Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

DOE created the American Assured Fuel Supply (AAFS), a reserve of low-enriched uranium (LEU), to serve as a backup supply of LEU available to foreign end-users to be supplied through U.S. persons, or to domestic recipients, in the event of a supply disruption in the nuclear fuel market. This reserve of LEU as a backup supply supports DOE’s nuclear nonproliferation and civil nuclear energy objectives.

Outcome and Assessment Information Set (OASIS-E1) (CMS-10545)

Abstract

This request is for OMB PRA approval of a version update of the Outcome and Assessment Information Set (OASIS). The updated version of the OASIS item set is titled OASIS –E1. OASIS is a core standard assessment data set that Home Health Agencies (HHAs) integrate into their own patient-specific, comprehensive assessment to identify each patient’s need for home care that meets the patient’s medical, nursing, rehabilitative, social, and discharge planning needs. Since 1999, the Medicare Conditions of Participation (CoPs) have mandated that HHAs use the OASIS data set when evaluating adult, non-maternity patients receiving skilled services. OASIS data are used for both home health quality measurement and payment adjustment. OASIS-E1 is scheduled for implementation on January 1, 2025, to comply with changes noted in the CY2024 HH Final Rule. The changes for OASIS-E1 include addition of one new item: O0350. COVID-19 Vaccine, and removal of two items: M0110. Episode Timing andM2200 Therapy Need due to no longer being used in the HH QRP or for other purposes in CMS programs. Also, Discharge Goals, Column 2 in GG0130 Self-Care and Column 2 in GG0170 Mobility are removed, with their associated instructions due to retiring the quality measure: Application of Percent of Long-Term Care Hospital Patients with an Admission & Discharge Functional Assessment and a Care Plan that Addresses Function Discharge. Instructions for Part C of item D0150. Patient Mood Interview PHQ-2 to 9 are revised to clarify directions for completing the interview.

Abstract

Reporting and Use of Information Concerning Integrity and Performance of Recipients of Grants and Cooperative Agreements

Abstract

The Duncan Hunter National Defense Authorization Act of 2009 (Public Law 110-417) was enacted on October 14, 2008. Section 872 of this Act required the development and maintenance of an information system that contains specific information on the integrity and performance of covered federal agency contractors and grantees. The Federal Awardee Performance and Integrity Information System (FAPIIS) was developed to address these requirements and has been superseded by the System for Award Management (SAM) at SAM.gov. SAM provides users access to integrity information from the FAPIIS reporting module in the Contractor Performance Assessment Reporting System (CPARS), proceedings information from the Entity Management section of the SAM database, and suspension/debarment information from the Exclusions section of SAM. As required by 2 CFR Part 200 Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, effective January 1, 2016, Federal agencies are required to review and consider any information about the applicant that is in SAM before making any award in excess of the simplified acquisition threshold, defined in 41 U.S.C. 134, over the period of performance. Non-Federal entities (NFEs) are required to disclose any information about criminal, civil, and administrative proceedings, and/or affirm that there is no new information to provide. This applies to NFEs that receive Federal awards (currently active grants, cooperative agreements, and procurement contracts), as required by 45 CFR Part 75, Appendix XII, of the Uniform Guidance, for any period of time during the period of performance of an award/project.

Based on the statutory authority in Title XVIII of the Social Security Act; The statutory provisions originated with Section 299I of Public Law 92-603 which created the National End Stage Renal Disease (ESRD) Program that extended Medicare benefits to cover the high cost of medical care for most individuals living from ESRD. The statutory mission of the Program, as set forth in Section 1862(g) of the Act, involves the Secretary entering into contracts with ESRD Networks for purposes of improving cost-effectiveness, ensuring quality of care, encouraging kidney transplantation and home dialysis, and increasing program accountability. The Patient Protection and Affordable Care Act, Public Law 111-148, enacted on March 23, 2010, and the Health Care and Education Reconciliation Act, Public Law 111-152, enacted on March 30, 2010 (collectively, "Affordable Care Act"), expand access to health insurance for individuals and employees of small businesses through the establishment of new Affordable Insurance Exchanges (Exchanges), including the Small Business Health Options Program (SHOP). The Exchanges, which will become operational by January 1, 2014, will enhance competition in the health insurance market, expand access to affordable health insurance for millions of Americans, and provide consumers with a place to easily compare and shop for health insurance coverage. The reporting requirements and data collection in the Exchange rule address Federal requirements that States must meet with respect to the establishment and operation of an Exchange; minimum requirements that health insurance issuers must meet with respect to participation in a State based or Federally-facilitated Exchange; and requirements that employers must meet with respect to participation in the SHOP and compliance with other provisions of the Affordable Care Act. The submission seeks OMB approval of the regulatory PRA requirements associated with 45 CFR parts 155, 156, and 157.

Section 80.302 requires that when changes occur in the operation of a public coast station which include discontinuance, relocation, reduction or suspension of a watch required to be maintained on 2182 kHz or 156.800 MHz, notification must be made by the licensee to the nearest district office of the U.S. Coast Guard as soon as practicable and the notification must include the estimated or known resumption time of the watch.

Streamlined Clearance Process for Discretionary Grants

Abstract

Section 3505(a)(2) of the PRA of 1995 provides the OMB Director authority to approve the streamlined clearance process proposed in this information collection request. This information collection request was originally approved by OMB in January of 1997. This information collection streamlines the clearance process for all discretionary grant information collections which do not fit the generic application process. The streamlined clearance process continues to reduce the clearance time for the U.S. Department of Education's (ED's) discretionary grant information collections by two months or 60 days. This is desirable for two major reasons: it would allow ED to provide better customer service to grant applicants and help meet ED's goal for timely awards of discretionary grants. §3474.20(d) adds the requirement for grantees to develop a dissemination plan for copyrighted work under open licensing. Information contained in the narrative of an application will be captured in the Evidence of Effectiveness Form.

Abstract

In a Report and Order (FCC 99-9, released February 19, 1999) in WT Docket 97-153, the Commission, under section 90.651, adopted a revised time frame for reporting the number of mobile units placed in operation from eight months to 12 months of the grant date of their license. The radio facilities addressed in this subpart of the rules are allocated on and governed by regulations designed to award facilities on a need basis determined by the number of mobile units served by each base station. This is necessary to avoid frequency hoarding by applicants. This rule section requires licensees to report the number of mobile units served via FCC Form 601.
