What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Hazardous Materials Shipping Papers & Emergency Response Information

Abstract

This is to request approval from the Office of Management and Budget (OMB) for a revision of previously approved information collection titled, “Hazardous Materials Shipping Papers and Emergency Response Information,” under OMB Control No. 2137-0034. This information collection is currently due to expire on November 30, 2026. This OMB Control Number covers hazardous materials shipping papers and emergency response information, which in accordance with the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180), are required to accompany each shipment of hazardous materials in commerce. On April 10, 2024, PHMSA published the HM-215Q final rule titled “Hazardous Materials: Harmonization With International Standards” [89 FR 25434]. This final rule revises § 173.185(c)(4) to require that shippers and carriers of small lithium batteries not contained in equipment have shipping papers and perform Notice of Pilot in Command (NOPIC) checks when transported by air.

Abstract

Section 107(a)(1) of the Rehabilitation Act of 1973 (Rehabilitation Act) requires the Commissioner of the Rehabilitation Services Administration (RSA) to conduct annual reviews and periodic on-site monitoring of the vocational rehabilitation (VR) program to determine whether a state agency is complying substantially with the provisions of its State Plan under Section 101 of the Rehabilitation Act and with the evaluation standards and performance indicators established under section 106 of the Rehabilitation Act subject to the performance accountability provisions described in Section 116(b) of the Workforce Innovation and Opportunity Act (WIOA). To fulfill its monitoring responsibility, RSA reviews a maximum of 15 VR agencies in each Federal fiscal year. When, based on its monitoring, RSA determines that a state agency has not administered and operated the VR program in compliance with its State Plan, the Rehabilitation Act, and implementing regulations at 34 C.F.R. Part 361, the agency must develop a corrective action plan (CAP), established by RSA in accordance with the requirement of section 107(b)(2) of the Rehabilitation Act, for RSA approval within 45 days from the issuance of the final monitoring report.

Approvals for Hazardous Materials

Abstract

The Pipeline and Hazardous Materials Safety Administration (PHMSA) has the primary responsibility for the issuance of Department of Transportation (DOT) Special Permits and Approvals under the Hazardous Materials Regulations (HMR; 49 CFR parts 171 180). An approval is a written authorization, including a competent authority approval, issued by the Associate Administrator, the Associate Administrator’s designee, or as otherwise prescribed in the HMR, to perform a function for which prior authorization by the Associate Administrator is required under subchapter C of this chapter (49 CFR parts 171-180). There are more than 100 approval provisions in the HMR and associated procedural regulations. Responses to this information collection are required to obtain benefits, including becoming an approval or certification agency, or obtaining a variance from packaging or handling requirements based on information provided by the respondent. These benefits and variances include, but are not limited to: United Nations (UN) third party certification; authorization to examine and test lighters; authorization to examine and test explosives; and authorization to re-qualify DOT cylinders. This information collection supports the Departmental Strategic Goal for Safety. Required collections are contained in Hazardous Materials Program Procedures, 49 CFR part 107 and parts 100-185. These regulations are promulgated in accordance with 49 U.S.C. 5110, the Federal hazardous materials transportation law. On April 8, 2024, PHMSA published a final rule titled “Hazardous Materials: Harmonization With International Standards” [HM-215Q, 89 FR 25434]. This final rule adds a new entries to the § 173.224 (Self Reactives Table) and § 173.225 (Organic Peroxide Table), which will decrease the number of annual approval applicants. Based on estimates provided in the Regulatory Impact Analysis (PRIA), PHMSA estimates that this proposal would reduce the number of approvals by one annually.

Medical Clearance Process for Deployment to the Polar Regions

Key Information

Abstract

The National Science Foundation requires all U.S. Antarctic participants and all participants deploying to Greenland and other select regions of the Arctic to take and pass a physical examination prior to deployment. NSF uses the information to determine the medical and dental health and psychological suitability of the polar participants; to determine whether accommodations exist to treat certain ailments and to provide on-site treatment, when needed, without doing harm. The respondents are all USAP participants; all Greenland participants in select regions of the Arctic that are under the auspices of USAP.

