What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Noise is a harmful physical agent and one of the most pervasive health hazards in mining. Repeated exposure to high levels of sound over time causes occupational noise-induced hearing loss (NIHL). NIHL is a serious, often profound physical impairment for miners, with far-reaching psychological and social effects. NIHL can be distinguished from aging and other factors that can contribute to hearing loss and it can be prevented. According to the National Institute for Occupational Safety and Health (NIOSH), NIHL is among the "top ten" leading occupational illnesses and injuries. For many years, NIHL was regarded as an inevitable consequence of working in a mine. Mining, an intensely mechanized industry, relies on drills, crushers, compressors, conveyors, trucks, loaders, and other heavy-duty equipment for the excavation, haulage, and processing of material. This equipment creates high sound levels, exposing machine operators as well as miners working nearby to occupational noise that can contribute to hearing loss. MSHA, the Occupational Safety and Health Administration, the military, and other organizations around the world have established and enforced standards to reduce the loss of hearing. Quieter equipment, isolation of workers from noise sources, and limiting the time workers are exposed to noise are among the many well-accepted methods that will prevent NIHL. Records of miners’ exposures to noise are necessary so that mine operators and MSHA can evaluate the need for and effectiveness of engineering controls, administrative controls, and personal protective equipment to protect miners from harmful levels of noise that can result in hearing loss. However, the Agency believes that extensive records for this purpose are not needed. Instead, the requirements are a performance-oriented approach to monitoring. Records of miners’ hearing examinations enable mine operators and MSHA to ensure that the controls are effective in preventing NIHL for individual miners. Records of training are needed to confirm that miners receive the information they need to become active participants in hearing conservation efforts.

Abstract

Clean Water Act section 312(p), titled Uniform National Standards for Discharges Incidental to Normal Operation of Vessels, directs EPA to establish national standards of performance for discharges incidental to the normal operation of commercial vessels greater than 79 feet in length; other non-recreational, non-Armed Forces vessels, such as research and emergency rescue vessels; and ballast water only from small vessels (vessels less than 79 feet in length) and fishing vessels of all sizes. The activities covered by this ICR include petitions from states, as provided for in 312(p), for the establishment of no-discharge zones (NDZs), issuance of emergency orders, review of standards of performance, and establishment of enhanced Great Lakes system requirements. This is not a reporting requirement, nor are there any deadlines associated with these requests. Instead, states may voluntary undertake the burden of pursuing a petition as needed or desired. The information collection burden is largely attributable to the preparation of these petitions by states and EPA's subsequent review of the petitions.

Abstract

The information collection under OMB Control Number 2900-0160 includes VA Forms 10-5588, 10-5588A, and 10-10SH and has a current Paperwork Reduction Act (PRA) clearance with an expiration date of 10/31/2026. VHA is implementing a new regulation that will add another element to this information collection. Specifically, the new regulation will allow State homes to submit a list of veteran names to VA for reconsideration of previously denied claims. This will be a time limited opportunity that must occur within 30 days of the effective date of the rule. Authority for this information collection can be found in two public laws affecting State homes: Public Law 115-159, the State Veterans Home Adult Day Health Care Improvement Act of 2017, which requires VA to pay State Veteran Homes (SVHs) for medical model adult day health care provided to certain eligible Veterans; and Public Law 116-315, Section 3007, Waiver of Requirements of Department of Veterans Affairs for Receipt of Per Diem Payments for Domiciliary Care at State Homes and Modification of Eligibility for such Payments. This information collection also enables the payment of per diem to State homes that provide care to eligible Veterans in accordance with Title 38, CFR Part 51. The intended effect of these provisions is to create a safeguard that Veterans are receiving a high quality of care in SVHs. To ensure that high quality care is furnished to Veterans, VA requires those facilities providing nursing home care, domiciliary care, and adult day health care programs to Veterans to supply various kinds of information. The information required includes an application and justification for payment; records and reports that facility management must maintain regarding payment activities of residents or participants; and records and reports that facilities management and health care professionals must maintain regarding eligibility and level of care for residents or participants. The following three forms are included in this information collection: 10-5588, 10-5588A, and 10-10SH. The State Home Per Diem (SHPD) Program made updates to the automated the 10-10SH form to increase functionality and usage. This form was converted into a web-based, fillable form that can be electronically submitted from the SVH to the appropriate VAMC. It includes data field validation, assuring that all required fields have been filled before the user can electronically submit the 10-10SH form. The VA portion of the application also includes business rules to assist the VA representatives in making uniform determinations, allow the VA representative to return incomplete applications to the SVH along with a notification to them, and record the receipt of the completed application.

