What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Permits for Incidental Taking of Endangered or Threatened Species

Key Information

Abstract

This request is for an extension of a current information collection. The Endangered Species Act of 1973 (ESA; 16 U.S.C. 1531 et. seq.) imposed prohibitions against the taking of endangered species. In 1982, Congress revised the ESA to allow permits authorizing the taking of endangered species incidental to otherwise lawful activities. The corresponding regulations (50 CFR part 222) established procedures for persons to apply for such a permit. In addition, the regulations set forth specific reporting requirements for such permit holders. The regulations contain three sets of information collections: (l) applications for incidental take permits, (2) applications for certificates of inclusion, and (3) reporting requirements for permits issued. Certificates of inclusion are only required if a general permit is issued to a representative of a group of potential permit applicants, rather than requiring each entity to apply for and receive a permit. The required information is used to evaluate the impacts of the proposed activity on endangered species, to make the determinations required by the ESA prior to issuing a permit, and to establish appropriate permit conditions. When a species is listed as threatened, section 4(d) of the ESA requires the Secretary to issue whatever regulations are deemed necessary or advisable to provide for conservation of the species. In many cases those regulations contain a blanket application of the ESA’s section 9 take prohibition. However, the National Marine Fisheries Service (NMFS) recognizes certain exceptions to that prohibition, including habitat restoration actions taken in accord with approved state watershed action plans. While watershed plans are prepared for other purposes in coordination with or fulfillment of various state programs, a watershed group wishing to take advantage of the exception for restoration activities (rather than obtaining a section 10 permit) would have to submit the plan for NMFS review.

Abstract

The information collection requirements contained in the proposed rule titled “Transparency in Coverage,” published November 27, 2019 (84 FR 65464), would require group health plans and health insurance issuers offering coverage in the individual and group markets to disclose to a participant, beneficiary, or enrollee (or an authorized representative on behalf of such individual), the estimated cost-sharing liability for covered items or services from a particular provider or providers, thereby allowing a participant, beneficiary, or enrollee to obtain an accurate estimate and understanding of their potential out-of-pocket expenses and to effectively shop for covered items and services. Group health plans and health insurance issuers would be required to make such information available through a self-service tool on an internet website. The self-service tool must provide the information through real-time responses and allow users to search for cost-sharing information for covered items and services. The self-service tool must also allow users to input information necessary to learn the out-of-network allowed amount for a covered item or service and have the capability to refine and reorder results. Group health plans and health insurance issuers would also be required to make this information available as a disclosure in written form. Both the self-service tool and the paper disclosure would be required to include several disclaimer statements relevant to information provided through the disclosure and could be provided by using a model notice developed by the Departments. Additionally, group health plans and health insurance issuers would be subject requirements to disclose in-network provider negotiated rates and historical payment data for allowed amounts for covered items and services furnished by out-of-network providers through two digital files in a machine-readable format to be specified by the Departments. The Negotiated Rate file and the Allowed Amount file must be posted publicly on an internet website.

Evaluation of Emergency Housing Voucher Program

Key Information

Abstract

This new collection, sponsored by the U.S. Department of Housing and Urban Development (HUD), seeks to examine the implementation and outcomes associated with the Emergency Housing Voucher (EHV) program, which was created under the American Rescue Plan Act (ARPA) of 2021, in response to the COVID-19 pandemic. The EHV program awarded roughly 70,000 new Housing Choice Vouchers (HCV) to 611 public housing agencies (PHA) that were targeted to households experiencing or at-risk of experiencing homelessness. The collection aims to explore the structure of the EHV program compared to its analogous program, the Housing Choice Voucher program (HCV). Additionally, the evaluation will examine unique features of the EHV program, e.g., the partnerships formed between Public Housing Agencies (PHAs) and Continuums of Care (CoCs), and program features such as the use of administrative fees and waivers to assist program beneficiaries. In this context, HUD contracted with Social Policy Research Associates (SPR) and its subcontractor, Abt Global (Abt) (“the research team”), to evaluate the EHV program and collect data from three sources: 1) administrative data, 2) a national web survey of PHAs and CoCs, and 3) follow-up telephone interviews with a selected sample of PHAs, CoCs, and other PHA partner organizations in 25 communities. The evaluation will use a mixed-methods approach with administrative data and web survey data to measure outcomes in key interest areas. The follow-up telephone interviews will collect information on the experiences of program staff in implementing the EHV program. Data from this evaluation will help guide any future emergency housing voucher programs and could also inform possible changes to the HCV program to serve households who are experiencing or at risk of experiencing homelessness. The authority to collect this information is in Sections 501 and 502 of the Housing and Urban Development Act of 1970 (Public Law 91-609) (12 USC §§ 1701z-1; 1701z-2(d) and (g)).

