What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Consolidated Annual Report (CAR) for the Carl D. Perkins Career and Technical Education Act of 2006

Abstract

This information collection is used by the U.S. Department of Education (Department) to gather annual performance and financial data from eligible agencies under the Carl D. Perkins Career and Technical Education Act of 2006. On August 30, 2024, the Department published for public comment, for a period of 60 days, a proposed request to extend this information collection request (ICR) for nine months to enable eligible agencies to meet their annual reporting requirements for Fiscal Year (FY) 2023. On September 11, 2024, the Department published for public comment, for a period of 60 days, a proposed revision of this ICR for which three-year approval was requested so that eligible agencies could meet their reporting requirements for FYs 2024 through 2026. On September 23, 2024, ED corrected an error in the publication of the proposed revised instrument for the CAR and posted the correct version. Due to this error, on October 15, 2024, ED extended the public comment period on the CAR for two weeks, to November 26, 2024. The Department proposed a consolidated information collection request that incorporates the extension for FY 2023 reporting that was published on August 30, 2024, and the proposed revision for FYs 2024 through 2026 reporting that was published on September 11, 2024. On December 3, 2024, the Department published in the Federal Register (89 FR 95760) a request for public comment for the consolidated request for a period of 30 days. The comment period ended on January 2, 2024. This information collection request would extend current reporting requirements through FY 2025 and make revisions to these requirements for FY 2026. The proposed revisions would provide data specifications for the numerators and denominators used to calculate the performance indicators so that they are measured in a manner that is consistent with the law, collect data on participants in the middle grades to the extent such data are available, and collect data on the education and employment outcomes of CTE concentrators who have exited secondary education or who have completed a postsecondary program that is disaggregated by placement type, to the extent these data available. The proposed ICR also includes narrative questions about different aspects of an eligible agency's implementation of the law.

Key Information

Abstract

The School Pulse Panel (SPP) is a data collection that was originally designed to collect voluntary responses from a nationally representative sample of public schools to better understand how schools, students, and educators were responding to the ongoing stressors of the coronavirus pandemic. The School Pulse Panel is conducted by the National Center for Education Statistics (NCES), part of the Institute of Education Sciences (IES), within the United States Department of Education. Initially, the purpose of the study was to collect extensive data on issues brought to light by the COVID-19 pandemic, as well as other important education-related issues that could inform data-driven policy decisions, in U.S. public schools. Due to the immediate need to collect pandemic-era information from schools as described in Executive Order 14000, an emergency clearance was issued to develop and field the first several monthly collections of the SPP in 2021 and a full review of the SPP data collection was performed in 2022 (OMB# 1850-0969). SPPs innovative design and timely dissemination of findings have been used and cited frequently among Department of Education senior leadership, the White House Domestic Policy Council, the USDAs Food and Nutrition Service, the Centers for Disease Control and Prevention, Congressional deliberations, and the media. The growing interest from stakeholders resulted in a request for funding to create an established NCES quick-turnaround data collection vehicle to become a mainstay for NCES. Funding for a mainstay collection was approved in late 2022, and NCES conducted a new collection during the 2023-24 school year (OMB# 1850-0975). The School Pulse Panel study is one of the few reliable, nationally representative, quick-turnaround studies that produces data on U.S. public schools. The sample design for the 2025-26 collection will roughly be the same as the 2024-25 collection with 4,000 public schools randomly selected to an initial sample and 4,000 in a reserve sample. It is expected these schools will come from roughly 3,000 districts. The goal is national representation from about 1,200 responding schools each month in order to report out national estimates. School staff will be asked to provide requested data monthly during the 2025-26 school year. This approach provides the ability to collect detailed information on various topics while also assessing changes over time for items that are repeated from year to year. Given the demand for data collection, the content of the survey is expected to change monthly. For the 2025-26 school year, the survey may ask school staff about a wide range of topics, including but not limited to staffing; learning recovery; absenteeism; usage of federal funds; and overall principal experiences. This package includes preliminary activities, including contacting and obtaining research approvals from public school districts with an established research approval process (special contact districts) where applicable; notifying sampled schools and districts of their selection for the survey; and inviting them to complete a short Screener Survey to establish points of contact. In spring of 2025, a clearance for main study data collection activities that will include instruments for the first quarter of collections will be submitted for 60-day and 30-day public comment. Subsequent quarterly content submissions will be submitted for 30-day public comment. This request is to conduct the SPP 2025-26 preliminary activities. Substantial edits and additional materials may be added to this package after the 60-day public comment period is complete, in time for the subsequent 30-day public comment period that will begin Fall 2024. Materials for SPP are cleared under two OMB Number sequences. Materials for SPP 2022 and SPP 2024-25 were cleared under OMB# 1850-0969, while SPP 2023-24 and now SPP 2025-26 are cleared under OMB# 1850-0975.

