What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This ICR renewal is for the mandatory reporting of foreign motor carriers to report information to FMCSA on an annual basis using the OP-2 form in order to operate in the United States. This collection of information is used by the FMCSA to register foreign motor carriers to operate across the Mexico- U.S. border into the United States in accordance with 49 U.S.C. 13902(c) and 49 CFR 368. Data contained on the Form OP-2 will provide the FMCSA with evidence to assess the foreign (Mexico-based) motor carrier’s safety program and its ability to comply with U.S. safety standards. It also provides information concerning changes in each carrier’s operating status to ensure actual compliance with safety requirements. This enables the Agency to maintain an accurate census of registered carriers and ensure safety. There is an increase in the number of respondents and in the burden hours calculated for this renewal. The annual burden hour increase of 831 is due primarily to the increase in the number of updated OP-2 forms filed from 2020 through 2022. The average number of entities which filed updated OP-2 forms in the three-year period 2020 and 2022 increased by 95 percent, compared to the number that registered from 2017 through 2019.

Abstract

Docket No. RD22-5. Delegated order was published on November 23, 2022. The Facility Design, Connections, and Maintenance Reliability Standards address topics such as facility interconnection requirements, facility ratings, system operating limits, and transfer capabilities. Reliability Standard FAC-001-003 required Transmission Owners and applicable Generator Owners to complete coordinated studies for new or “materially modified” existing interconnections. Reliability Standard FAC-001-4 clarifies that requirement by applying it to “qualified changes” instead of “materially modified” interconnections. This clarification is intended to prevent confusion with the Commission-defined term “Material Modification” in the pro forma interconnection procedures and agreements. The Commission estimates no burden effects for this clarification. The delegated order also revises Requirement R6 of previously approved Reliability Standard FAC-002-3 by requiring planning coordinators to define the term “qualified change” and requiring public posting of the definition. This new information collection activity represents a minor additional burden to planning coordinators, who must develop the definition of “qualified change” for new and existing interconnections of generation, transmission, or electricity end user facilities. This burden is expected to be greater in years one and two than in year three and beyond for this new information collection activity. The implementation of Reliability Standards FAC-001-4 and FAC-002-4 will ensure that there is appropriate coordination and communication regarding the interconnection of facilities.

Disposal of Coal Combustion Residuals from Electric Utilities (Final Rule)

Key Information

Abstract

Coal combustion residuals (CCR) are generated from the combustion of coal, including solid fuels classified as anthracite, bituminous, subbituminous, and lignite, for the purpose of generating steam for the purpose of powering a generator to produce electricity or electricity and other thermal energy by electric utilities and independent power producers. CCR includes fly ash, bottom ash, boiler slag, and flue gas desulfurization materials. CCR are solid wastes that are neither listed nor characteristic hazardous waste and thus, are subject to the requirements of Subtitle D of the Resource Conservation and Recovery Act, as amended (RCRA). RCRA Subtitle D establishes a framework for federal, state, and local government cooperation in controlling the management of non-hazardous solid waste. The federal role in this management structure is to establish the overall regulatory direction, by providing minimum national standards that will protect human health and the environment, and to provide technical assistance to states for planning and developing their own environmentally sound waste management practices. The actual planning and any direct implementation of solid waste programs under RCRA Subtitle D, however, remains a state and local function, and RCRA envisions that states will devise programs to deal with state-specific conditions and needs. 40 CFR Part 257 contains provisions regarding the management of CCR under RCRA Subtitle D. In 2015, EPA published a final rule to regulate the disposal of CCR from electric utilities as solid waste under RCRA Subtitle D (see 80 FR 21302; April 17, 2015). In the final rule, EPA established national minimum criteria for existing and new CCR landfills and CCR surface impoundments and all lateral expansions to include location restrictions, design and operating criteria, groundwater monitoring and corrective action, closure requirements and post-closure care, and recordkeeping, notification, and internet posting requirements. The 2015 rule requires any existing unlined CCR surface impoundment that is contaminating groundwater above a regulated constituents groundwater protection standard to stop receiving CCR and either retrofit or close, except in limited circumstances. The rule also requires the closure of any CCR landfill or CCR surface impoundment that cannot meet the applicable performance criteria for location restrictions or structural integrity established in this rule. CCR surface impoundments that are no longer receiving CCR as of the effective date of the rule, but still contain water and CCR, will be subject to all applicable regulatory requirements, unless the owner or operator of the facility closes the inactive unit (e.g., the impoundment is closed with a final cover system) no later than three years from the effective date of the rule.