Under 31 U.S.C. 5313, the Secretary is authorized to require financial institutions to report certain currency transactions. Regulations implementing 31 U.S.C. 5313 are found at 31 CFR 1010.310 through 1010.314, 31 CFR 1021.311, and 31 CFR 1021.313. The Money Laundering Suppression Act of 1994 amended the BSA to create certain mandatory exemptions applicable to banks from the requirement for financial institutions to file currency transaction reports (CTRs), and to give the Secretary authority to create additional such exemptions. Regulations implementing this exemption authority, including by requiring the collection of information on FinCEN Form 110, Designation of Exempt Person (DOEP Report), are found at 31 CFR 1020.315.

Abstract

Pilot reporting of weather conditions, including turbulence, commonly referred to as Pilot Weather Reports (PIREPs), has been standard procedure during most of the Twentieth century. By the late 1940s, the International Civil Aviation Organization (ICAO) had developed standards which included aircraft-based weather observations by pilots and subsequent government distribution. In the USA, commercial airlines developed their own collection and distribution methods. This was in response to Federal Aviation Administration (FAA) requirements that pilots should report hazardous weather, and airlines should have ability to monitor the progress of every flight. Pilot Weather Reports (PIREPs) are voluntary reports from pilots describing weather conditions observed while flying. PIREPs are an important source of weather information in the National Airspace System (NAS). In some instances PIREPs are the only way for forecasters to confirm the forecasted conditions are occurring. Complete, accurate, and timely weather information from PIREPs is an essential element of flight safety for all aircraft operations in the NAS. This information is used by pilots to avoid inadvertent encounters with hazardous weather and preventing weather-related accidents. Pilots most commonly submit PIREPs verbally via radio to a flight service station (FSS). Pilots also have technology options to transmit a PIREP in text format, through either aircraft or web-based tools and/or portable electronic devices. The PIREP Form, FAA Form 7110-2, is a tool to assist ATC personnel and pilots to report the conditions encountered in the proper format. It is essential that the weather conditions in a PIREP be reported be in the correct format to ensure the timely dissemination and availability to the users of the NAS. The PIREP format includes aircraft type, location, altitude; time conditions were observed; and a description of observed weather conditions.

Approval Procedures for Nontoxic Shot and Shot Coatings (50 CFR 20.134)

Abstract

We collect this information only when a manufacturer submits an application for approval of a nontoxic shot or shot coating. The regulations at 50 CFR 20.134 outline the application and approval process for new types of nontoxic shot and specify what information we collect and how we use it to determine the shot material’s nontoxic status. When considering approval of a candidate material as nontoxic, we must ensure that it is not hazardous in the environment and that secondary exposure (ingestion of spent shot or its components) is not a hazard to migratory birds. To make that decision, we require each applicant to collect information about the solubility and toxicity of the candidate material. Additionally, for law enforcement purposes, a noninvasive field detection device must be available to distinguish candidate shot from lead shot. This information constitutes the bulk of an application for approval of nontoxic shot.

Abstract

Section 251(b)(2) of the Communications Act of 1934, as amended requires LECs to “provide, to the extent technically feasible, number portability in accordance with requirements prescribed by the Commission.” Through the LNP process, consumers have the ability to retain their phone number when switching telecommunications service providers, enabling them to choose a provider that best suits their needs and enhancing competition. In the Porting Interval Order and Further Notice, the Commission mandated a one business day porting interval for simple wireline-to-wireline and intermodal port requests. The information collected in the standard local service request data fields is necessary to complete simple wireline-to-wireline and intermodal ports within the one business day porting interval mandated by the by the Commission and will be used to comply with Section 251 of the Telecommunications Act of 1996.

This information collection implements the statutory obligations of section 222 of the Communications Act of 1934, as amended, 47 U.S.C. 222. These regulations impose safeguards to protect customers' CPNI against unauthorized access and disclosure. In November 2023, the FCC released the SIM Swap and Port-Out Fraud Order (88 FR 85794 (December 8, 2023)), which modifies the existing CPNI collection requirements to establish a framework to combat SIM swap fraud. In December 2023, the Commission released the Data Breach Report and Order (89 FR 9968 (February 12, 2024)), which modifies the scope of customer data and reportable breaches covered by the Commission’s rules, and also modifies the Commission’s data breach notification rules to require covered service providers to electronically notify the FCC of a reportable data breach, and adopts equivalent requirements for telecommunications relay services (TRS) providers.