Abstract

Section 206 of the Federal Power Act (FPA), 16 U.S.C. 824e, obligates the Commission to remedy unjust, unreasonable, and unduly discriminatory or preferential rates, terms, and conditions of transmission service. Generator interconnection is a critical component of open access transmission service. This information collection request for FERC 516A involves Commission implementation of FPA section 206 via: • 18 CFR 35.28 (“Non-Discriminatory Open Access Transmission Tariff”); • The pro forma Small Generator Interconnection Procedures (SGIP); and • The pro forma Small Generator Interconnection Agreement (SGIA). The Commission’s regulations at 18 CFR 35.28 (2022) require certain types of entities to have on file an Open Access Transmission Tariff (OATT) that contains minimum terms and conditions of non-discriminatory transmission service. This requirement applies to all public utilities that own, control, or operate facilities used for transmitting electric energy in interstate commerce. Public utilities that are required to have an OATT on file with the Commission must include the pro forma LGIP, pro forma LGIA, pro forma SGIP, and pro forma SGIA in their OATT. Other provisions in section 35.28 apply to non-public utilities, but only if they seek voluntary compliance with jurisdictional transmission tariff reciprocity conditions. Non-public utilities are not affected by this information collection request. The changes in this ICR to the FERC 516A are a result of the final rule in Docket No. RM22-2-000. The revisions included in Docket No. RM22-2-000 would require respondents to update their Open Access Transmission Tariffs (OATTs), pro forma Large Generator Interconnection Agreements (LGIAs), and pro forma Small Generator Interconnection Agreements (SGIAs) and would require a single compliance filing to be submitted to the Commission.

The FERC-516H requires jurisdictional public utilities to comply with the Commission approved Open Access Transmission Tariff (OATT). Specifically, This collection pertains to 18 CFR 35.28, which applies to: • Commission-jurisdictional public utilities that own, control, or operate facilities used for the transmission of electric energy in interstate commerce; and • Non-jurisdictional utilities that seek voluntary compliance with jurisdictional transmission tariff reciprocity conditions. In the Notice of Proposed Rulemaking, the Commission is proposing revisions to the currently approved Open Access Transmission Tariff. Generally, generating facilities that are interconnected to the transmission system are required to operate within a standard power factor range, which represents the proportion of their output that is reactive power vs. real power. Transmission providers may elect to pay their own or affiliated generating facilities for the provision of reactive power within the standard power factor range provided that they also pay unaffiliated generating facilities. These charges are then included in and increase transmission providers’ transmission rates. The Commission is proposing to eliminate this allowance so that all generating facilities, on a comparable basis, do not receive separate payment for the provision of reactive power within the standard power factor range. As such, the Commission is proposing to add language to Schedule 2 of its pro forma OATT specifying that transmission rates shall not include any charges associated with compensation to a generating facility for the supply of reactive power within the standard power factor range specified in the generating facility’s interconnection agreement.

Abstract

The Spatial, Address, and Imagery Data (SAID) Program is one of many voluntary geographic partnership programs that collects data to update the U.S. Census Bureau’s geographic database, known as the Master Address File/Topologically Integrated Geographic Encoding and Referencing (MAF/TIGER) System. The Census Bureau uses the MAF/TIGER System to link statistical data from censuses and surveys to locations and areas, such as American Indian reservations, states, counties, incorporated places, and census tracts. To tabulate census and survey response data properly, the Census Bureau must have current and accurate addresses, street centerlines, and imagery. The SAID Program provides the Census Bureau with a continuous method to obtain current, accurate, and complete address, street centerline, and imagery data from tribal, state, and local governments as well as other federal agencies and authoritative data source organizations. The purpose of the SAID Program is to help maintain the Census Bureau’s geographic framework for data collection, tabulation, and dissemination to support ongoing surveys and programs such as the American Community Survey and the Population Estimates Program, as well as the 2030 Census. The SAID Program will continue to focus on acquiring addresses, street centerlines, and imagery in areas identified with housing unit growth or change. The Census Bureau is requesting clearance to continue the SAID Program. As the current OMB Control Number 0607-1008 clearance will expire in January 2025, the new clearance will allow the Census Bureau to continue data acquisition to support MAF/TIGER System updates, quality control, and change detection.

