Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

This is a request for revision and extension for an approved information collection. This collection seeks approval for NOAA MDP to update instructions to reduce potential confusion from federally funded grantees on progress reporting. It also seeks approval for 3 additional reporting forms that will aid MDP grantees in recording and tracking detailed project accomplishments. The additional reporting mechanisms include a table with marine debris removal information broken down by state within the existing progress report structure, a spreadsheet for grantees to collect performance measure information across sites and subawards, and a spreadsheet for additional metrics related to large debris removal and habitat monitoring. This information is necessary for NOAA to effectively oversee the expenditure of public funds awarded through the program, to ensure both cost-effectiveness and programmatic goals are met. This collection also involves data collection for the NOAA Restoration Center (RC) and NOAA Coral Reef Conservation Program (CRCP), however this revision is only applicable to the NOAA Marine Debris Program (MDP). Previous CRCP and RC sections remain unchanged.

On December 11, 2023, the Commission adopted a Report and Order, FCC 23-112, to implement the Low Power Protection Act (LPPA or Act), which was enacted on January 5, 2023. The LPPA provides certain low power television (LPTV) stations with a limited window of opportunity to apply for primary spectrum use status as Class A television stations. The Report and Order establishes the period during which eligible stations may file applications for Class A status, eligibility and interference requirements, and the process for submitting applications. The Report and Order provides that applications to convert to Class A status under the Low Power Protection Act must be filed using FCC Form 2100, Schedule F. The application form requires certifications by the applicant as prescribed by the LPPA. This submission is being made to OMB for approval of the modified FCC Form 2100, Schedule F. In addition, LPTV stations that file an application to convert to Class A status must provide local public notice of the filing of the application pursuant to 47 CFR 73.3580(c). Specifically, the station must both broadcast on-air announcements and give online notice. This submission also reflects the burden associated with that information collection and is also being made to request Office of Management and Budget (OMB) approval of that collection.

Runaway and Homeless Youth Homeless Management Information System (RHY-HMIS)

Key Information

Abstract

The Runaway and Homeless Youth (RHY) program serves as the national leader for the provision of shelter and supportive services to youth experiencing homelessness. The RHY program administers grants to public and private organizations to establish and operate youth emergency shelters and transitional living programs. These grant recipients are located in all 50 states, the District of Columbia, and the U.S. territories. The Runaway and Homeless Youth Act (RHYA), as reauthorized by the Reconnecting Homeless Youth Act of 2008 (P.L.110-378 ) through FY 2013 and more recently reauthorized by the Juvenile Justice Reform Act through FY 2019, mandates that Runaway and Homeless Youth programs provide statistical records profiling the youth and family members whom it serves and also mandates that the Department of Health and Human Services (HHS) report regularly to Congress on the status of RHY-funded programs serving runaway and homeless youth. Further, these requirements include maintenance of client statistical records and submission of annual program reports regarding the characteristics of the youth and families served and the services provided to them. The October 2008 reauthorization of the Act and the reauthorization through FY 2019, maintained the longstanding requirements, as described in the legislation. This information collection request is for the Family and Youth Services Bureau (FYSB) to continue to collect the data standards to meet these legislative requirements. All RHY funded organizations are required to collect and submit their statistical information/data through a larger system of data standards housed by the Department of Housing and Urban Development’s (HUD) Homeless Management Information System (HMIS). FYSB’s data standards within that system are referred to as the Runaway and Homeless Youth Homeless Management Information System (RHY-HMIS). RHY grant recipients are required to enter their RHY-HMIS data through their local HUD’s Continuums of Care (CoC) HMIS. Quarterly to meet the legislative requirements, RHY grant recipients work with their HMIS Leads to extract their data for uploading to FYSB. See sections A3 and A4 for more information about the partnership with HUD and its HMIS.

Abstract

The Health Center Program, administered by HRSA, is authorized under section 330 of the Public Health Service (PHS) Act, most recently amended by section 50901(b) of the Bipartisan Budget Act of 2018, P.L. 115-123. Health centers are community-based and patient-directed organizations that deliver affordable, accessible, quality, and cost-effective primary health care services to patients regardless of their ability to pay. Nearly 1,400 health centers operate approximately 12,000 service delivery sites that provide primary health care to more than 28 million people in every U.S. state, the District of Columbia, Puerto Rico, the U.S. Virgin Islands, and the Pacific Basin. HRSA uses the Uniform Data System (UDS) for annual reporting by certain HRSA award recipients, including Health Center Program awardees (those funded under section 330 of the Public Health Service (PHS) Act), Health Center Program look-alikes, and Nurse Education, Practice, Quality and Retention (NEPQR) Program awardees (specifically those funded under the practice priority areas of section 831(b) of the PHS Act). These data help to identify trends over time, enabling HRSA to establish or expand targeted programs and to identify effective services and interventions that will improve the health of medically underserved communities.

