What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Substantial Equivalence Reports for Tobacco Products

Key Information

Abstract

The FD&C Act requires FDA to issue an order under section 910(c)(1)(A)(i) (order after review of a premarket application, see section 910(b) of the FD&C Act) before a new tobacco product may be commercially marketed. An order under section 910(c)(1)(A)(i) is not required, however, if a manufacturer submits a report under section 905(j)(1)(A)(i) for the new tobacco product and FDA issues an order finding that the tobacco product is (1) substantially equivalent to a tobacco product commercially marketed in the United States as of February 15, 2007, and (2) in compliance with the requirements of the FD&C Act. Manufacturers of these tobacco products may submit a report under section 905(j)(1)(A)(i) demonstrating that a new tobacco product is “substantially equivalent, within the meaning of section 910, to a tobacco product commercially marketed (other than for test marketing) in the United States as of February 15, 2007, or to a tobacco product that the Secretary has previously determined, pursuant to subsection (a)(3) of section 910, is substantially equivalent and that it is in compliance with the requirements of this Act” (section 905(j)(1)(A)(i) of the FD&C Act). The comparison product chosen by the tobacco product manufacturer is referred to by FDA as the predicate tobacco product. (In addition to the premarket application under section 910(b) and a report under 905(j)(1)(A)(i), certain new tobacco products may use the exemption premarket pathway, see 21 CFR 1107.1.) The regulations contain requirements for the content and format of SE Reports intended to establish the substantial equivalence of a tobacco product. The regulations establish the information an SE Report must include so that FDA may make a substantial equivalence determination. In addition, the regulation contain the general procedures FDA intends to follow when evaluating SE Reports, including procedures that address communications with the applicant and the confidentiality of data in an SE Report. FDA will have three forms (Form FDA 3965; Form FDA 3965a; and new Form FDA 3965b) required for use (once this revision is approved) under section 21 CFR 1107.18(a)) when submitting an SE Report to the Agency. Forms FDA 3965 and 3965b are required when submitting single and bundled SE submissions. Form FDA 3965a is for use when firms are submitting amendments and other general correspondence. Form FDA 3965b is a new form that assists industry and FDA in identifying the products that are the subject of a submission. CTP is planning a significant upgrade to the submission process for SEs, known as the CTP Portal Next Generation (CTP Portal NG), streamlining the application process for the tobacco industry.

Abstract

This ICR applies to a contractor who performs response services at sensitive sites with serious security concerns where the Agency and public interest would best be protected through drug testing of contractor employees. The contractor will test employees for the use of marijuana, cocaine, opiates, amphetamines, phencyclidine (PCP), and any other controlled substances. Only contractor employees who have been tested within the previous 90 calendar days and have passing drug test results may be directly engaged in on-site response work and/or on-site related activities at designated sites with significant security concerns. The Agency may request contractors responding to any of these types of incidents to conduct drug testing and apply Government-established suitability criteria in Title 5 CFR Administrative Personnel 731.104 Appointments Subject to Investigation, 732.201 Sensitivity Level Designations and Investigative Requirements, and 736.102 Notice to Investigative Sources when determining whether employees are acceptable to perform on given sites or on specific projects.

Drug Price Negotiation Process under Sections 11001 and 11002 of the Inflation Reduction Act (CMS-10849) - (IRA)

Abstract

Under the authority in sections 11001 and 11002 of the Inflation Reduction Act of 2022 (P.L. 117-169), the Centers for Medicare & Medicaid Services (CMS) is implementing the Medicare Drug Price Negotiation Program (the “Negotiation Program”), codified in sections 1191 through 1198 of the Social Security Act (“the Act”). Section 1193(a)(1) of the Act establishes that CMS will negotiate an MFP with “the manufacturer” of the selected drug. In section 1191(c)(1) of the Act, the Negotiation Program statute adopts the definition of manufacturer established in section 1847A(c)(6)(A) of the Act. To the extent that more than one entity meets the statutory definition of manufacturer for a selected drug for purposes of initial price applicability year 2027. The statute provides that, after receiving CMS’ written initial offer for a selected drug, the Primary Manufacturer may, in accordance with section 1194(b)(2)(C) of the Act, submit an optional written counteroffer (if CMS’ written initial offer is not accepted by the Primary Manufacturer) that must be submitted no later than 30 days after the date of receipt of the written initial offer. If the Primary Manufacturer chooses to develop and submit a written counteroffer to CMS’ written initial offer during the drug price negotiation process for initial price applicability year 2027, the Primary Manufacturer must submit the Counteroffer Form.