This is a request for extension of an information collection for rulemaking, special permits, and preemption requirements. The information collection is voluntary for regulated entities who wish to submit a petition for a rulemaking, special permit application, or preemption determination. The information collected in this OMB control number, include those persons who are requesting a change to the regulations, applying for the allowance to perform a function other than what is prescribed in the HMR, or seeking a preemption determination. The petition for rulemaking and preemption determination information collection are reporting requirements, while the special permit application process is both a reporting and recordkeeping requirement. The information is collected as needed. The information collected is used in PHMSA’s review process for determining the merits of petitions for rulemaking, special permit applications, and preemption determinations, and requires the submission of specific details on the reason for application. For a special permit, enforcement officials of the DOT will review the special permit at a reasonable time and location to ensure that the special permit holder is complying with the requirements outlined in the special permit authorization. The requested changes come from a final rule published on March 4, 2024, titled “Adoption of Miscellaneous Petitions and Updating Regulatory Requirements” [HM-219D; 89 FR 15636]. This final rule updates, clarifies, improves the safety of, or streamline various regulatory requirements. Specifically, this rulemaking responds to 18 petitions for rulemaking submitted by the regulated community between May 2018 and October 2020 that requests PHMSA address a variety of provisions, including but not limited to those addressing packaging, hazard communication, and the incorporation by reference of certain documents.

Abstract

This is a revision of a currently approved information collection Public Transportation Agency Safety Plan (PTASP) associated with a Final Rulemaking. The Final Rulemaking proposes new requirements for PTASP as a result of Section 30012 of the Bipartisan Infrastructure Law (BIL), enacted as the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 117-58 (Nov. 15, 2021). The Notice of Proposed Rulemaking (NPRM) was published on April 26, 2023. OIRA filed comment on the proposed rule on July 14, 2023. The respondents are public transportation systems that receive federal funds under FTA's Urbanized Area Formula Grants program. In order to received federal funding, they must develop and maintain an Agency Safety Plans (ASP) that include the processes and procedures to implement a Safety Management System (SMS). This ASP is the information that FTA collects. All of the respondents have an existing ASP and the proposed new requirements in the rulemaking merely need to be added to their existing plans. This supporting statement reflects a small increase in the respondent universe from 755 in the previous submittal to 758 as a result of three new transit agencies. More significantly, this updated supporting statement also reflects a change in the burden hours as a result of proposals and comments received during the NPRM stage from the respondent universe. Under the current collection, the estimated total annual burden hours is 252,855. Based on the burden requirements adopted from the comments and proposals during the NPRM phase, FTA estimates that burden hours would be increased by 299,990 hours, totaling 552,845 hours.

The National Health Service Corps (NHSC) Loan Repayment Programs

Key Information

Abstract

The National Health Service Corps (NHSC) Loan Repayment Program (LRP) was established to assure an adequate supply of trained primary care health professionals to provide services in the neediest Health Professional Shortage Areas (HPSAs) of the United States. The NHSC Substance Use Disorder (SUD) Workforce LRP and the Rural Community LRP were established to recruit and retain a health professional workforce with specific training and credentials to provide evidence-based SUD treatment in HPSAs. Under these programs, the Department of Health and Human Services agrees to repay the qualifying educational loans of selected primary care health professionals. In return, the health professionals agree to serve for a specified period of time in an NHSC-approved site located in a federally-designated HPSA approved by the Secretary for LRP participants. The forms utilized by each LRP include the following: the NHSC LRP Application, the Authorization for Disclosure of Loan Information form, the Privacy Act Release Authorization form, and if applicable, the Verification of Disadvantaged Background form and the Private Practice Option form. The first four of the aforementioned NHSC LRP forms collect information that is needed for selecting participants and repaying qualifying educational loans. The Private Practice Option Form, is needed to collect information for all participants who have applied for that service option. NHSC-approved sites are health care facilities that provide comprehensive outpatient, ambulatory, primary health care services to populations residing in HPSAs. Related in-patient services may be provided by NHSC-approved Critical Access Hospitals (CAHs) and Indian Health Service Hospitals. In order to become an NHSC-approved site, new sites must submit a Site Application for review and approval. Existing NHSC-approved sites are required to complete a Site Recertification Application in order to maintain their NHSC-approved status. Both the NHSC Site Application and Site Recertification Application request information on the clinical service site, sponsoring agency, recruitment contact, staffing levels, service users, charges for services, employment policies, and fiscal management capabilities. Assistance in completing these applications may be obtained through the appropriate State Primary Care Offices and the NHSC. The information collected on the applications is used for determining the eligibility of sites for the assignment of NHSC health professionals and to verify the need for NHSC clinicians. NHSC service site approval is valid for 3 years. Sites wishing to remain eligible for the assignment of NHSC providers must submit a Site Recertification Application every 3 years.

