What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

Section 14(a) of the Consumer Product Safety Act (CPSA) requires manufacturers (including importers) and private labelers of certain regulated consumer products manufactured outside the United States to test and issue a certificate of compliance (COC) certifying such products as compliant with applicable laws and regulations before importation. 15 U.S.C. 2063(a). Section 14(g)(1) of the CPSA describes the data required on a COC. Section 14(g)(3) requires a COC to accompany the applicable product or shipment of products covered by the COC, and that certifiers furnish the COC to each distributor or retailer of the product. Upon request, COCs must also be furnished to CPSC and CBP. However, section 14(g)(4) provides that “[i]n consultation with the Commissioner of Customs, the Commission may, by rule, provide for the electronic filing of [COCs] under this section up to 24 hours before arrival of an imported product.” CPSC refers to the electronic filing of COCs as eFiling. To test CPSC and CBP systems and to receive participant feedback on the eFiling program, from October 2023 through June 2024, CPSC conducted a Beta Pilot test with 37 participants. 87 FR 35513 (June 10, 2022). During this test, CPSC worked with participants to develop and improve IT solutions and CPSC procedure. CPSC staff anticipates sending a final rule to implement eFiling in the coming months. To continue testing the eFiling system, and to allow sufficient time for importers of consumer products and substances to participate in eFiling and prepare for such a required program, CPSC now seeks to expand the Beta Pilot test (expanded Beta Pilot) from up to 50 participants to up to an additional 2,000 participating importers. 89 FR 47922 (June 4, 2024) (60-Day Notice); 89 FR 73392 (Sept. 10, 2024) (30-Day Notice).

Abstract

The National Marine Fisheries Service (NMFS) requests OMB merge the 0648-0826 temporary information collection into approved information collection 0648-0545, Central Gulf of Alaska Rockfish Program: Permits and Reports. Due to the concurrent timing of the rulemaking for 0648-BM69 and the renewal of information collection 0648-0545, Central Gulf of Alaska Rockfish Program: Permits and Reports, a temporary collection was created for the rule-related collection. This request seeks to merge the new temporary collection (0648-0826) with 0648-0545 now that all actions have been resolved. The National Marine Fisheries Service (NMFS) promulgated a rule (0648-BM69) to implement Amendment 113 to the Fishery Management Plan for Groundfish of the Gulf of Alaska. This rule revised regulations for the Application for Rockfish Cooperative Fishing Quota and the Rockfish Program vessel check in / check out report. The application requirement does not increase the total annual respondents, responses, and burden, but the vessel check in / check out report adds ten (10) new respondents, which is approved under OMB Control Number 0648-0545.

Certificate of Enforcement of Heavy Vehicle Use Tax

Key Information

Abstract

This information request requires the Governor or a named designee in each State submit a certification each year that the State has received a proof-of-payment of the Heavy Highway Vehicle Use Tax (HVUT) before certain vehicles, those over 55,000 pounds Gross Vehicle Weight (GVW), can receive a new registration or renewal of a registration for each vehicle. The administration of the HVUT is primarily the responsibility of the Internal Revenue Service, such as collecting the tax and issuing the proof-of-payment to the vehicle owner, but FHWA is required to perform in-person reviews of the documentation that the State has received, and to receive the annual certifications. The certification is required by all 50 States and the District of Columbia. The document collected by FHWA includes language required in the Code of Federal Regulations, Title 23 (Highways), Section 669. The regulation includes required language that will be included in the certification, and directions on how to submit the certification. The certification will cover the previous Federal Fiscal Year (Oct. 1 to Sept. 30) and is due to each of the local FHWA Division Offices by January 1 of the following year. This is a revision required after the expiration of the previous collection notice.

