What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

The CMS-370 Health Insurance Benefits Agreement is utilized for the purpose of establishing eligibility for payment under Title XVIII of the Social Security Act. No edits were made to this agreement form. The CMS-377 ASC Request for Certification or Update of Certification Information in the Medicare Program form is utilized to collect facility-specific characteristics that facilitate CMS’ oversight of ASCs, for example, through the ability to track and trend survey results broken down by various facility characteristics. The data also enables CMS to respond to inquiries from the Congress, GAO, OIG concerning the characteristics of Medicare-participating ASCs. This form is submitted by ASCs when they request initial certification of compliance with the ASC CfCs or to update an ASC’s existing certification information. Minor edits to form were made for clarification of data being requested.

Abstract

This new information collection request is to request the Office of Management and Budget’s (OMB) approval of a new information collection titled, FMCSA Registration System. FMCSA is replacing its Unified Registration System, with a new, online registration system, which will be named the “FMCSA Registration System” (FRS). The new system will allow all persons required to register under the Agency’s commercial or safety jurisdiction to do so online. While the online registration system is voluntary, entities are still required to register with FMCSA either through this system or through mailing the paper forms associated with this collection. Motor carriers may conduct transportation services in the United States only if they are registered with FMCSA. FMCSA requests information to identify the applicant, the nature and scope of its proposed operations, safety-related details, and information regarding the drivers and vehicles it plans to use in U.S. operations. FMCSA and the States use registration information collected to track motor carriers, freight forwarders, brokers, and other entities they regulate. Registering motor carriers is essential to being able to identify carriers so that their safety performance can be tracked and evaluated. The data make it possible to link individual trucks to the responsible motor carrier, thus implementing the mandate under 49 U.S.C. 31136(a)(1); that is, ensuring that commercial motor vehicles (CMVs) are maintained and operated safely. In general, registration information collected informs prioritization of the Agency’s activities and aids in assessing and statistically analyzing the safety outcomes of those activities. There are six ICs as follows: IC #1 - Unified Registration System, FMCSA Registration Updates (PRIOR Form MCSA-1); IC #2 - Licensing Applications for Motor Carrier Operating Authority (PRIOR Forms OP-1, OP-1(P), OP-1(FF), OP-1(MX), and OP-1(NNA)); IC #3 - Motor Carrier Identification Report (PRIOR Forms MCS-150, MCS-150B, and MCS-150C); IC #4 - Motor Carrier Records Change Form (PRIOR Form MCSA-5889); IC #5 - Request for Revocation of Authority Granted (PRIOR Form OCE-46); and IC #6 - Designation of Agents, Motor Carriers, Brokers, and Freight Forwarders (PRIOR Form BOC-3). It is expected that FMCSA will eliminate collections and associated forms, as users will instead use the FRS to collect the information previously submitted. Under FRS, these forms will be integrated into the online system through a series of questions that will be asked, using smart logic where the system will ask only the questions that relate to the applicant or registrant, based on the answers they provided to the previous question. Until FMCSA completes a regulatory change to remove reference to the original forms from regulation, registrants may continue to use the original forms to request the appropriate registration action.

Abstract

The Secretary has broad authority under Title 38 United States Code, section 501, to protect Veterans and their family members from fraud and enforce compliance with federal laws and regulations. The Department is an active participant in the cross-government Veteran Scam and Fraud Evasion (VSAFE) campaign and Task Force, and this information collection supports the goal of “no wrong door” for the reporting and resolution of potential fraudulent issues. An individual can file a complaint or comment with the office by sending a letter using regular mail, telephoning, emailing, or, in the future, by filing a web-based complaint. Information is gathered only from the individual submissions and may be submitted anonymously. The new VA Form 10-390 can be used by individuals to capture information for a fraud, waste or abuse complaint. The form may be submitted anonymously, and there is no requirement to complete all fields. Once received by Department staff, complaints are entered into the Compliance Inquiry Reporting & Tracking System (CIRTS), (System of Record Notice: 110VA17 “Compliance Record, Response, and Resolution of Reports of Persons Allegedly Involved in Compliance Violations—VA)” and assigned to appropriate Department offices. Complaints can be reassigned to appropriate program offices with VHA or routed to VBA. In appropriate instances, the office investigates the complaint and may refer to law enforcement.