Abstract

The FR 2956 collects detailed data on depository institutions’ daily transactions trading of marketable U.S. Treasury securities and transactions trading of the debt and mortgage-backed securities (MBS) issued by U.S. federal government agencies including government-sponsored enterprises (agencies). The report has two parts: Part 1 collects data on transactions in U.S. Treasury debt, and Part 2 collects transactions in debt and MBS issued by agencies. Every national bank, state member bank, state non-member bank, savings association, or U.S. branch and agency of a foreign bank filing a Notice by Financial Institutions of Government Securities Broker or Government Securities Dealer Activities (Form G-FIN; OMB No. 7100-0224) with average daily transaction volumes of over $100 million, for U.S. Treasury debt, or over $50 million, for agency-issued debt and MBS, during the prior fiscal year is subject to the these reporting requirements. Depository institutions subject to the reporting requirements of the FR 2956 electronically report transactions through the Board’s data collection vendor, the Financial Industry Regulatory Authority (FINRA), utilizing its Trade Reporting and Compliance Engine (TRACE). The Board receives data on transactions executed by FINRA’s broker-dealer members from FINRA, but the depository institutions subject to the FR 2956 are not members of FINRA and are not subject to its rules.

Abstract

On October 22, 2018, the Commission issued a Report and Order and Order, FCC 18-143, in WP Docket No. 15-32, RM-11572, WP Docket No. 16-261, RM-11719 and RM-11722 (800/PLMR Access Order), in which it revised certain rules to require applicants for channels currently designated for central station alarm use to obtain the concurrence of the central station alarm frequency coordinator in order to use the channels for uses other than central station alarm operations. This requirement is similar to existing requirements pertaining to certain other channels. The Report and Order and Order did not revise any of the information collection requirements that are contained in this collection but rather added additional frequencies to the list. Therefore, this essentially is adding an additional 200 respondents to this collection. 47 C.F.R. § 90.175(b) establishes frequency coordination requirements for frequencies between 25 and 470 MHz to include a statement from the applicable frequency coordinator recommending the most appropriate frequency.

In these filings, applicant(s) describe the securities that the company proposes to issue. Additionally, applicant(s) indicate the purpose of the securities and whether or not the company will file any part of the application with any state. Applicant(s) provide a detailed statement of the facts upon which the applicant relies as well as a statement of the bond indentures or other limitations on interest and dividend coverage. These applicant(s) identify the effects of the limitations on the issuance of additional debt or equity securities. And finally, applicant(s) must provide a brief statement of any rate changes made effective during the subject period. The Commission issues an approval order if it finds that the issuance of any security or assumption of any obligation meets the following criteria: • it is for "lawful object" within the corporate purposes of the applicant and compatible with the public interest; • it is necessary or appropriate for or consistent with the proper performance by the applicant of service as a public utility; and • it will not impair the applicant's ability to perform service and is reasonably necessary or appropriate to perform service. The Commission uses this information to determine whether to approve an application for authorization to issue securities or to assume an obligation or liability by the public utilities and their licensees who make these applications. If the information were not collected, the Commission would not be able to comply with the FPA directives.