The William T. Pecora Award Application and Nomination Process

Abstract

The William T. Pecora Award is presented annually to individuals or groups that make outstanding contributions toward understanding the earth by means of remote sensing. The award is sponsored jointly by the Department of the Interior (DOI) and the National Aeronautics and Space Administration (NASA). In 1974 the Pecora award was established in honor of Dr. William T. Pecora, former Director of the U.S. Geological Survey, Under Secretary, Department of the Interior and a motivating force behind the establishment of a program for civil remote sensing of the earth from space. The purpose of the award is to recognize individuals or groups working in the field of remote sensing of the earth. National and international nominations are accepted from the public and private sector individuals, teams, organizations, and professional societies. Nomination packages include three sections: (A) Cover Sheet, (B) Summary Statement, and (C) Supplemental Materials. The cover sheet includes professional contact information. The Summary Statement is limited to two pages and describes the nominee's achievements in the scientific and technical remote sensing community, contributions leading to successful practical applications of remote sensing, and/or major breakthroughs in remote sensing science or technology. Nominations may include up to 10 pages of supplemental information such as resume, publications list, and/or letters of endorsement. The award consists of a citation and plaque, which are presented to the recipient at an appropriate public forum by the Secretary of the Interior and the NASA Administrator or their representatives. The name of the recipient is also inscribed on permanent plaques, which are displayed by the sponsoring agencies.

Abstract

The Presidential Policy Directive-17: Countering Improvised Explosive Devices (PPD-17) reaffirms the 2007 Strategy for Combating Terrorist Use of Explosives in the United States. It provides guidance to update and gives momentum to our ability to counter threats involving improvised explosive devices (IEDs). DHS was mandated to deliver standardized IED awareness and familiarization training for federal, state and local responders and public safety personnel. The Office for Bombing Prevention (OBP) must collect various information to effectively deliver this training. Additionally, OBP collects data to provide updated and awareness product information following conferences and other outreach events.

Abstract

We administer the SSI program, which provides monthly payments to: (1) adults and children with a disability or blindness; and (2) adults aged 65 or older. Eligible individuals must meet all the requirements in the Social Security Act (Act), including having resources and income below specified amounts. Since SSI is a needs-based program for those with limited income and resources, SSA must consider the amount of income an applicant or recipient has when determining whether that person is eligible to receive SSI payments. If the individual is eligible, their income is also a factor when SSA calculates the amount of their monthly SSI payments. Specifically, once SSA determines an individual is eligible for SSI, SSA determines the individual’s monthly payment amount by subtracting the individual’s countable monthly income from the Federal benefit rate (FBR), which is the monthly maximum Federal SSI payment. For the purposes of SSI, SSA defines “income” as anything that an individual receives in cash or in kind that the individual can use to meet their needs for food and shelter. We also define income as “earned,” such as wages from work, and “unearned,” such as gifted cash. We refer to this “unearned” income as in-kind support and maintenance (ISM). We have two rules for valuing the ISM that we must count: (1) currently, the one-third reduction rule (VTR) applies if the individual is living in the household of a person, throughout a month, who provides the individual with both food and shelter, and (2) the presumed maximum value rule (PMV) applies in all other situations in which the individual is receiving countable ISM. Our regulations clarify that that an individual is not receiving ISM in the form of room or rent if they are paying the required monthly rent charged under a “business arrangement.” We define a “business arrangement” as an arrangement which exists when the amount of monthly rent required to be paid equals the current monthly rental value (CMRV) – that is, the price of the rent on the open market in the individual’s locality. Court cases for residents living in specific jurisdictions within seven excepted States, changed the rules for rental subsidy showing that a “business arrangement” exists when the required monthly rent the SSI recipient is required to pay equals or exceeds the PMV. If the required monthly rent is less than the CMRV, we count the difference between the required monthly rent and the CMRV as ISM to the SSI applicant or recipient. We use the PMV rule to value this type of ISM. Under this final rule, we revised the definition of “business arrangement” based on the PMV rather than the CMRV across the nation, thus focusing on the SSI recipient’s purchasing power or the actual economic benefit they receive. This also ensures that all SSI applicants and recipients, regardless of where they reside, have the same policy applied to them regarding the definition of a business arrangement. This rule improves nationwide program uniformity, and we expect, will also improve equality in the application of the rental subsidy policy. Respondents are applicants for, or recipients of, Social Security disability benefits (SSDI); SSI payments; or their representatives.
