization “intends to make any substantial or material change in any aspect of the Tribal IV-D program” (45 CFR 309.35(e)). The Office of Management and Budget (OMB) previously approved the optional IV-D tribal streamlined plan forms, OMB 0970-0218. All tribes have IV-D plans in place. Some tribes use the optional streamlined plan forms to organize and update their plans. Plan amendments that tribes submit are required when there is a “substantial or material” change to the tribe’s code or policy and procedures. On average, OCSS receives 30 annual plan amendments to notify OCSS of relevant changes required. The streamlined plan for Tribal Direct Funding Request: 45 CFR 309 Plan information collection was approved by OMB for three years March 31, 2023. However, on May 31, 2024, OCSS published a Notice of Proposed Rulemaking (NPRM) (89 FR 47109; RIN 0970-AD00) proposing to allow federal financial participation (FFP) for certain optional and nonduplicative employment and training services for eligible noncustodial parents in the child support program. Changes to the Use of Electronic Payroll Data to Improve Program Administration

Key Information

Abstract

We administer the Old-Age, Survivors, and Disability Insurance (OASDI) disability and Supplemental Security Income (SSI) programs under Titles II and XVI of the Social Security Act (Act), respectively. The OASDI program pays benefits to individuals who meet certain requirements, including being disabled and insured for disability. OASDI also pays benefits to certain members of disabled individuals’ families. We refer to meeting the requirements for OASDI disability benefits as OASDI disability “entitlement.” The SSI program provides financial support to: 1) adults and children with a disability or blindness; and 2) adults aged 65 and older. These individuals must meet all program eligibility requirements, including having resources and income below specified amounts. We refer to meeting the factors of eligibility for SSI payments as SSI “eligibility.” We use wage and employment information to decide who can receive OASDI disability benefits and SSI payments. We also use it to determine SSI payment amounts. Receiving complete, accurate, and timely wage and employment information allows us to administer our programs efficiently and to avoid improper payments that can occur when we do not have such information. Currently, we rely on individuals to report certain wage and employment information to us. Section 824 of the Bipartisan Budget Act of 2015 (BBA), Pub. L. 114-74, 129 Stat. 584, 607, authorizes the Commissioner of Social Security to enter into information exchanges with payroll data providers to obtain wage and employment information for the purposes of efficient program administration, and, to prevent improper OASDI disability and SSI payments without the need for additional verification. SSA published the Final Rule for the Use of Electronic Payroll Data to Improve Program Administration which revises our regulations to include procedures for implementing the access to and use of the information held by payroll data providers. We expect this final rule will support proper use of information exchanges with payroll data providers, which will help us administer our programs more efficiently and prevent improper payments under Titles II and XVI of the Act, which can otherwise occur when we do not receive timely and accurate wage and employment information. While this rule will not require any revisions to our existing information collections, the application of the revisions to these rules may cause a burden change to our currently approved information collections under 0960-0715. In addition, we also note that we will need to update the listing of the Code of Federal Regulation (CFR) citations to include references to 20 CFR 703(a)&(b); 404.1588(b)(3)(iii) & (b)(4); 416.708(c); and 416.709 for the following ICRs: 0960 0034, 0960-0138, 0960-0715, 0960 0807, and 0960-0820. Upon OMB’s approval of the final rule, we will adjust the figures associated with the current information collection for these forms to reflect the new burden and will also update the documentation to include the new or revised CFR citations. Respondents are applicants for, or beneficiaries of, OASDI disability; applicants for, or recipients of, SSI; their representatives; or SSI deemors.

Key Information

Abstract

The U.S. Fish and Wildlife Service (Service) is the Federal agency delegated with the primary responsibility for managing migratory birds, including bald eagles and golden eagles. Our authority derives primarily from the Migratory Bird Treaty Act (MBTA, 16 U.S.C. 703 et seq.), which implements conventions with Great Britain (for Canada), Mexico, Japan, and the Russian Federation. The MBTA protects certain migratory birds from take, except as permitted under the MBTA. We implement the provisions of the MBTA through regulations in parts 10, 13, 20, 21, and 22 of title 50 of the Code of Federal Regulations (CFR). Regulations pertaining to migratory bird permits are set forth at 50 CFR part 21. In addition, the Bald and Golden Eagle Protection Act (Eagle Protection Act; 16 U.S.C. 668–668d) prohibits take of bald eagles and golden eagles except pursuant to Federal regulations. The Eagle Protection Act authorizes the Secretary of the Interior to issue regulations to permit the “taking” of eagles for various purposes, including the protection of “other interests in any particular locality” (16 U.S.C. 668a), provided the taking is compatible with the preservation of eagles. Regulations pertaining to eagle permits are set forth at 50 CFR part 22. We prepared proposed regulations (RIN 1018-BC76) to revise current regulatory authorizations and add new regulatory authorizations for possession of migratory birds and eagles and other purposes. These proposed changes would more efficiently and appropriately provide authorization to the general public, educators, and government agency employees while meeting our obligations under the MBTA and the Eagle Protection Act. The Service has long authorized activities under regulatory authorizations. The origins of the regulatory authorization “general exceptions to permit requirements” (50 CFR 21.12) can be traced back as far as 1944. With this proposed rulemaking action, we seek to address the need for better organization and transparency by redesignating the existing regulatory authorizations codified at 50 CFR 21.12(a)–(d) to their own sections. We propose revisions to these current regulations to add clarity and consistency. The Service also proposes new regulatory authorizations. Finally, we propose to modify the limitations on permits under the Airborne Hunting Act regulations (50 CFR part 19) to support emerging uses of technology for bird conservation.
