What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Diesel-Powered Equipment in Underground Coal Mines

Key Information

Abstract

MSHA requires mine operators to provide important safety and health protections to underground coal miners who work on and around diesel-powered equipment. The engines powering diesel equipment are potential contributors to fires and explosion hazards in the confined environment of an underground coal mine where combustible coal dust and explosive methane gas are present. Diesel equipment operating in underground coal mines also can pose serious health risks to miners from exposure to diesel exhaust emissions, including diesel particulates, oxides of nitrogen, and carbon monoxide. Diesel exhaust is a lung carcinogen in animals. This information collection includes maintenance and use of diesel equipment; tests and maintenance of fire suppression systems on both the equipment and at fueling stations; and exhaust gas sampling. Records are required to document that essential testing and maintenance of diesel- powered equipment are conducted regularly by qualified persons; that corrective actions are taken; and the persons performing the maintenance, repairs, examinations, and tests are trained and qualified to perform such tasks. Safety requirements for diesel equipment include many of the proven features required in existing standards for electric-powered mobile equipment, such as cabs or canopies, methane monitors, brakes and lights. Sampling of diesel exhaust emissions is required to protect miners from overexposure to carbon monoxide and nitrogen dioxide contained in diesel exhaust. Adherence Potential and Patient Preference in Prescription Drug Promotion

Key Information

Abstract

This research is designed to experimentally examine the role of adherence and patient preference claims in prescription drug promotion. We will ask whether the presence or absence of an implied adherence claim and/or an adherence-related patient preference claim affect consumers’ and primary care physicians’ (PCPs’) behavioral intentions or risk, benefit, and adherence perceptions. To complete this research, we propose the following design for a total of eight study conditions (experimental groups): 2 (patient preference claim) x 2 (adherence claim) x 2 (disclosure). Each participant will see one of eight versions of a static web page for a fictitious prescription type 2 diabetes treatment. They will answer a survey designed to take no more than 15 minutes to complete regarding their perceptions of the drug’s risks, benefits, and effect on adherence. Consumers and PCPs will receive slightly different versions of the web page and survey, and their data will be analyzed separately. Results will help inform considerations around adherence and adherence-related patient preference claims in prescription drug promotion.

Abstract

The General Mining Law (30 U.S.C. 29, 30, and 39) authorizes a holder of an unpatented claim for hardrock minerals to apply for fee title (patent) to the federal land (as well as minerals) embraced in the claim. Division G, Title I of the Consolidated Appropriations Act, 2021 (Public Law No. 116–260), annual appropriation bill for the Department of the Interior, has prevented the BLM from processing mineral patent applications unless the applications were grandfathered under the initial legislation. While grandfathered applications are rare at present, the approval to collect the information continues to be necessary because of the possibility that the moratorium will be lifted and applicable regulations that contain the information are still part of the Code of Federal Regulations. Therefore, the Bureau of Land Management (BLM) is requesting that OMB renew this OMB control number of an additional three (3) years.

Abstract

The Telemarketing Sales Rule requires certain disclosures in telemarketing calls for the sale of goods or services or the solicitation of charitable contributions by sellers and/or telemarketers. The disclosures provide consumers or prospective donors with information necessary to make informed decisions. The Final Rule newly requires inbound tech support calls (calls that consumers make in response to an advertisement through any medium or to a direct mail solicitation) to comply with the Rule’s recordkeeping and disclosure requirements. The Final Rule and these associated information collections are necessary in light of the widespread deception and consumer injury caused by tech support scams. The Final Rule provides the Commission with the ability to obtain stronger relief in cases involving tech support scams, including civil penalties and consumer redress.

Notification of Methane Detected in Underground Metal and Nonmetal Mine Atmospheres

Abstract

Title 30 CFR 57.22004(c) requires operators of underground M/NM mines to notify the Mine Safety and Health Administration (MSHA) as soon as possible if any of the following events occur: (a) there is an outburst that results in 0.25 percent or more methane in the mine atmosphere, (b) there is a blowout that results in 0.25 percent or more methane in the mine atmosphere, (c) there is an ignition of methane, or (d) air sample results indicate 0.25 percent or more methane in the mine atmosphere of a I-B, I-C, II-B, V-B, or Category VI mine. Under §§ 57.22239 and 57.22231, if methane reaches 2.0 percent in a Category IV mine or if methane reaches 0.25 percent in the mine atmosphere of a Subcategory I-B, II-B, V-B, or VI mine, MSHA shall be notified immediately. Although the standards do not specify how MSHA is to be notified, MSHA anticipates that the notifications would be made by telephone. Title 30 CFR 57.22229 and 57.22230 require that the mine atmosphere be tested for methane and/or carbon dioxide at least once every seven days by a competent person or atmospheric monitoring system or a combination of both. Section 57.2229 applies to underground M/NM mines categorized as I-A, III, and V-A mines where the atmosphere is tested for both methane and carbon dioxide. Section 57.22230 applies to underground M/NM mines categorized as II-A mines where the atmosphere is tested for methane. Where examinations disclose hazardous conditions, affected miners must be informed. Title 30 CFR 57.22229(d) and 57.22230(c) require that the person performing the tests certify by signature and date that the tests have been conducted. Certifications of examinations shall be kept for at least one year and made available to authorized representatives of the Secretary of Labor.