Abstract

Section 6002 of the Affordable Care Act added section 1128G to the Social Security Act (Act), which requires applicable manufacturers and applicable group purchasing organizations (GPOs) of covered drugs, devices, biologicals, or medical supplies to report annually to CMS certain payments or other transfers of value to physicians and teaching hospitals, as well as, certain information regarding the ownership or investment interests held by physicians or the immediate family members of physicians in such entities. Specifically, applicable manufacturers of covered drugs, devices, biologicals, and medical supplies are required to submit on an annual basis the information required in section 1128G(a)(1) of the Act about certain payments or other transfers of value made to physicians and teaching hospitals (collectively called covered recipients) during the course of the preceding calendar year. Similarly, section 1128G(a)(2) of the Act requires applicable manufacturers and applicable GPOs to disclose any ownership or investment interests in such entities held by physicians or their immediate family members, as well as information on any payments or other transfers of value provided to such physician owners or investors. Applicable manufacturers must report the required payment and other transfer of value information annually to CMS in an electronic format. The statute also provides that applicable manufacturers and applicable GPOs must report annually to CMS the required information about physician ownership and investment interests, including information on any payments or other transfers of value provided to physician owners or investors, in an electronic format by the same date. Abstract

EPA is proposing revisions to the Resource and Recovery Act (RCRA) regulations to clarify existing requirements for owners/operators of OB/OD units, including how and when to apply and implement the requirements in the permitting process. Specifically, EPA is proposing to create new Subparts for OB/OD units in Parts 264 (applicable to permitted facilities) and 265 (applicable to interim status facilities). The new Subparts would contain requirements that apply to all owners and operators conducting or seeking to conduct OB/OD of waste explosives, including activities conducted as part of RCRA corrective action. EPA is further proposing requirements for OB/OD used in non-time sensitive emergencies. The new provisions would specify how and when owners and operators and permit authorities are to evaluate alternative treatment technologies for OB/OD, including specific information that would be required for facilities to demonstrate whether safe alternative modes of treatment are available for specific waste streams. EPA is proposing an exemption from the requirement to conduct comprehensive alternative technology evaluations for de minimis quantities of waste explosives that were generated on site. This rule also proposes new and revised regulatory provisions on timelines for implementing alternative technologies, permitting for alternative technologies, waste analysis/characterization, wastes prohibited/restricted from OB/OD, technical standards for OB/OD units, delay of closure applicability to OB/OD units, clarifications to emergency provisions at §§ 270.61 and 264.1(g)/270.1(c)(3), and procedures for permitting mobile treatment units (MTUs). The overall reporting and recordkeeping requirements for OB/OD facilities are reported in separate ICRs, including OMB Control No. 2050-0050 (EPA ICR No. 1572.13) and OMB Control No. 2050-0009 (EPA ICR No. 1573.16). This ICR (EPA ICR No. 2769.01) will be rolled into the consolidated RCRA ICRs in the next renewal cycle.

Abstract

FinCEN promulgated regulations regarding access by authorized recipients to beneficial ownership information (BOI) that will be reported to FinCEN pursuant to section 6403 of the Corporate Transparency Act (CTA), enacted into law as part of the Anti-Money Laundering Act of 2020 (AML Act), which is itself part of the National Defense Authorization Act for Fiscal Year 2021 (NDAA). These regulations are titled "Beneficial Ownership Information Access and Safeguards final rule" (the “BOI Access Rule”). The BOI Access Rule implements the strict protocols required by the CTA to protect sensitive personally identifiable information (PII) reported to FinCEN and establish the circumstances in which specified recipients have access to BOI, along with data protection protocols and oversight mechanisms applicable to each recipient category. The disclosure of BOI to authorized recipients in accordance with appropriate protocols and oversight will help law enforcement and national security agencies prevent and combat money laundering, terrorist financing, tax fraud, and other illicit activity, as well as protect national security. This information collection request is being submitted to incorporate the forms to collect information as required by the BOI Access Rule.