FERC-537, Gas Pipeline Certificates: Construction, Acquisition and Abandonment

Abstract

The FERC 537 collection includes the requirements to obtain FERC approval for construction, aquisition, or abandonment of natural gas pipelines. Under the Natural Gas Act (NGA) a natural gas company must obtain FERC authorization to engage in the transportation of natural gas in interstate commerce, to undertake the construction or extension of any facilities, or to acquire or operate any such facilities or extensions in accordance with sSection 7(c) of the NGA. A natural gas company must also obtain FERC approval under sSection 7(b) of the NGA prior to abandoning any jurisdictional facility or service. Under the Natural Gas Policy Act (NGPA) (Public Law 96-621) interstate pipelines must also obtain FERC authorization for certain transportation arrangements. If a certificate is granted, the natural gas company can engage in the interstate transportation of natural gas and construct, acquire, or operate facilities. Conversely, approval of an abandonment application permits the pipeline to cease service and discontinue the operation of such facilities. Authorization under NGPA Section 311(a) allows the interstate or intrastate pipeline applicants to render certain transportation services.

This paperwork burden directly supports the Department of Transportation Strategic Goal on Safety. Specifically, the goal is to promote the public health and safety by working toward the elimination of transportation related deaths, injuries, and property damage. The LODA requirements under § 91.326(b) are similar to the current LODA requirements under § 91.319(h) for operators of certain experimental aircraft who broadly offer their aircraft for training, testing, or checking. In the “Public Aircraft Logging of Flight Time, Training in Certain Aircraft Holding Special Airworthiness Certificates, and Flight Instructor Privileges” final rule, the FAA will terminate current training LODAs issued under 91.319(h) within two years of the effective date of a final rule. To ensure that all operations in which an aircraft with a special airworthiness certificate is “held out” for training, testing, or checking comply with the proposed requirements, holders of current exemptions and LODAs permitting these training operations will need to apply for a LODA under the revised § 91.326(b).

Abstract

This information collection is submitted to the Office of Management and Budget (OMB) to request a three-year approval clearance for the information collection entitled “Flight Instructor Enhanced Qualification Training Program: Preparation and Approval.” The Federal Aviation Administration (FAA) is publishing a final rule to revise part 61 by creating two new qualification options for flight instructors to train initial flight instructor applicants, in addition to retaining the original qualification parameters as an option. Flight instructors seeking to instruct initial flight instructor applicants must satisfy one option to meet qualification requirements and, therefore, may choose between the three. One new option is the successful completion of an FAA-approved flight instructor enhanced qualification training program (FIEQTP), which may be offered by a part 141 pilot school or part 142 training center under the respective part. In order for training providers to offer an FIEQTP, they must submit specific course information to the FAA for approval. Additionally, the final rule requires part 141 pilot schools and part 142 training centers that offer an FIEQTP to provide certain documentation to its graduates.

The HIPAA Eligibility Transaction System (HETS) (CMS-10157)

Key Information

Abstract

The Centers for Medicare and Medicaid Services (CMS) is requesting the Office of Management and Budget's (OMB) approval of a revised HIPAA Eligibility Transaction System (HETS) Trading Partner Agreement form. CMS created the HETS application to provide Health Insurance Portability and Accountability Act of 1996 (HIPAA) compliant 270/271 health care eligibility inquiries (270) and responses (271) on a real-time basis. In creating the HETS application, federal law requires that CMS take precautions to minimize the security risk to federal information systems. Accordingly, CMS is requiring that trading partners who wish to connect to the HETS 270/271 application via the CMS Extranet and/or Internet agree to specific trading partner terms as a condition of receiving access to Medicare eligibility information. Applicants will complete the entire Trading Partner Agreement form indicate agreement with CMS trading partner terms and provide sufficient information to establish connectivity to the service and assure that those entities that access the Medicare eligibility information are aware of applicable provisions and penalties for the misuse of information.