The federal Office of Child Support Services (OCSS), Division of Federal Systems, in the U.S. Department of Health and Human Services (HHS) maintains the Child Support Portal (Portal) as part of the Federal Parent Locator Service (FPLS). The Portal is a secure, web-based gateway to various child support applications for authorized users to view, update, upload, send, and receive vital information to support effective and efficient enforcement of child support cases. To provide authorized users with secure access to the Portal, OCSS creates profiles in the Portal for employers, insurers, and financial institutions from information provided in “Employer Services” (ES) Profile and “Insurance Match Debt Inquiry” (IM) Agreement and Profile forms. OCSS sets up Portal preferences using information from the program-specific electronic National Medical Support Notice (e-NMSN), the electronic Incoming Withholding Order (e-IWO), and Federally Assisted State Transmitted Levy (FAST Levy) Financial Institution Profile forms. State child support agencies do not register for the Portal through OCSS because they manage and authenticate authorization for individual users via the state proxy server; however, states must provide OCSS with a profile form containing information for OCSS to establish account preferences. The federal Child Support Portal Registration information collection activities are authorized by 1) 42 U.S.C. § 653(m)(2), which requires the Secretary to establish and implement safeguards to restrict access to confidential information in the FPLS to authorized persons and to restrict use of such information to authorized purposes; 2) E-Government Act of 2002 and Office of Management and Budget (OMB) Circular 03-22, Guidance for Implementing the Privacy Provisions of the E-Government Act of 2002, which requires agencies to ensure program integrity by verifying access to data; and 3) 44 U.S.C. § 3554, which requires OCSS to implement security protections to prevent unauthorized access to information maintained by OCSS. Abstract

Section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e-8(c), requires State and local governments to make and keep records relevant to a determination of whether unlawful employment practices have been or are being committed and produce reports required by the EEOC. Accordingly, the EEOC issued regulations, 29 CFR 1602.30 and 1602.32-.37, which set forth the reporting requirements and related record retention policies for State and local governments. 29 CFR 1602.30 requires every covered State and local government to make or keep all records necessary for completion of an EEO-4 submission and retain those records for three years. 29 CFR 1602.32 requires filers to retain a copy of each filed EEO-4 report for three years. These requirements are related to record keeping which is part of standard administrative practices, and as a result, the EEOC believes that any impact on burden would be negligible and nearly impossible to quantify. State and local governments with 100 or more employees have been required to submit EEO-4 reports since 1973 (biennially since 1993). The EEOC uses EEO-4 data for research and to investigate charges of discrimination. The individual reports are confidential.

Abstract

State agencies that administer Supplemental Nutrition Assistance Programs (SNAP) are mandated by federal law to participate in a computerized matching program with the federal Office of Child Support Services (OCSS). The computerized matching program compares each state SNAP agency’s applicant and recipient information with employment information maintained in the National Directory of New Hires (NDNH). The outcomes of the computerized match provide each state SNAP agency with information that will help to establish or verify an individual’s eligibility for SNAP benefits. Determining eligibility also helps each state agency reduce payment errors, identify duplicate participants, and maintain program integrity. To receive NDNH information, each state SNAP agency must enter into a computer matching agreement with OCSS and adhere to its terms and conditions, including providing OCSS with an annual performance outcomes report. The Servicemembers Civil Relief Act (SCRA) provides that those on active-duty military service are entitled to have an interest rate in excess of 6% be capped at 6% for the duration of their qualifying military service. The Department is requesting an extension of the currently approved information collection. These Federal Family Education Loan (FFEL) Program and Direct Loan Program regulations have not changed. The regulations require a loan holder to match its database against the Department of Defense's Defense Manpower Data Center (DMDC) and automatically apply the interest rate limitation, as appropriate, to borrowers under the Servicemembers Civil Relief Act. The form in this collection would only be used in limited cases where the borrower is not found in the Defense Manpower Data Center, or does not have a copy of military orders, but still wishes to receive benefits under the SCRA.

Abstract

Benefits are authorized monthly based on the number of hours worked in a training capacity by the trainee as verified by the training establishment. Unscheduled terminations result in the termination of benefits. If hours are reduced to less than a full-time work schedule, a reduction of benefits will occur. Public Law 115-89 “Veterans Apprenticeship and Labor Opportunity Reform Act” (VALOR Act) was signed into law on November 21, 2017. Section 3 of this law amended 38 U.S.C. 3680(c) to eliminate the trainee’s certification requirement. As a result, this form is only completed, signed, and certified by the training establishment to report the trainee’s number of hours worked and/or to report the trainee’s date of termination. The form no longer requires the signature of the trainee. The form is then sent to the Regional Processing Office (RPO) for processing.

On March 11, 2021, the President signed the American Rescue Plan Act of 2021 (the “Act”), Pub. L. No. 117-2. Title III, Subtitle B, Section 3201of the Act provides $21.55 billion for the U.S. Department of the Treasury (Treasury) to make payments to States (defined to include the District of Columbia), U.S. Territories (Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa), and certain local governments with more than 200,000 residents (collectively the “eligible grantees”) to provide financial assistance and housing stability services to eligible households, and cover the costs for other affordable rental housing and eviction prevention activities for eligible households.