Southeast Region Vessel Monitoring System (VMS) and Related Requirements

Abstract

The NMFS, Office of Law Enforcement, Southeast Enforcement Division is submitting this request for a revision and an extension of a currently approved information collection. Pursuant to proposed rule 0648-BM98, the changes proposed to this collection are the elimination of the current paper-based “Vessel Monitoring System Mobile Transceiver Unit (MTU) Power-Down Exemption Request for Vessels in the Gulf of Mexico Reef Fish Fishery” to be replaced with an online form submission. The online form also includes the addition of two data elements; the email address of the submitter, and an option for the submitter to identify themselves as the “permit holder” or “vessel operator.” Additionally, the change proposes to eliminate the current requirement for vessel owners to submit the Vessel Monitoring System (VMS) Installation and Activation Certification for the Reef Fish Fishery of the Gulf of Mexico form. The Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) authorizes the Gulf of Mexico Fishery Management Council (Gulf Council) and South Atlantic Fishery Management Council (South Atlantic Council) to prepare and amend fishery management plans (FMP) for any fishery in Federal waters under their respective jurisdictions. NMFS and the Gulf Council manage the reef fish fishery in the Gulf of Mexico (Gulf) under the FMP for the Reef Fish Resources of the Gulf of Mexico (Reef Fish FMP). NMFS and the South Atlantic Council manage the fishery for rock shrimp in the South Atlantic under the FMP for the Shrimp Fishery in the South Atlantic Region (Shrimp FMP). The FMPs and the implementing regulations contain several specific management areas where fishing is restricted; enforcement for which is most effectively conducted using VMS technology. The information collected on the soon-to-be-eliminated ‘‘Vessel Monitoring System Installation and Activation Certification for the Reef Fish Fishery of the Gulf of Mexico’’ form provides NMFS assurance that vessels are compliant with the requirements to install and activate an approved VMS unit. The requirement for vessel owners to install a VMS unit properly will remain in regulation, but there is little utility to requiring vessel owners to submit a form attesting to their compliance. Accordingly, we no longer seek to require that documentation. Information collected on the current ‘‘Vessel Monitoring System Mobile Transceiver Unit (MTU) Power-Down Exemption Request for Vessels in the Gulf of Mexico Reef Fish Fishery’’ form and online “Power Down Exemption Request form” provide information that allows NMFS to exempt a vessel from the VMS reporting requirement under specific criteria. Information collected in fishing activity declarations is used to identify fishing activities, necessary for law enforcement operational planning, so law enforcement will know in real time, with what fishing activities the vessels are engaged.

Abstract

Section 126 of the Consolidated Appropriations Act (CAA), 2020 (Public Law 116-93), enacted December 20, 2020, included a key provision affecting Medicare payments for Graduate Medical Education (GME). Section 126(a) of the CAA amended section 1886(h) of the Act by adding a new section 1886(h)(9) requiring the distribution of additional residency positions (slots) to qualifying hospitals. Section 1886(h)(9)(A) of the law makes an additional 1,000 Medicare funded residency slots available. Section 1886(h)(9)(B) requires that at least 10 percent of the aggregate number of slots be distributed to hospitals in four categories: (1) hospitals in rural areas (or treated as being located in a rural area under the law), (2) hospitals currently operating over their GME cap, (3) hospitals in states with new medical schools or additional locations, and (4) hospitals that serve areas designated as health professional shortage areas. Additionally, section 1886(h)(9)(C) places certain limitations on the distribution of the residency positions. Eligible teaching hospitals submit applications under this collection for the available slots and CMS staff reviews the applications and supporting documents to determine the validity of the hospitals’ requests for Medicare funded residency slots requested in accordance with Section 126 of the Consolidated Appropriations Act, 2020 (Public Law 116-93) prior to awarding the slots.