Abstract

This is a request for a 3-year extension of an already approved ICR, which was an emergency request approved by OMB on April 4, 2024, and expires on September 30, 2024. There are no changes in the estimated burden hours or costs for this ICR. The collection of information is associated with the Infrastructure Investment and Jobs Act (IIJA) Section 23022 requirement to provide Congress a recommendation regarding whether the level of safety achieved by the SDAP program is equivalent to, or greater than, the level of safety for equivalent commercial motor vehicle (CMV) drivers aged 21 years or older. The agency is required to collect (1) data relating to any safety incident involving an apprentice participating in the Apprentice Pilot Program; (2) data relating to any safety incident involving a driver under the age of 21 operating a commercial motor vehicle in intrastate commerce; and (3) such other data relating to the safety of Apprentice Pilot Program participants aged 18 to 20 years operating in interstate commerce as the Secretary determines to be necessary. Information collection tools consist of (1) applications from motor carriers interested in participating in the apprentice pilot program, (2) driver information and consent forms for apprentice drivers, (3) driver information and consent forms for experienced drivers, (4) safety benchmark certifications participating carriers complete for each apprentice, and (5) monthly data submissions from participating motor carriers. The information collection (IC) tools consist of six ICs: IC-1, applications from motor carriers interested in participating in the SDAP program;IC-2, driver information and consent forms for apprentice drivers;IC-3, driver information and consent forms for experienced drivers;IC-4, safety benchmark certifications participating carriers complete for each apprentice; IC-5a, monthly data submissions; and IC-5b, miscellaneous monthly data submissions from participating motor carriers. The data collected will be used to report: 1)The findings and conclusions on the ability of technologies or training provided to apprentices as part of the pilot program to successfully improve safety; 2)An analysis of the safety record of participating apprentices as compared to other CMV drivers; 3)The number of drivers that discontinued participation in the apprenticeship program before completion; 4)A comparison of the safety records of participating drivers before, during, and after each probationary period; and 5)A comparison of each participating driver’s average on-duty time, driving time, and time spent away from home terminal before, during, and after each probationary period. FMCSA will monitor the monthly data being reported by the motor carriers and will identify drivers or carriers that may pose a risk to public safety. It is a necessary feature for FMCSA to comply with 49 CFR 381.505, which requires development of a monitoring plan to ensure adequate safeguards to protect the health and safety of pilot program participants and the general public. Knowing that a driver or carrier was removed from the SDAP program for safety reasons will help FMCSA minimize bias in the final data analysis. The results of the SDAP program will be documented in a technical report that will be delivered to and maintained by FMCSA. This report will be made available to the public on the FMCSA Web site, at www.fmcsa.dot.gov. The estimated annual burden for all respondents is 56,448 hours at a cost of $2,352,675.70.

Deep Seabed Mining Regulations for Exploration Licenses

Abstract

This request is for the extension of the currently approved information collection. No changes have been made to the collection requirements. NOAA’s regulations at 15 CFR part 970 govern the issuing and monitoring of exploration and production licenses under the Deep Seabed Hard Mineral Resources Act. The NOAA Office for Coastal Management is responsible for approving and administering licenses. Any persons seeking a license must submit certain information that allows NOAA to ensure the applicant meets the standards of the Act. Licensees are required to conduct monitoring and make reports, and they may request revisions, transfers, or extensions of licenses. Information required for the issuance and extension of licenses is provided to fulfill statutory requirements to ensure that license applicants have identified areas of interest for deep seabed hard mineral exploration and production; developed plans for those activities; have the financial resources available to conduct proposed activity; and have considered the effects of the activity on the natural and human environment. This information is used to determine whether licenses should be granted or extended. Exploration licenses and commercial recovery permits under the Deep Seabed Hard Mineral Resources Act are only for activities by U.S. citizens in international waters. No license or permit applications have been received since the early 1980s, and none are expected during this collection period. Two exploration licenses issued in the early 1980s are held by Lockheed Martin Corporation. The licenses are subject to annual reporting requirements and extension requests every five years. No at-sea exploration is authorized under the licenses without further authorization from NOAA.

