What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The American Innovation and Manufacturing (AIM) Act of 2020 authorizes EPA to address hydrofluorocarbons (HFCs) in three main ways: phasing down HFC production and consumption through an allowance allocation program; promulgating certain regulations for purposes of maximizing reclamation and minimizing releases of HFCs and their substitutes from equipment; and facilitating sector-based transitions to next-generation technologies. This ICR covers provisions under subsection (i) of the AIM Act that restrict, fully, partially, or on a graduated schedule, the use of hydrofluorocarbons (HFCs or regulated substances) in the sector or subsector in which the regulated substance is used. In accordance with the rulemaking Phasedown of Hydrofluorocarbons: Restrictions on the Use of Certain Hydrofluorocarbons under Subsection (i) of the American Innovation and Manufacturing Act of 2020, manufacturers and importers of products containing HFCs are required to electronically report data to EPA and label products using regulated substances.

Abstract

The Bureau of Justice Statistics (BJS) requests clearance to conduct the core 2020 Law Enforcement Management and Administrative Statistics (LEMAS) Survey. In each iteration of LEMAS, BJS draws a nationally-representative sample of state and local law enforcement agencies from its census of state and local law enforcement agencies, administers the LEMAS instrument, and produces national-level estimates about the organization and characteristics of law enforcement agencies. The proposed survey seeks to better meet the needs of the law enforcement community, while maintaining the ability to trend over time with the previous LEMAS waves. The 2020 LEMAS sample will consist of about 3,500 state, county and local general purpose law enforcement agencies (LEAs) in the United States, will be nationally-representative, and will preserve continuity between previous LEMAS waves on critical data elements about LEAs nationwide. A revision to the approved package is being submitted to add questions to the survey instruments to examine the COVID-19 impact on staffing, budgeting and agency policies.

Boundary and Annexation Survey (BAS)

Abstract

The Boundary and Annexation Survey (BAS) provides eligible governments, which include tribal, state, and general-purpose local governments, an opportunity to review the Census Bureau’s legal boundary data to ensure the Census Bureau has the correct boundary, name, and status information and make necessary updates. BAS also allows for the review and update of census designated place (CDP) boundaries and linear features. It fulfills the agency’s responsibility as part of the National Spatial Data Infrastructure, for which the Office of Management and Budget (OMB) Circular A-16 designates the Census Bureau as the lead federal agency for maintaining national data about legal government boundaries, as well as statistical and administrative boundaries. It also supports the geospatial data steward responsibilities of the Geospatial Data Act, the Evidence Act, OMB E-Gov, the Federal Geographic Data Committee, Data.gov, GeoPlatform.gov, the National Map, the Geographic Names Information System, and the Geospatial One-Stop. The Census Bureau uses the boundaries collected during BAS to tabulate data for various censuses and surveys including the decennial census, American Community Survey (ACS), and Population Estimates Program (PEP). It also uses the boundaries collected through BAS to support other programs such as the Redistricting Data Program, the Economic Census, the Geographically Updated Population Certification Program, and the Special Census program. Other federal programs also rely on accurate boundaries collected through BAS. The Department of Housing and Urban Development uses boundaries to determine jurisdictional eligibility for various grant programs, such as the Community Development Block Grant program. In addition, the Department of Agriculture uses boundaries to determine eligibility for various rural housing and economic development programs.

Abstract

This Declaration is used by CBP to ensure duty-free status for entries covering articles repaired abroad. It must be filed by importers claiming duty-free status. The "Declaration of Person Who Performed Repairs or Alterations," as required by 19 CFR 10.8, is used in connection with the entry of articles entered under subheadings 9802.00.40 and 9802.00.50, Harmonized Tariff Schedule of the United States (HTSUS, https://hts.usitc.gov/current). Articles entered under these HTSUS provisions are articles that were in the U.S., were exported temporarily for repairs or alterations, and are returned to the United States. Upon their return, duty is only assessed on the value of the repairs performed abroad and not on the full value of the article. The declaration under 19 CFR 10.8 includes information such as a description of the article and the repairs or alterations; the value of the article and the repairs or alterations; and a declaration by the owner, importer, consignee, or agent having knowledge of the pertinent facts. The information in this declaration is used by CBP to determine the value of the repairs or alterations, and to assess duty only on the value of those repairs or alterations. These requirements apply to the trade community who are familiar with CBP regulations and the tariff schedules and are required by law to provide this declaration.