Quality Measures and Administrative Procedures for the Hospital-Acquired Condition Reduction Program (CMS-10668)

Abstract

The Hospital-Acquired Condition (HAC) Reduction Program is established by section 1886(p) of the Social Security Act, as added by Section 3008 of the Affordable Care Act (Pub. L. 111-148), and requires the Secretary to reduce payments to subsection (d) hospitals in the worst-performing quartile of all subsection (d) hospitals by 1 percent effective beginning on October 1, 2014 and subsequent years. In the FY 2025 IPPS/LTCH PPS final rule, we are not adopting or removing any measures for the FY 2025 program year or subsequent years. For the FY 2025 program year and subsequent years, we are accounting for the burden associated with submission of the Measure Exception Form for NHSN HAI Data Submission under this OMB control number (0938-1352) instead of OMB control number 0938-1022.

License Requirements for Operation of a Launch Site

Key Information

Abstract

This information collection is mandatory for privatized space launch facilities or entities wishing to become a privatized space launch facility. This information collection requirement is intended to enable FAA/AST to incorporate acquired data into the license, which subsequently becomes binding on the site operator. FAA/AST issues a site operator license based on the site operator’s demonstration of the ability to ensure public safety and the safety of property, both on and off the site. Under the policy review and approval process, an applicant is required to submit information identifying foreign ownership of the launch site or reentry site enterprise. FAA/AST determines, before issuing a license, if issuance of such a license would jeopardize the foreign policy or national security interest of the United States. The Launch Site Location Review and Approval provision requires the applicant to conduct an analysis that objectively determines whether the location of a proposed launch or reentry site can support the launch or reentry of a suborbital launch vehicle or, at a minimum, one class of orbital launch vehicle on at least one trajectory. Finally, the applicant is required to submit an explosive site plan, which complies with established levels of risk calculations to acceptable exposure to destructive forces. In accordance with the requirements of the National Environmental Policies Act, 42 U.S.C. § 4321, et. seq., (NEPA), the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA, 40 CFR Parts 1500-1508, and the DOT’s Procedures for Considering Environmental Impacts, DOT Order 5610.1C, applicants are required to submit environmental information concerning proposed new launch sites and launch vehicles that are not currently described in the environmental impact statements, as well as payloads that may have significant environmental impacts in the event of a launch or reentry accident. .

Reporting Requirements covered under this IC include: • For initial certification, completing FAA Form 8310-3, Application for Repair Station Certificate and/or Rating, to request issuance of an initial air agency certificate, along with any required application attachments, and submitting to the FAA for review. • On occasion, completing and FAA Form 8310-3, Application for Repair Station Certificate and/or Rating, to request a certificate amendment, ratings change, change of location, name change, ownership change, etc. Any required application attachments must also be updated and submitted to the FAA for review. • Other reporting requirements occur occasionally after certification, for example, when the certificate holder’s operations change. • If a repair station is located outside of the US., it must apply for renew its air agency certificate every 2 years. • All repair stations must develop initially, and as needed after certification keep current, a Repair Station Manual (RSM) and Quality Control Manual (QCM). The repair station must notify the FAA of any revisions to these manuals. Additionally, all repair stations must develop a Training Program and submit any revisions of the program to the FAA. • Repair Stations that are Hazmat Employers under 49 CFR 171.8 must have a hazardous materials training program. • Repair Stations that perform work for air carriers must acknowledge receipt of the part 121 or part 135 operator notification required under §§ 121.1005(e) and 135.505(e). • Repair stations that choose to use repairmen must certify that each person recommended for certification as a repairman is employed by the repair station and meets the eligibility requirements of § 65.101. • A repair station with a limited rating may choose to maintain a capability list and provide the FAA with a copy of the revised list. Recordkeeping Requirements covered under this IC include: • Each repair station must retain records that demonstrate compliance with the requirements of part 43. • Each repair station must document the individual employee training required by the repair station training program approved by the FAA. The respondents to this collection are current part 145 certificated Repair Stations and applicants for a part 145 air agency certificate. Responding to the collection is required to obtain and/or retain a benefit.   The information collected is provided or made available to each certificate holder/applicant’s responsible FSDO. Additionally, A certificated repair station must make all required records available for inspection by the FAA and the National Transportation Safety Board (NTSB). The FAA uses FAA Form 8310-3, Application for Repair Station Certificate and/or Rating, to collect information on repair station applicants, amendments to a repair station certificate holder’s air agency certificate, and renewal requests for repair station certificate holders located outside of the United States. FAA Form 8310-3 collects the official name of the repair station, location where business is conducted, official mailing address, any additional business names (i.e., dba, doing business as), changes in ratings (or ratings sought if submitted by an applicant), changes in location or housing and facilities, change in name or ownership, or any other purpose for which the certificate holder or applicant requests, requests for approval/changes to contract maintenance functions to outside entities. Other information described in this IC is provided to the FAA in the form of manuals, lists, or other documentation containing the information requested.