Medication Therapy Management Program - Standardized Format (CMS-10396)

Key Information

Abstract

The MMA of 2003 under title 42 CFR Part 423, Subpart D, established the requirements that Part D sponsors must meet with regard to medication therapy management (MTM) programs. Beginning in 2010, sponsors must offer an interactive, person-to-person comprehensive medication review (CMR) by a pharmacist or other qualified provider at least annually. A CMR is a review of a beneficiary's medications, including prescription and over-the-counter (OTC) medications, herbal therapies, and dietary supplements, which is intended to aid in assessing medication therapy and optimizing patient outcomes. Sponsors must summarize the CMR and provide an individualized written or printed summary to the beneficiary. The burden associated with the time and effort necessary for Part D sponsors to conduct CMRs with written summaries was estimated previously (RIN 0938-AP77, OCN: 0938-0964).The ACA under Section 10328 specifies that the Secretary, in consultation with relevant stakeholders, develop a standardized format for the action plan and written or printed summary that are given to beneficiaries as a result of their CMRs. The standardized format will replace whatever formats Part D sponsors are using for their written CMR summaries and action plans prior to 2013. Beginning in January, 2013, Part D sponsors will collect information required by the new standardized format, and provide that information to Medicare beneficiaries after their CMRs on forms that comply with the requirements specified by CMS for the standardized format (RIN 0938-AQ00). The use of the standardized format will support a uniform and consistent level of MTMP communications with beneficiaries, improve the ability of beneficiaries to understand and manage their medications safely and effectively, and support improved healthcare outcomes and lower overall healthcare costs. The final standardized format will be posted in the 2013 Call Letter for implementation by Part D sponsors in January 2013.

Survey To Collect Economic Data From Recreational Anglers Along the Atlantic Coast

Abstract

This request is for a revision and extension to a currently approved information collection. The first data collection effort in 2019 under OMB Control Number 0648–0783 was to assess how changes in saltwater recreational fishing regulations affect angler effort, angler welfare, fishing mortality, and future stock levels. That data collection effort focused on anglers who fished for Atlantic cod and haddock off the Atlantic coast from Maine to Massachusetts (North Atlantic Recreational Fishing Survey I). In 2020, the collection was revised to remove the cod and haddock survey and add a survey focused on anglers who fish for summer flounder, black sea bass, and scup along the Atlantic coast from Massachusetts to North Carolina (North Atlantic Recreational Fishing Survey II). In 2022, the collection was revised again to re-add the original cod and haddock survey back to this control number (North Atlantic Recreational Fishing Survey III). This revision will re-add the survey focused on summer flounder, black sea bass, and scup (North Atlantic Recreational Fishing Survey IV) that was inadvertently removed in the last revision. The objective of these surveys will remain exactly the same as the previous surveys conducted under this control number. That is, to statistically assess how anglers respond to changes in management options and fishing regulations (e.g., bag limits, size limits, dates of open seasons, etc.). The survey data will provide the information fisheries managers need to conduct updated analysis of the socio-economic effects to recreational anglers and to coastal communities of proposed changes in fishing regulations. The recreational fishing community and regional fisheries management councils now rely on species-specific socio-economic studies of recreational fishing for analyses of fisheries policies. These surveys will address the stated need for more species-specific studies.

The information collections in parts 7, 34,160, and 190 are required by statute to regulate real estate lending and holding by national banks and savings associations. They are used by the OCC to ensure the safe and sound operation of institutions and institution compliance. This ICR is being filed in connection with final interagency guidance on reconsiderations of value (ROV) of residential real estate valuations. The guidance highlights the risks associated with deficient residential real estate valuations and describes how financial institutions may incorporate ROV processes and controls into established risk management functions. The guidance also provides examples of ROV policies, procedures, and control systems that institutions may choose to implement that identify, address, and mitigate the risk of deficient valuations. The OCC, Board, FDIC, CFPB, and the NCUA are revising their real estate appraisals and evaluations information collections to account for these new policies, procedures, and control systems. Additionally, the banking agencies are updating and aligning their information collections with respect to the burden associated with the Interagency Appraisal and Evaluation Guidelines.