Abstract

This document reflects a revision to a package (0925-0781) which was originally submitted for approval in March 2024. The Adolescent Brain Cognitive Development Study (ABCD Study®) is the largest long-term study of brain and cognitive development in children across the United States. Findings from the Study will greatly increase our understanding of environmental, social, and genetic factors that affect brain and cognitive development. One of the Study’s key missions is to collect data that will inform just and equitable policies to elevate the quality of life for all youth, especially those who have been historically marginalized. The ABCD Study will require up to two rounds of pre-testing per year in order to enhance participant experience and ensure that data collection is not negatively impacted by incomplete or missing responses or unclear instructions/communications. When feedback on certain stimuli is complete, the stimuli will be removed from data collection instruments (attachments G-M) and replaced with new or revised stimuli to reflect the ABCD Study’s evolving needs for pre-testing. The revision to this information collection denotes the plan to update the stimuli included in data collection instruments (web surveys, group discussion guides, online bulletin board guides, or at-home materials review) up to twice per year. This includes adding new stimuli when pre-testing needs are identified, updating stimuli to test revisions to the stimuli, and removing and replacing stimuli when feedback is complete.

Quarterly Survey of Public Pensions

Key Information

Abstract

The survey provides a rich source of data on public retirement systems administered by state and local governments in the United States and is used to collect data on the assets, revenues and expenditures of the 100 largest systems, as measured by the system assets. This survey provides the quarterly change in composition of the securities holdings of the defined benefit public employee retirement systems component of the economy. The Federal Reserve Board uses these data to track the public sector portion of the Flow of Funds Accounts. Additionally, the data are used by a variety of government officials, academics, students and non-profit organizations to analyze trends in public employee retirement and the impact of retirement obligations on the fiscal well-being of state and local governments.

The Redistricting Data Program

Abstract

The Redistricting Data Program (RDP) is one of many voluntary geographic partnership programs that collects boundaries and attributes to update the U.S. Census Bureau’s geographic database of addresses, streets, and boundaries. The Census Bureau uses its geographic database, i.e., the Master Address File/Topologically Integrated Geographic and Encoding and Referencing (MAF/TIGER) System, to link demographic data from surveys and the decennial census to locations and areas, such as cities, congressional and legislative districts, and counties. To tabulate statistics by localities, the Census Bureau must have accurate addresses, streets, boundaries, and attributes. The RDP is executed under the provisions of Title 13, Section 141(c) of the United States Code (U.S.C.). Under the provisions of Public Law 94-171, as amended (Title 13, United States Code (U.S.C.), Section 141(c)), “[t]he officers or public bodies having initial responsibility for the legislative apportionment or districting of each State may, not later than 3 years before the decennial census date, submit to the Secretary a plan identifying the geographic areas for which specific tabulations of population are desired.” The Census Bureau is requesting a clearance to continue activities included in the RDP. As the current OMB Control Number 0607-0988 clearance will expire in November 2024, the new clearance will allow the Census Bureau to provide RDP-specific materials and procedures to participants during the fiscal years (FY) 2025, 2026, and 2027. These activities include the solicitation of non-partisan liaisons, the collection of Post-2020 Census Congressional and State Legislative District Plans, and the Block Boundary Suggestion Project.

Abstract

Under section 5341 of title 5, United States Code, the pay of Federal trade, craft, and laboring employees is to be maintained in line with prevailing private sector levels for comparable work within a local wage area. The pay system for these employees is known as the Federal Wage System (FWS). The pay of FWS employees is fixed and adjusted on an annual basis. The U.S. Office of Personnel Management (OPM) has designated the Department of Defense (DOD) as the lead agency which sponsors and conducts annual wage surveys in numerous geographic areas to determine local prevailing rates and set pay for FWS employees. FWS wage surveys are conducted by DOD under regulatory guidelines established by OPM in part 532 of title 5, Code of Federal Regulations. The forms developed by OPM for FWS wage surveys are the Establishment Information Form, the Wage Data Collection Form, and the Wage Data Collection Continuation Form. The information collected on these forms enables DOD to establish the rates of pay for FWS employees based on prevailing rates of pay in the private sector for similar levels of work. OPM developed the data elements to be collected by DOD. DOD is authorized to vary the layout of the forms if necessary to meet its needs. The forms are printed by DOD. The forms are used as interview guidelines by Federal employees who collect data necessary to determine local prevailing rates. Federal employees complete the forms rather than private sector establishment officials.

Aircraft operators on occasion of seeking operational approval to conduct Reduced Vertical Separation Minimum (RVSM) operations are mandated to report initial identifying information to their responsible FAA safety office. The responsible FAA safety office registers RVSM approved airframes in the FAA RVSM Approvals Database. Additionally, on the occasion of completing airworthiness, continued airworthiness and operations program requirements, operators report information to the responsible FAA safety office which grants operational approval. Employee Retirement Income Security Act of 1974 Technical Release 1991-1

