Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

Completion of Foreign Currency Forms FC-1, FC-2, and FC-3, to be filed by major market participants, is required under Title II of Public Law 93-110 (87 Stat. 352, 31 U.S.C. 5315), and implementing regulations. The data collected on Foreign Currency Forms FC-1, FC-2 and FC-3 are used in connection with supplemental information from other sources to better understand the sources and nature of mobile capital flows which can have a significant impact on the functioning of the international monetary system. Aggregate data from these forms are published quarterly in the “Foreign Currency Positions” section of the Treasury Bulletin. Data reported by individual firms may be made available to other Federal agencies and to the Federal Reserve District Banks. Data are made available to the Federal Reserve System for analysis of market forces to aid in the formulation and implementation of U.S. monetary policy and operations in foreign exchange markets. In addition, data reported by individual banks may be made available to the Federal Reserve Board insofar as authorized by Section 11(a) of the Federal Reserve Act, as amended (12 U.S.C. 248(a)(2)).

Abstract

On March 23, 2010, the President signed into law the Patient Protection and Affordable Care Act (P.L. 111-148). On March 30, 2010, the Health Care and Education Reconciliation Act of 2010 (P.L. 111-152) was signed into law. The two laws are collectively referred to as the Affordable Care Act. The Affordable Care Act implements various policies that will make health insurance coverage more accessible to consumers. Under 45 CFR 156.122(d)(1)(2) and 156.230(c) in the rule Patient Protection and Affordable Care Act; HHS Notice of Benefit and Payment Parameters for 2016 (CMS-9944-P), new standards for qualified health plan (QHP) issuers are established for the submission of provider and formulary data in a machine- readable format to the Department of Health and Human Services (HHS) and for posting on issuer web sites.

Abstract

Unmanned aircraft with remote identification are mandated to broadcast the remote identification message elements addressed in this supporting statement, on occasion (when the unmanned aircraft with remote identification is operated in the airspace of the United States). This requires the disclosure of information about the unmanned aircraft. The remote identification message elements that operators are required to broadcast under this rule are considered publicly accessible information as they may be available to the public. The remote identification message elements broadcast directly from the unmanned can be received by anyone who has equipment, such as a personal wireless device, that can receive broadcast messages. The FAA considers that there is no more inherent right to privacy in the physical location of either the unmanned aircraft or the control station than there is in the location of manned aircraft. As the disclosure required by this information collection is automated, the time burden for compliance is zero hours. The information broadcast in the message elements will be used by the FAA and other Federal partners to provide airspace awareness of unmanned aircraft operations in the airspace of the United States, which could be used to distinguish compliant airspace users from those potentially posing a safety or security risk.

Abstract

The Rehabilitation Act of 1973 (the Act) requires the Independent Living Services (ILS) Program Performance Report (PPR). The ILS PPR is submitted annually by the Designated State Entities (DSEs) and Statewide Independent Living Councils (SILCs) in every state that receives Part B funds. The ILS PPR serves as the main way for DSEs to fulfill their requirement to submit reports regarding financial assistance from the Administration for Community Living (ACL). The ILS PPRs are used by ACL to assess grantees’ compliance with Title VII of the Act, with 45 CFR part 1329 of the Code of Federal Regulations, and with applicable provisions of the HHS Regulations at 45 CFR part 75. Based on the review and analysis of PPRs, ACL provides technical assistance, assesses compliance, and grants and denies continuation of funding. The PPR is also used by ACL to design CIL and SILC training and technical assistance activities authorized by section 721 of the Act. See 29 U.S.C. § 721(b)(1) (which is 29 U.S.C. 796f(b)(1)); see 45 CFR 1329.24. The data is also used to meet the requirements of GPRAMA regarding performance measures. See 31 U.S.C. § 1116.

Abstract

Pursuant to chapters 51 and 52 of the Internal Revenue Code (IRC, 26 U.S.C.) and the Federal Alcohol Administration Act (FAA Act, 27 U.S.C. 201 et seq.), TTB regulates, among other things, the importation of alcohol and tobacco products. Under those statutory authorities, TTB has issued regulations in 27 CFR requiring importers of alcohol and tobacco products to provide certain information regarding their identity, TTB-issued permits, the identity and amount products imported, and the taxes paid on those products or, for products released from customs custody without payment of tax, the transfer of such products to a bonded facility. TTB also uses the collected information to ensure that imported alcohol beverage labels comply with FAA Act labeling requirements. Under this information collection, importers generally submit the required information electronically to Customs and Border Protection during the import entry process, and the required information is then electronically transmitted to TTB. In addition, importers may submit letterhead applications to TTB to request variances from established regulatory provisions. The collected import data and letterhead variance information are necessary to protect the revenue and ensure that importers comply with Federal laws and regulations regarding alcohol and tobacco products or that proposed alternatives will not pose a burden to TTB in administrating its import regulations.

On March 11, 2021, the President signed the American Rescue Plan Act of 2021 (the “Act”), Pub. L. No. 117-2. Title III, Subtitle B, Section 3206 of the Act established the Homeowner Assistance Fund and provides $9.961 billion for the U.S. Department of the Treasury (Treasury) to make payments to States (defined to include the District of Columbia, Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa), Indian tribes or tribally designated housing entities, as applicable, and the Department of Hawaiian Home Lands (collectively the “eligible entities”) to mitigate financial hardships associated with the coronavirus pandemic, including for the purposes of preventing homeowner mortgage delinquencies, defaults, foreclosures, loss of utilities or home energy services, and displacements of homeowners experiencing financial hardship after January 21, 2020, through qualified expenses related to mortgages and housing. Section 3206(c)(1) requires the eligible entities to use the funds for the purpose of preventing homeowner mortgage delinquencies, defaults, foreclosures, loss of utilities or home energy services, and displacements of homeowners experiencing financial hardship after January 21, 2020, through qualified expenses related to mortgages and housing. Section 3206(e)(1) provides that not later than 45 days after March 11, 2021, the Secretary shall pay each eligible entity. To date, eligible entities have generally received 10% of their allocations.

The SCA amends the Communications Act of 1934 to require mobile service providers to separate the line of a survivor of domestic violence (and other related crimes and abuse), and any individuals in the care of the survivor, from a mobile service contract shared with an abuser within two business days after receiving a request from the survivor. The SCA also directs the Commission to issue rules implementing the line separation requirement within 180 days of enactment (i.e., by June 7, 2024). To implement the line separation process, the Commission establishes this collection, which requires covered providers to notify consumers about the availability of the line separation process, and requires survivors to submit certain information to covered providers to request a line separation.