This request is for a revision of a currently approved information collection. This revision is being requested in support of the final rule to implement Framework Adjustment 16 to the Mackerel, Squid, and Butterfish Fishery Management Plan. Framework 16 proposes adding a vessel hold baseline requirement for limited access Illex squid vessels in order to cap fishing power and limit expansion of effort in the fishery. In order to comply with this requirement, limited access Illex squid permit holders will need to submit certified vessel hold capacity measurements to NMFS approximately 12 months after implementation of the rule, and vessel hold capacity measurements will be required on all subsequent vessel permit applications and RPH applications for limited access Illex squid vessels. This action will also clarify an existing requirement for limited access Illex squid permit holders to submit daily reports via vessel monitoring system (VMS) to better verify catch in this fishery. The burden hours and cost associated with daily VMS reporting in the Illex squid fishery were already calculated and approved through previous actions; therefore, this clarification does not need additional approval through the PRA. Additionally, this action will require Illex and longfin squid vessels to declare their primary annual vessel processing type in order to assist stock assessment scientists in calculating catch per unit effort (CPUE). This information will be collected through the use of existing vessel permit applications and there will be negligible additional burden and no cost; therefore, this requirement also does not need additional approval through the PRA.

Section 1123A [42 U.S.C. 1320a-1a] of the Social Security Act (the Act) and regulations at 45 CFR 1355.33(b), 45 CFR 1355.33(c) and 45 CFR 1355.35(a) govern the Child and Family Services Reviews (CFSR). The CFSR looks at both the outcomes related to safety, permanency and well-being of children served by the child welfare system and the assessment of seven systemic factors. The systemic factors refer to systems within a state that, if well-functioning, will support the outcomes. This regulated monitoring process allows ACF to determine whether states are complying with federal child welfare requirements; determine what is happening to children and families; and assist states to enhance their capacity to help children and families achieve positive outcomes. Ultimately, the goal of the CFSR is to help states improve child welfare services by identifying their strengths and areas needing improvement. Three activities are associated with the CFSR collection: a statewide assessment, which is the state’s evaluation of its performance on CFSR outcomes and systemic factors and is used to guide the focus of the onsite review; an on-site review, which involves case record reviews and a joint federal-state team interviewing stakeholders in the state to inform the Children’s Bureau’s (CB) determination of the state’s functioning on the seven systemic factors; and a program improvement plan, which addresses areas in which states are found to be out of conformity with any one of the seven outcomes or seven systemic factors under review.

Abstract

This information collection protects miners by assuring that up-to-date, accurate mine maps contain the information needed to clarify the best alternatives for action during an emergency operation. Also, coal mine operators routinely use maps to create safe and effective development plans. Mine maps are schematic depictions of critical mine infrastructure, such as water, power, transportation, ventilation, and communication systems. Using accurate, up-to-date maps during a disaster, mine emergency personnel can locate refuges for miners and identify sites of explosion potential; they can know where stationary equipment was placed, where ground was secured, and where they can best begin a rescue operation. During a disaster, maps can be crucial to the safety of the emergency personnel who must enter a mine to begin a search for survivors. Mine maps may describe the current status of an operating mine or provide crucial information about a long-closed mine that is being reopened. Coal mine operators use map information to develop safe and effective plans and to help determine hazards before beginning work in areas, such as abandoned underground mines or the worked-out and inaccessible areas of an active underground or surface mine. Abandoned mines or inaccessible areas of active mines may have water inundation potentials and explosive levels of methane or lethal gases. If an operator, unaware of the hazards, were to mine into such an area, miners could be killed or seriously injured.

This is to request approval for the continued use of an electronic Individual Development Plan (eIDP), with an exit survey. Completing an eIDP is a crucial step in a trainees’ professional development and is a standard in graduate and postdoctoral education. An IDP is an effective tool for trainees to think about their career goals and skills needed to achieve them during their time at the NEI. Trainees work together with their research mentor to organize and describe their research projects, consider career paths, and set training goals and expectations. The information provided by the trainee on their proposed project, for example, helps their mentor judge the merits and feasibility of said project, helping identify problems early on and prevent possible delays. As research training at the NIH is time-limited (for example, postdoctoral fellows can only stay five years without special permission) and the types of research emphasized at the NIH and NEI are high-risk/high-reward projects that typically span much of the trainee’s tenure, the use of the project section in the eIDP assists mentors and mentees in aligning their goals and has ensured that projects are well thought out and planned to avoid delays. Additionally, in case of a dispute on the direction of a project, the mentor and mentee can refer back to what’s proposed within the eIDP.

Pursuant to the Danny Keysar Child Product Safety Notification Act, section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), the U.S. Consumer Product Safety Commission (Commission or CPSC) is issuing a final rule establishing a consumer product safety standard for nursing pillows. CPSC is also amending its regulations regarding third party conformity assessment bodies, to include the safety standard for nursing pillows in the list of notices of requirements (NORs), along with identifying nursing pillows as a durable infant or toddler product subject to consumer registration requirements. The rule for nursing pillows contains information collection requirements that are subject to public comment and review by the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995 (PRA; 44 U.S.C. 3501–3521).