Abstract

Section 101(e) of ERISA establishes notice requirements that must be satisfied before an employer may transfer excess assets from a defined benefit pension plan to a retiree health benefit account, as permitted under the conditions set forth in section 420 of the Internal Revenue Code of 1986, as amended (the Code). The notice requirements of ERISA section 101(e) are two-fold. First, subsection (e)(1) requires plan administrators to provide advance written notification of such transfers to participants and beneficiaries. Second, subsection (e)(2)(A) requires employers to provide advance written notification of such transfers to the Secretaries of Labor and the Treasury, the plan administrator, and each employee organization representing participants in the plan. Both notices must be given at least 60 days before the transfer date. The two subsections prescribe the information to be included in each type of notice and further give the Secretary of Labor the authority to prescribe how notice to participants and beneficiaries must be given, and how any additional reporting requirements are deemed necessary. On May 8, 1991, the Department published ERISA Technical Release 91-1, to provide guidance on how to satisfy the notice requirements prescribed by ERISA section 101(e). The Technical Release made two changes in the statutory requirements for the second type of notice. First, it required the notice to include a filing date and the intended asset transfer date. Second, it simplified the statutory filing requirements by providing that filing with the Department of Labor would be deemed sufficient notice to both the Department and the Department of the Treasury as required under the statute.

The term “blackout period” is generally defined as any period of more than three consecutive business days during which time the ability of plan participants and beneficiaries to direct or diversify investments or to obtain loans or distributions is suspended, limited or restricted.

Abstract

The Employee Retirement Income Security Act of 1974 (ERISA) section 104 requires administrators of employee benefits plans (pension and welfare plans) and employers sponsoring certain fringe benefit plans and other plans of deferred compensation to file returns/reports annually with the Secretary of Labor concerning the financial condition and operation of plans. Reporting requirements are satisfied by filing the Form 5500 in accordance with its instructions and the related regulations. Form 5500 filings are processed under the ERISA Filing Acceptance System 2 (EFAST-2), which is designed to simplify and expedite the receipt and processing of the Form 5500 by relying on internet-based forms and electronic filing technologies. In order to file electronically, employee benefit plan Filing authors, Schedule authors, Filing signers, Form 5500 transmitters, and entities developing software to complete and/or transmit the Form 5500 are required to register for EFAST-2 credentials through the EFAST2 website. The information requested for registration includes: Applicant type (Filing Author, Filing Signer, Schedule Author, Transmitter, or software developer); mailing address; fax number (optional); email address; company name, contact person; and daytime telephone number. Registrants must also provide an answer to a challenge question (“What is your date of birth?” or “Where is your place of birth?”), which enables users to retrieve forgotten credentials. In addition, registrants must accept a Privacy Agreement; PIN Agreement; and, under penalty of perjury, a Signature Agreement.

Federal Student Loan Program: Internship/Residency and Loan Debt Burden Forbearance Forms

Abstract

These forms serve as the means by which borrowers in the William D. Ford Federal Direct Loan (Direct Loan), Federal Family Education Loan (FFEL) and the Federal Perkins Loan (Perkins Loan) Programs may request forbearance of repayment on their loans if they meet certain conditions. The U.S. Department of Education and other loan holders uses the information collected on these forms to determine whether a borrower meets the eligibility requirements for the specific type of forbearance. The Service forbearance (SERV Forb) and the Student Loan Debt forbearance (SLDB Forb) forms are currently approved under OMB No. 1845-0018. The General forbearance (GEN Forb) form is currently approved under OMB No. 1845-0031. For greater simplicity and to make it easier to maintain consistency among the various forbearance forms, the Department is consolidating the two current collections into a single collection under OMB No. 1845-0018. This review request merges the number of respondents/responses/burden hours for both collections.

Summer Food Site Locations for State Agencies

Abstract

This non-substantive change request is for revisions to Form FNS-905. These revisions include adding a new data collection field, updating the data which is required, and updating the instructions for the form. Section 13 of the Richard B. Russell National School Lunch Act (NSLA) authorizes the Summer Food Service Program (SFSP) and the National School Lunch Program Seamless Summer Option (SSO) to provide low-income children with access to nutritious meals when school is not in session. Meals meeting Federal nutrition guidelines are served at no cost to all children 18 years old and under at approved SFSP and SSO sites in areas in which at least 50 percent of children are eligible for free and reduced-price school meals during the school year. The Form FNS-905 is the instrument used to voluntarily collect information from State agencies about approved summer meal sites.

Abstract

Reverse mortgages are home-secured loans typically offered to elderly consumers. Financial institutions currently provide two types of reverse mortgage products: the lenders’ own proprietary reverse mortgage products and reverse mortgages insured by the Federal Housing Administration (FHA) within the U.S. Department of Housing and Urban Development (HUD). Reverse mortgage loans insured by the FHA are made pursuant to the guidelines and rules established by HUD’s Home Equity Conversion Mortgage (HECM) program. HECM loans and proprietary reverse mortgages are also subject to consumer financial protection laws and regulations (e.g., the regulations that implement laws such as the Real Estate Settlement Procedures Act (RESPA) and the Truth in Lending Act (TILA)).