EJ Grantmaking Program: Applications for Subawards September Launch (Emergency)

Abstract

To meet the goals and objectives that demonstrate the U.S. Environmental Protection Agency (EPAs) and the Administrations commitment to achieving environmental justice and embedding environmental justice into Agency programs, EPA released the Thriving Communities Grantmaking Program funding opportunity. The program will provide about $600 million in 11 cooperative agreements funding to Grantmakers who will function as pass-through entities for the Environmental Justice Thriving Communities Subgrants (2 CFR Parts 200 and 1500). The pass-through model removes the requirement of applying through the federal grants process and decreases the amount of time it takes to award federal funds. The Grantmakers will collaborate with EPA to design and build their own processes to receive and evaluate applications to fund the initial development of community-led environmental justice projects. With this Information Collection Request (ICR), EPA seeks emergency clearance for three Grantmakers to solicit applications for their first round of subgrants to be launched in September 2024. If the information requested under this emergency clearance were not collected, EPA would have no mechanism for selecting and distributing subaward grants. Without this activity, the central programmatic objectives of the Environmental Justice Thriving Communities Grantmaking Program cannot be met. The six-month emergency clearance period will cover the first round of subaward applications that will be solicited by three Grantmakers in September 2024. Subsequent rounds of applications for these three Grantmakers will be authorized via a Standard ICR package for the Grantmaking Program that will be submitted for review via the standard ICR approval process.Emergency Justfication:EPA is requesting Emergency clearance for Grantmakers to launch their subaward programs and publish a call for the first round of applications, because it is essential that this initial work take place as early as possible in the award period. Under this program, Philanthropy Northwest and the other Grantmakers need to engage in multiple subaward processes, not just one, before the end of the 3-year performance period. This is because the small and capacity-constrained entities that will apply for these awards will typically be first-time grantees who cannot absorb funds quickly, because they need time and technical assistance, etc. The process has to be slow and steady, rather than a single plug of funding. These sub-awardees are organizations that likely have never received a federal grant before. Therefore, we need to do at least 2, preferably 3, subaward processes. EPAs experience with the Environmental Justice Community Change Grant Programs technical assistance is that most communities need a tremendous amount of time and support to develop project ideas and budgets.

Abstract

BOEM intends to conduct a research study of outdoor recreation and tourism in the Cook Inlet OCS Planning Area and adjacent coastal areas (i.e., the study area). BOEM seeks updated baseline information on the nature, distribution, and seasonality of outdoor recreation and tourism in the study area, and the relative preferences and values for these activities. BOEM would use this data for environmental assessments and decision making for federal permitting actions that could affect the human environment. Information from this research would help the bureau describe the affected environment and analyze and monitor potential impacts to recreation and tourism activities, experiences, and associated revenues from its future permitting activities (i.e., oil and gas) in the study area. This study would help BOEM identify any appropriate mitigation strategies to address potential effects of its activities on recreation and tourism in the study area.