A Survey on Quantitative Claims in Direct-to-Consumer Prescription Drug Advertising

Key Information

Abstract

This survey collects insights on consumer understanding of quantitative claims in direct-to-consumer (DTC) prescription drug advertising. It will build on previous qualitative research by recruiting a wider range of respondents and weighting the data to make it nationally representative. We plan to use an address-based mixed-mode methodology that will direct one randomly chosen member of sampled households to complete a 20-minute online survey, with non-respondents receiving a paper questionnaire. We will also conduct a within-survey experiment to test whether a post-paid incentive increases survey response.

Under that IRC authority, the Alcohol and Tobacco Tax and Trade Bureau (TTB) regulations in 27 CFR part 18 require volatile fruit-flavor concentrate manufacturers to register using form TTB F 5520.3 and file amendments to their registrations using that form or a letterhead application (depending on circumstances). Additionally, the regulations require concentrate manufacturers to maintain a record file of all approved registrations and related supporting documents. TTB uses the collected information to identify concentrate manufacturers and their operations to ensure that the tax provisions of the IRC are appropriately applied.

The Bank Secrecy Act (BSA) prohibits financial institutions from issuing any “bank check, cashier’s check, traveler’s check, or money order to any individual in connection with a transaction or group of such contemporaneous transactions which involves United States coins or currency (or such other monetary instruments as the Secretary may prescribe) in amounts or denominations of $3,000 or more” unless (1) the financial institution verifies, through a signature card or other account documentation or information, that the individual has a transaction account with the financial institution, and records the method of verification in accordance with regulations issued by the Secretary; or (2) the individual furnishes the financial institution with such forms of identification as the Secretary may require by regulation, and the financial institution verifies and records such information in accordance with regulations issued by the Secretary. To implement these requirements, FinCEN issued a regulation requiring financial institutions to maintain records related to the issuance or sale of bank checks and drafts, cashier’s checks, money orders, and traveler’s checks. The regulation applies to all financial institutions as defined in 31 CFR 1010.100(t). However, it is FinCEN’s experience that banks and money services businesses (MSBs) are more likely than other categories of financial institution to issue or sell bank checks and drafts, cashier’s checks, money orders, and traveler’s checks. Under 31 CFR 1010.415, financial institutions are required to maintain records of certain information related to the issuance or sale of bank checks and drafts, cashier’s checks, money orders, and traveler’s checks when the issuance or sale involves currency between $3,000 and $10,000, inclusive, to any individual purchaser of one or more of these instruments.

This information collection is used by the Department to request State Plans and annual revisions under the Carl D. Perkins Career and Technical Education Act of 2006. The Department published a request for public comment, for a period of 60 days, in the Federal Register on August 30, 2024 (89 FR 70617). Based on feedback received during the 60-day public comment period, the Department removed the proposed additional narrative items from the State Plan Guide and moved them to the Consolidated Annual Report (CAR) (1830-0569). On December 2, 2024, the Department published in the Federal Register (89 FR 95188) a request for public comment for a period of 30 days that included these proposed changes. The comment period ended on January 2, 2024. No additional changes were proposed after the 30-day public comment period. This information collection request revises the ICR to provide data specifications for the numerators and denominators used to calculate the law's performance indicators, which are effective for FY 2026, so that they are measured in a manner that is consistent with the statute. The revisions also reduce the collection of potentially duplicative information, give States more time to report education and employment outcomes to improve the accuracy and completeness of these data, and improve the consistency of performance data reported by States.

Abstract

Rule 15c2-8 of the Securities Exchange Act of 1934 ("Exchange Act") requires broker-dealers to deliver preliminary and/or final prospectuses to certain people under certain circumstances. In connection with securities offerings generally, including initial public offerings (IPOs), the rule requires broker-dealers to take reasonable steps to distribute copies of the preliminary or final prospectus to anyone who makes a written request, as well as any broker-dealer who is expected to solicit purchases of the security and who makes a request. In connection with IPOs, the rule requires a broker-dealer to send a copy of the preliminary prospectus to any person who is expected to receive a confirmation of sale (generally, this means any person who is expected actually to purchase the security in the offering) at least 48 hours prior to the sending of such confirmation. In order to comply with the rule, broker-dealers participating in a securities offering must keep accurate records of persons who have indicated interest in an IPO or requested a prospectus, so that they know to whom they must send a prospectus.