Textile Mills Industry Data Collection (New)

Abstract

As announced in the Effluent Guidelines Program Plan 15, published in January 2023, the EPA plans to continue its detailed study investigating PFAS discharges from facilities in the Textile Mills point source category. Based on information and data collected during the Multi-Industry PFAS Study and the Textile Mills Detailed Study to date, the EPA determined PFAS are used by some textile manufacturing facilities to impart water, grease, and stain resistance to finished textiles, including consumer apparel, carpets, and technical textiles. The EPA, through this Information Collection Request (ICR) package, requests that the Office of Management and Budget (OMB) review and approve the ICR for the Textile Mills Detailed Study. Through this collection, the EPA will obtain data essential to determine if updated regulations are required to address PFAS in wastewater discharges from textile manufacturing facilities, including facilities regulated under the Textile Mills point source category as specified by the Effluent Limitations Guidelines and Standards (ELGs) codified in Title 40 of the Code of Federal Regulations (CFR) Part 410. This collection effort is necessary because national data on PFAS use, treatment, and discharge at textile manufacturing facilities is not currently available and EPA requires detailed information on industry practices to determine whether technology based ELGs are appropriate for the textile industry.

Abstract

The American Innovation and Manufacturing (AIM) Act of 2020 authorizes EPA to address hydrofluorocarbons (HFCs) in three main ways: phasing down HFC production and consumption through an allowance allocation program; promulgating certain regulations for purposes of maximizing reclamation and minimizing releases of HFCs and their substitutes from equipment; and facilitating sector-based transitions to next-generation technologies. This ICR covers provisions under subsection (i) of the AIM Act that restrict, fully, partially, or on a graduated schedule, the use of hydrofluorocarbons (HFCs or regulated substances) in the sector or subsector in which the regulated substance is used. In accordance with the rulemaking Phasedown of Hydrofluorocarbons: Restrictions on the Use of Certain Hydrofluorocarbons under Subsection (i) of the American Innovation and Manufacturing Act of 2020, manufacturers and importers of products containing HFCs are required to electronically report data to EPA and label products using regulated substances.

Abstract

The Bureau of Justice Statistics (BJS) requests clearance to conduct the core 2020 Law Enforcement Management and Administrative Statistics (LEMAS) Survey. In each iteration of LEMAS, BJS draws a nationally-representative sample of state and local law enforcement agencies from its census of state and local law enforcement agencies, administers the LEMAS instrument, and produces national-level estimates about the organization and characteristics of law enforcement agencies. The proposed survey seeks to better meet the needs of the law enforcement community, while maintaining the ability to trend over time with the previous LEMAS waves. The 2020 LEMAS sample will consist of about 3,500 state, county and local general purpose law enforcement agencies (LEAs) in the United States, will be nationally-representative, and will preserve continuity between previous LEMAS waves on critical data elements about LEAs nationwide. A revision to the approved package is being submitted to add questions to the survey instruments to examine the COVID-19 impact on staffing, budgeting and agency policies.

Pacific Islands Short-tailed Albatross Recovery Data Form

Abstract

This request is for a revision of a currently approved information collection. We request the revision to the current title changed from Pacific Islands Region Seabird-Fisheries Interaction Recovery Reporting to Pacific Islands Short-tailed Albatross Recovery Data Form because it is a more accurate description of the collection and its purpose. Other changes to the form include removing the field for hook type as only one hook type is currently allowed in the fishery, collecting information on hook size, collecting more details about bird bands, and requesting more information about transportation of an injured bird. These changes will not affect burden estimates. Federal regulations at 50 CFR 665.815(b) require that the operator of a vessel with a Hawaii longline limited access permit notify NMFS, the U.S. Coast Guard (USCG) or the U.S. Fish and Wildlife Service (USFWS) in the event an endangered short-tailed albatross (Phoebastria albatrus) or STAL is hooked or entangled during fishing operations. Following the retrieval of the albatross from the ocean, the vessel operator must record the condition of the bird on the recovery data form. A veterinarian will use the information to provide advice to the vessel operator for caring for the bird if it is alive. If the albatross is dead, the vessel operator must attach an identification tag to the carcass to assist USFWS biologists in follow-up studies on the specimen. This collection is one of the terms and conditions contained in the Endangered Species Act Section 7 biological opinion issued by USFWS, and is intended to maximize the probability of the long-term survival of short-tailed albatross accidentally taken by longline gear.