Abstract

This information request requires applicants for the Federal Highway Administration’s (FHWA) Highway Use Tax Evasion (HUTE) Grants to use the forms in the grants.gov application. The program is open only to State agencies (50 States and the District of Columbia). The responses are required only when the State agencies are applying for one of the HUTE grants. The applications would be submitted as needed, but no more than once each award cycle (yearly). The applications require several documents that will collect demographic, agency, and budget information, but also must include a detailed project narrative describing the issue(s) to be addressed, and a tentative work plan to address the issue(s). Once submitted through grants.gov, the information would be downloaded by the HUTE program office in the FHWA Office of Highway Policy Information, and analyzed by a panel of subject matter experts who will make recommendations on what projects should be funded. The recommendations are then reviewed by a Senior Review Team and reviewed by several other offices at FHWA. The final approval is made after a review by the Office of the Secretary of Transportation.

Abstract

DHS uses Form I-134A to determine whether a U.S.-based individual has sufficient financial resources and access to those funds to support the beneficiary for the duration of their temporary stay in the United States. Form I-134A is used by a U.S. based individual (the supporter) to request to be considered as a supporter and to agree to provide financial support to the beneficiary named on the form during the beneficiary’s period of stay in the United States. Form I-134A is filed online and is only available for use by specific parole processes. This information collection supports the action being taken by the Secretary of Homeland Security to expand the ability for certain U.S.-based individuals to request to be considered to be a supporter of a beneficiary seeking to be paroled into the United States. Biographic information about the beneficiary provided on Form I-134A will be used for biographic security screening and advance travel authorization from DHS (OMB Control Number 1651-0143) for eligible nationals. Prior to the transmission of this biographic information from USCIS to U.S. Customs and Border Protection (CBP) for this purpose, the beneficiary will be requested to confirm electronically the accuracy of the biographic information provided on their behalf by the respondent.Emergency Justfication:In this emergency request, USCIS is amending the Form I-134A for potential supporters and co-supporters under the U4U process and the Processes for Cubans, Haitians, Nicaraguans, and Venezuelans to include (1) a requirement to submit biometrics, if necessary, (2) notice of the $30.00 biometric services fee, (3) notice of a requirement for potential co-supporters to complete a Form I-134A, and (4) notice of a requirement for potential supporters to submit a copy of a government-issued photo identity document for themselves and a copy of the beneficiary’s passport biographic data page. USCIS has also made updates to identification elements for organizations by requesting information about the organization’s name, phone number, email address, taxpayer identification number, finances, and confirmation of the organization’s support of the beneficiary. SCIS has monitored trends and will now require submission of biometrics, if necessary, and payment of the biometric services fee from potential supporters, which will be used for additional vetting of potential supporters to provide greater safeguards for beneficiaries. Emergency processing is justified under 5 CFR 1320.13(a)(2)(i) to minimize a possible surge of Cubans, Haitians, Nicaraguans, and Venezuelans at the southwest land border and ensure adequate support of U4U beneficiaries.

This is a request for OMB to approve the revised information collection Stakeholder Measures and Advocate Forms at NCI for an additional three years. This revision adds one new survey form. The Office of Advocacy Relations (OAR) disseminates cancer-related information to various stakeholders, seeks input and feedback, and facilitates collaboration to advance NCI’s authorized programs. It is beneficial for NCI, through the OAR, to recruit and manage research advocates, which includes collecting demographic information and areas of experience, skill, and interest. Since OAR is responsible for matching advocates to NCI programs and initiatives across the cancer continuum, it is also necessary to measure the satisfaction of both internal and external stakeholders with this collaboration.
