Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This request is for a revision of the current information collection pursuant to proposed rule 0648-BK86. NMFS is requesting OMB approval for the expanded information set on the paper form and the requirement for electronic submission of certain data elements from the form as part of entry filing through the Automated Commercial Environment (ACE). Importers would also be required to keep records of the form for a period of two years from the date of the import and obtain International Fisheries Trade Permit, if one is not already in possession, and include the permit number on the Certificate of Admissibility (COA) form. In addition, the proposed revisions would allow a foreign nation to use its own COA form, subject to approval by the National Marine Fisheries Service (NMFS). Pursuant to the High Seas Driftnet Fishing Moratorium Protection Act (Moratorium Protection Act), the Marine Mammal Protection Act (MMPA), and the Atlantic Tunas Convention Act (ACTA), certain fish products may be excluded from U.S. markets. For example, if a nation is identified under the Moratorium Protection Act and fails to receive a positive certification decision from the Secretary of Commerce, certain fish or fish products from that nation may be prohibited from import to the United States. Similarly, if a nation does not receive a comparability finding for a fishery under the MMPA, products from that nation's fishery may also be prohibited. For ATCA, National Marine Fisheries Service (NMFS) is authorized to make determinations that fish subject to regulation or investigation by the International Commission for the Conservation of Atlantic Tunas (ICCAT) are ineligible for entry into the United States under specific circumstances. In each case, if certain fish or fish products of a nation are subject to import prohibitions (e.g., harvest of a particular fishery), NMFS requires that similar fish or fish products from that nation that are not subject to the import prohibitions must be accompanied by Certification of Admissibility (COA) fish harvest record form to be eligible for entry into the United States. A duly authorized official/agent of the applicant’s Government must certify that the fish being imported into the United States are of a species, or from a fishery, not subject to the import restriction.

This request is for the revision and extension of a current information collection. The National Marine Fisheries Service operates a fee-for-service Seafood Inspection Program (SIP), available to all segments of the seafood industry. Participants request services such as product inspection, export health and legal harvest certification, and facility approval. Information is collected from participants to confirm the identity of products being inspected and certified, as well as to show compliance with Program requirements. The implementing regulations for this Program at 50 CFR 260 are being updated to bring the regulation more in line with current practices, remove outdated text, and streamline seafood inspection services. The last updated information collection (published January 19, 2022, with expiration date January 31, 2025) already included all of the changes proposed with this rulemaking, including the shift to online inspection and service requests and housing day-to-day procedures in the online SIP Manual versus in codified text. The information collection is being revised and extended to add a previously overlooked Surety form and adjust the burden figures.

This rule is necessary to improve efficiency, provide economic benefits for the hook-and-line catcher/processer subsector, and minimize potential fishery interactions with killer whales. This collection is revised because the rule adds the Bering Sea Greenland turbot fishery to the recordkeeping and reporting requirements specific to longline pot gear. This revision does not change the respondents, responses, burden hours, or costs for this collection. The directly regulated entities already complete the catcher/processor electronic logbook, and the current burden estimates allow for differences in the time and cost needed to complete and submit the logbook. This rule also affects information collection requirements approved under OMB Control Number 0648-0353. NMFS is submitting a separate request to revise -0353. One change not associated with the rule was made from the proposed rule to the final rule. The form for the IFQ/CDQ landing report has been revised to increase clarity and improve consistency with other forms for the NMFS Alaska Region. This does not change the number of respondents and responses or the burden for this form.

Abstract

SSA uses Form SSA-821-BK to collect employment information to determine whether individuals have worked after becoming disabled and, if so, whether the work is SGA. We use the information to make a determination of eligibility for disability payments. Specifically, we use Form SSA-821-BK to obtain information from individuals during the initial SSI and SSDI claims process; the Continuing Disability Review (CDR) process; and appeals involving work issues. An SSA employee may fill out the form during an in office or telephone interview, or the applicants or recipients may fill it out themselves. SSA reviews and evaluates the data to determine if the applicant or recipient meets the disability requirements of the law. If respondents work when they apply for benefits, they must complete this collection to obtain SSI or SSDI. The respondents are SSDI applicants or recipients, and SSI applicants.

Section 728 of the Dodd-Frank Act specifically requires the Commodity Futures Trading Commission (“CFTC” or “Commission”) to establish certain standards for the registration and governance of swap data repositories (“SDRs”), including regulations regarding SDRs reporting data to the Commission and to the public. In addition to implementing standards governing registration of and statutory duties applicable to SDRs, the CFTC is also required to adopt regulations that mitigate certain conflicts of interest in the operation of these entities and ensure appropriate levels of access by the Commission and certain other regulators to the data maintained by SDRs. The information from this collection is necessary for the Commission to perform its regulatory mandate to provide oversight of the markets and SDRs. Without accurate reporting of the data as set forth in the Commission’s regulations discussed in this statement, the Commission would be unable to fulfill its regulatory mandate of monitoring systemic risk.

This revision adds requirements for the purchase and validation of charter halibut stamps, adds a new field to the ADF&G saltwater charter logbook to validate stamps, and adds appeals for an Initial Administrative Determination received for a validated charter halibut stamp deficit. This revision does not add respondents but does increase the logbook burden by 1 minute for the new field. This revision is due to the final rule (RIN 0648-BN18) that requires a charter halibut stamp for charter vessel anglers in International Pacific Halibut Commission Regulatory Areas 2C and 3A. This rule is necessary to promote stability and economic viability in the charter halibut fishery, and is intended to promote the goals and objectives of the Magnuson-Stevens Act, the Northern Pacific Halibut Act of 1982, and other applicable laws. This supporting statement was updated from the proposed rule to the final rule to be consistent with regulatory and editorial changes to the rule. These updates did not change respondents, responses, or burden. This information collection contains the logbook, landing reports, permit and transfer applications, and administrative appeals for the Pacific halibut charter fishery off Alaska. This collection is necessary for NMFS to manage and administer the charter halibut fishery under the Charter Halibut Limited Access Program and the Pacific Halibut Catch Sharing Plan.