Key Information

Abstract

The Securities and Exchange Commission ("Commission") is adopting new Rule 13h-1 and Form 13H under Section 13(h) of the Securities Exchange Act of 1934 ("Exchange Act") to establish large trader reporting requirements. The rule is intended to assist the Commission in identifying and obtaining certain baseline trading information about traders that conduct a substantial amount of trading activity, as measured by volume or market value, in the U.S. securities markets. In essence, a "large trader" will be defined as a person whose transactions in NMS securities equal or exceed (i) two million shares or $20 million during any calendar day, or (ii) 20 million shares or $200 million during any calendar month. The large trader reporting regime is designed to facilitate the Commission's ability to assess the large trader activity on the securities markets, to reconstruct trading activity following periods of unusual market volatility, and to analyze significant market events for regulatory purposes. It also should enhance the Commission's ability to detect and deter fraudulent and manipulative activity and other trading abuses, and should provide the Commission with a valuable source of useful data to study markets and market activity. The identification, recordkeeping, and reporting system will provide the Commission with a mechanism to identify large traders and their affiliates, accounts, and transactions. Specifically, Rule 13h-1 will require large traders to identify themselves to the Commission and make certain disclosures to the Commission on Form 13H. Upon receipt of Form 13H, the Commission will issue a unique identification number to the large trader, which the large trader will then provide to its registered broker-dealers. Registered broker-dealers will be required to maintain transaction records for each large trader, and will be required to report that information to the Commission upon request. In addition, certain registered broker-dealers subject to Rule 13h-1 will be required to perform limited monitoring of their customers' accounts for activity that may trigger the large trader identification requirements of Rule 13h-1.

In accordance with section 70914 of the Build America Buy America Act (Pub. L. No. 117-58 §§ 70901-70953) (BABAA), grantees funded under Department of Education (the Department) programs that allow funds to be used for infrastructure projects (infrastructure programs), i.e., construction and broadband infrastructure, may not use their grant funds for these infrastructure projects or activities unless they comply with the following BABAA sourcing requirements: 1) All iron and steel used in the infrastructure project or activity are produced in the United States, 2) All manufactured products used in the infrastructure project or activity are produced in the United States, and 3) All construction materials are manufactured in the United States. The Department may, in accordance with sections 70914(b) and (d), 70921(b), 70935, and 70937 of BABAA, and the Office of Management and Budget Memorandum M 22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, approve waivers to BABAA sourcing requirements submitted by grantees under programs it has identified as infrastructure programs when it determines that exceptions to these requirements apply. The Department may approve, subject to notice and comment requirements and the Office of Management and Budget Made in America Office (MIAO) review, the types of waivers listed below when one or more of the following conditions are met: 1) Public Interest Waiver - Applying the BABAA sourcing requirement would be inconsistent with the public interest, 2) Non-availability Waiver - The types of iron, steel, manufactured products, or construction materials are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality, and 3) Unreasonable Cost Waiver - The inclusion of iron, steel, manufactured products, or construction materials produced in the United States will increase the cost of the overall project by more than 25 percent. Abstract

CBP Form 7501, Entry Summary, is used to identify merchandise entering the commerce of the United States, and to document the amount of duty and/or tax paid. CBP Form 7501 is submitted by the importer, or the importer’s agent, for each import transaction. The data on this form is used by CBP as a record of the import transaction; to collect the proper duty, taxes, certifications and enforcement information; and to provide data to the U.S. Census Bureau for statistical purposes. Abstract

The Board’s Regulation O - Loans to Executive Officers, Directors, and Principal Shareholders of Member Banks (12 CFR Part 215) governs any extension of credit made by a member bank to an insider of the member bank, of any company of which the member bank is a subsidiary, and of any other subsidiary of that company. Insiders include executive officers, directors, principal shareholders, and any related interest of such person. Consistent with statute, the Federal Deposit Insurance Corporation (FDIC) and the Office of the Comptroller of the Currency (OCC) have issued regulations generally requiring the depository institutions that they supervise to comply with Regulation O. Regulation O prohibits extensions of credit to insiders unless they are made on substantially the same terms (including interest rates and collateral) as those prevailing at the time for comparable transactions by the bank with other persons who are not employed by the bank and do not involve more than the normal risk of repayment or present other unfavorable features, limits extensions of credit by a member bank to individual insiders and to all insiders, requires a member bank’s board of directors to approve certain large extensions of credit, and sets forth recordkeeping and disclosure requirements.

DOL published Final regulations implementing the Honoring Investments Recruiting and Employing (HIRE) American Military Act of 2017 (the Act). The HIRE Vets Act requires the Department to annually solicit and accept voluntary information from employers for consideration of employers to receive a HIRE Vets Medallion Award. The Act establishes specific criteria for large employers and allows the Department discretion in establishing additional criteria for each large employer award level and criteria for small and medium employers to qualify for similar awards. The Final establishes the application process and criteria that the Department intends to use to receive, review, and process applications to verify the information provided; and award the HIRE VETS Medallion.

Abstract

The information collection consists of reporting, recordkeeping, and disclosure requirements under subpart C (Nonpublic Information Made Available to Supervised Financial Institutions, Governmental Agencies, and Others in Certain Circumstances) of the Rules Regarding Availability of Information (12 CFR Part 261). Subpart C contains reporting requirements that enable third parties to request the Board’s authorization to access, use, or further disclose confidential supervisory information or other nonpublic information of the Board, and that ensure that the Board is notified when any subpoena or other legally enforceable demand requires production of confidential supervisory information or other nonpublic information of the Board in the form of documents or testimony. Subpart C also contains one recordkeeping requirement related to maintaining a written account when supervised financial institutions disclose confidential supervisory information to service providers if the disclosure is deemed necessary to the service provider’s provision of services, and two disclosure requirements that apply when individuals are served with a subpoena, order, or other judicial or administrative process requiring the production of confidential supervisory information or other nonpublic information of the Board in the form of documents or testimony.