Abstract

The United States Department of Housing and Urban Development (HUD) collects and maintains personally identifiable information on tenants in public and assisted housing, the confidentiality of which is protected by the Privacy Act of 1974 (5 U.S.C. 552a). On occasion, HUD shares this information with researchers subject to stringent requirements to protect these households from unauthorized disclosure of information. The purpose for sharing is to further policy-relevant research on the effectiveness of HUD programs. HUD may, under the terms of the Routine Uses published in its various System of Records Notices, share these data with researchers whom HUD has awarded contracts, grants, service agreements, or other agreements. HUD has shared data with contractors and grantees and will continue to share data under service agreements because it has a legal form for effectuating such an agreement. HUD does not limit access to the information to parties that have received specific funding to carry out a study through a grant or contract. Instead, HUD also shares the data with legitimate research organizations that have conceived policy-relevant analyses and that are able and willing to protect the data from unauthorized disclosure. The legal form for the service agreement is herein called a “license.” HUD will continue making the data available for statistical, research, or evaluation purposes to organizations qualified and capable of research and analysis consistent with the statistical, research, or evaluation purposes for which the data were provided or are maintained, but only if the data are used and protected in accordance with the terms and condition stated in the license, upon receipt of such assurance of qualification and capability, and it is agreed by the organization requesting such information and HUD. All data containing personally identifiable information maintained by HUD that are provided the Licensee and all information derived from that data, and all data resulting from mergers, matches, or other uses of the data provided by HUD with other data are subject to the License and are referred to in this License as subject data. Subject data under this License may be in the form of CD-ROMs, electronic data, hard copy, etc. The Licensee may only use the subject data in a manner and to purpose consistent with the statistical, research, or evaluation purpose for which the data are maintained. All subject data that include personally identifiable information are protected under the Privacy Act and may be used only for statistical, research, or evaluation purposes consistent with the purposes for which the data was collected and or is maintained. This ICR includes four requirements that may result in burden on the public: • Application for Data License- Interested parties must complete and submit a Data License Application for HUD review and consideration. • Data License Agreement- Approved applicants will be required to complete a Data License Agreement. • Affidavit of Nondisclosure- All researchers associated with an approved applicant who will be granted access to data must complete an Affidavit of Nondisclosure. • Data Destruction Certification Form- At the conclusion of each project, the research institution must attest to the destruction of all personally identifiable information received from HUD under the data license agreement. The authority to collect information is in Sections 501 and 502 of the Housing and Urban Development Act of 1970 (Public Law 91-609) (12 U.S.C. §§ 1701z-1; 1701z-2(d) and (g)) and Routine Use Inventory (77 FR 17361). The relevant section of HUD’s statutory authority is included as part of this ICR.

The Stem Cell Therapeutic Outcomes Database was established under contract by HRSA to establish and maintain information related to patients who have received stem cell therapeutic products using a standardized, electronic format. Data is collected from transplant centers by the Center for International Blood and Marrow Transplant Research and is used for ongoing analysis of transplant outcomes. HRSA uses the information to carry out its statutory responsibilities. Information is needed to monitor the clinical status of transplantation and to provide the Secretary of HHS with an annual report of transplant center-specific survival data.

This data collection complements the satisfaction data collected through the Medicare CAHPS Survey by providing dissatisfaction data in the form of reasons for disenrollment from PDPs and MA-PDs.

Abstract

The U.S. Department of Health and Human Services (HHS)’ Office for Human Research Protections (OHRP) is requesting reinstatement of OMB No. 0990-0477, the OHRP Incident Report Form, with changes, for a three-year period. Reinstatement will be necessary because the current collection is approved by OMB through May 31, 2024, and a request for OMB to extend its approval has gone beyond the required time span for submission to OMB prior to that expiration date. This reinstatement information collection request includes two new information elements on the Incident Report form: IORG # for Reviewing IRB; and, Revising research policies and procedures as a corrective action plan category, if it applies. The inclusion of these data elements did not affect the burden estimate. The purpose of the Incident Report form is to facilitate organizations’ or institutions’ prompt reporting of specific human subject protection incidents to OHRP in a simplified standardized format. Respondents for this information collection are organizations and institutions conducting or reviewing HHS conducted or supported human subjects research in compliance with the HHS Federal Policy for the Protection of Human Subjects (the Common Rule), which is codified for HHS at 45 CFR part 46, subpart A.