Small Biotech Exception and Biosimilar Delay Information Collection Request for Initial Price Applicability Year 2027 (CMS-10844) - IRA

Abstract

the Drug Price Negotiation Program established by the Inflation Reduction Act (IRA), a qualifying single source drug that meets the requirements for the exception for small biotech drugs (“Small Biotech Exception”) in section 1192(d)(2) of the Social Security Act (the Act) will be excluded from the definition of “negotiation-eligible drug” with respect to initial price applicability years 2026, 2027, and 2028. Among other requirements for this exception, the statute requires that CMS consider, for Part D drugs, total 2021 Medicare expenditures for the drug under Part D; total expenditures for all covered Part D drugs for such year; and total expenditures under Part D for all covered Part D drugs for which the manufacturer has an agreement under section 1860D-14A during 2021. For the purpose of this information collection request, “controlled group” means all corporations or partnerships, proprietorships and other entities treated as a single employer under 26 U.S. Code section 52(a) or (b). In order to accurately identify, at the request of a manufacturer, whether a given covered Part D drug qualifies for the Small Biotech Exception in accordance with section 1192(d)(2) of the Act, CMS needs to collect information to identify the entity that had a Medicare Coverage Gap Discount Program Agreement under section 1860D-14A for the drug as of December 31, 2021,including all other entities that, as of December 31, 2021, were treated as a single employer with that entity under subsection (a) or (b) of section 52 of the Internal Revenue Code of 1986.

EPA’s Voluntary Methane Challenge and Natural Gas STAR Programs (Renewal)

Abstract

The oil and natural gas industry is the second largest source of anthropogenic methane emissions in the U.S., according to the Inventory of U.S. Greenhouse Gas Emissions and Sinks: 1990-2022. Methane is the primary component of natural gas and a potent greenhouse gas. Since 1993, the US Environmental Protection Agencys (EPA) Natural Gas STAR Program has encouraged oil and natural gas companies to adopt cost-saving technologies and practices that improve operational efficiency and reduce methane emissions. This non-regulatory Program supported Partner companies in making voluntary efforts to implement recommended technologies and report related methane emissions reductions to EPA. In 2016, EPA launched a new program--the Methane Challenge Program. This Program leveraged the methane-reducing best practices and technologies developed by the industry and showcased through the Natural Gas STAR Program over the past 20+ years and created a mechanism for oil and natural gas companies to make ambitious, voluntary commitments to reduce their methane emissions. Methane Challenge Partners submitted detailed data to the Program each year so EPA, and the public, could track the progress Partners are making towards these commitments. EPA has recently taken historic steps to tackle wasteful methane emissions from the oil and gas sector beyond voluntary action. The Inflation Reduction Act directed EPA to implement a suite of actions to swiftly reduce methane emissions through the creation of the Methane Emissions Reductions Program (MERP). On December 2, 2023, EPA announced final New Source Performance Standards and Emissions Guidelines (NSPS/EG) to regulate the oil and gas industry under the Clean Air Act, resulting in ambitious requirements to reduce methane from both new and existing sources. The Department of Transportation has also imposed requirements on the transmission segment including implementation of the PIPES Act of 2020. Based on the limited remaining potential for voluntary actions to reduce methane emissions, EPA will be sunsetting the Methane Challenge Partnership, and transitioning its outreach efforts to advance ambitious, sector-wide methane reductions through technical assistance and outreach under the Methane Emissions Reduction Program. This follows EPAs sunsetting of the partnership agreements, implementation plans, and the reporting component of the Natural Gas STAR Program in 2022. Updating the ICR for the Methane Challenge and the Natural Gas STAR programs to reflect these programmatic changes is expected to significantly decrease burden by removing all partner reporting and partnership related data sharing aspects. The sole programmatic element involving voluntary collection of information the EPA plans to retain is the Oil and Gas Equipment and Service Providers Directory. This directory's purpose is to share information about service and technology providers that can facilitate methane emission reduction activities in the oil and gas sector. For this revision, EPA proposes to remove all partnership aspects and related information collection forms for both the Methane Challenge Program and the Natural Gas STAR Program. This includes the removal of annual reporting forms, partnership agreements, and implementation plans. The only information collection EPA proposes to retain under this ICR revision is for the Oil and Gas Equipment and Service Providers Directory. These changes will result in a significant overall decrease in burden for this ICR number.