General Aviation and Air Taxi Activity and Avionics Survey

Key Information

Abstract

The survey covers aircraft used for general aviation as well as commuter air carriers and on-demand air taxis. Operators voluntarily provide information to the FAA. The following statistics have been derived from past surveys and will continue to be in the future. • Number of active aircraft by aircraft type; • Distribution of aircraft by state and FAA region; • Annual hours flown by aircraft type and by use; • Annual operations; • Airframe hours; • Annual hours flown by IFR/IFR flight plans; • Lifetime airframe hours; • Fuel consumption; • Avionics equipment; • Participation in fractional ownership. In addition, information relative to aircraft aging, gear type, and the airworthiness certificate are developed from the survey. Examples of specific uses of the survey statistics include: • General aviation active aircraft and hours flown are the primary exposure measures used throughout the agency in assessing the safety status of general aviation flying and in determining the impact of general aviation on the National Airspace System. • The agency and the National Transportation Safety Board (NTSB) use the exposure data, both by itself and in conjunction with aircraft age, to calculate accident rates, which are used to compare safety over time and safety performance among different aircraft types and configurations. • The agency and the NTSB will use the exposure data for public use aircraft to calculate accident rates for those aircraft. The NTSB is now required to investigate accidents involving public use aircraft. This is a responsibility assigned by Public Law 103-411. • Lifetime airframe hours are used in aircraft fatigue studies for determining mean time failures and establishing aircraft maintenance cycles. • Hours flown and active aircraft information by type of flying is used for safety analyses, forecasting and planning.. • Fuel consumption data are used for planning, forecasting and for assessing the effect of the agency’s energy conservation programs. • The state in which aircraft are based is used to determine the geographical dispersion of the fleet and to estimate activity by state. Activity by state is also required to support the FAA, and state and local governments for airport master planning. • Data on avionics capability are used for assessing the ability of the general aviation fleet to use the National Airspace System. The availability of avionics data also allows the FAA to determine at which airports various aircraft can land and in which segments of airspace they can fly. These data are used in assessing the economic impact of proposed regulations on the general aviation fleet. • In addition to the FAA, NTSB, and the Department of Commerce, other organizations in federal, state and local governments, as well as the aviation industry, use the data collected in this survey for many other purposes.

Abstract

The Department of Education (the Department) amended the Student Assistance General Provisions regulations issued under the Higher Education Act of 1965, as amended (HEA), to implement the changes made to the Student Assistance General Provisions regulations Subpart K Cash Management 668.164 Disbursing funds. These regulations are intended to ensure students and parents have convenient access to their Title IV, HEA program funds, do not incur unreasonable and uncommon financial account fees on these title IV funds and are not led to believe that they must open a particular financial account to receive their federal student aid. This request is for an extension of the information collection for the requirements that are contained in the regulations 668.164 Disbursing funds. The regulations require that an institution that makes direct payments to a student or parent by electronic funds transfer (EFT) and that chooses to enter into an arrangement described in 668.164(e) or (f), including an institution that uses a third-party servicer to make those payments, must establish a selection process under which the student chooses one of several options for receiving those Title IV, HEA fund payments. There has been no change to the regulations.

Abstract

AVIATOR is the FAA’s job application system. It supports Human Resources in creating vacancy announcements, collecting applications. Each time an applicant applies, the system provides the applicant a link to voluntarily complete a survey regarding his/her experience in using AVIATOR in applying to FAA job announcements. The survey results are reviewed each week during a meeting with the AVIATOR programmers and system owners. The results are used to make enhancements to the system to improve/enhance AVIATOR application process. Results are not shared with the general public.

Verification of Authenticity of Foreign License, Rating, and Medical Certification

Abstract

All airmen wishing to use their foreign license in lieu of an aeronautical knowledge test, experience and a practical test when applying for a restricted or unrestricted U.S. certificate must submit to this information collection. The Airmen Certification Branch will use the required information to properly identify the person for the purpose of requesting foreign license verification from the appropriate CAA and for checking the applicant’s information against a list of potential TSA threats. Any person who is applying for a U.S. certificate and/or rating on the basis of a foreign license must apply for that certificate at least 90 days before arriving at the designated FAA Flight Standards District Office (FSDO) where the applicant intends to receive the U.S. certificate. This allows time for the Airmen Certification Branch to ask for and receive verification from the appropriate CAA that the person’s foreign license is current and valid.

Abstract

The respondents to this collection are mandated to collect and report information to the FAA. Respondents are organizations wishing to conduct nonpassenger-carrying external-load operations for compensation or hire, which requires the proper certification and or renewal of certification. The FAA uses this information, required, to process the operating certificate as a record of aircraft authorized for use, and to monitor Rotorcraft External Load Operations. FAA Form 8710 4, Rotorcraft External Load Operator Certificate Application, provides a record of surveillance activities when completed by an inspector. If the information were not collected, FAA would not be able to meet its regulatory responsibilities for oversight and surveillance under Part 133.
