What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Patent and Trademark Resource Center Metrics

Key Information

Abstract

The Patent and Trademark Resource Center (PTRC) is authorized under the provision of 35 U.S.C. 2(a)(2), which provides that the United States Patent and Trademark Office (USPTO) shall be responsible for disseminating information with respect to patents and trademarks to the public. The PTRC Program is made up of public, state, and academic libraries. Each participating library designated as a PTRC must fulfill the following requirements: Assist the public in the efficient use of patent and trademark resources; provide free access to patent and trademark resources provided by the USPTO; and send representatives to attend USPTO-hosted PTRC training seminars. The USPTO seeks to collect information about the public’s use of the PTRCs and training provided through the PTRC program. The PTRC Program requirements stipulate that all participating libraries must submit quarterly metrics on the public’s use of PTRC services and public outreach efforts provided by the PTRCs. To facilitate that requirement, the USPTO electronically collects these metrics on a quarterly basis. This information collection enables the USPTO to see how customers are being served by the PTRCs and to ascertain what changes may be needed in the types of services provided and trainings that the PTRC Program Office should offer to PTRC librarians.

Key Information

Abstract

Commercial air tour operators mandatorily report on the number of operations tours over national park units they conduct to the FAA. Commercial air tour operators are required to report as a condition of their Operation Specification that allows them to conduct air tours over national park units. The entities that are required to report are those operators who are currently granted the authority to conduct air tours over national park units. The operators will report on a semi-annual (every six months) basis. The collection is operators reporting their air tour information to the FAA and NPS, and the information includes the date and time of the tour, the type of aircraft the tour was conducted in, and the route that was utilized for the tour of the park. In addition, operators in parks with completed air tour management plans with flight monitoring requirements report their air tour flight monitoring data. The commercial air tour operational data is received by the FAA and NPS has and will be used by the agencies as background information useful in the development of air tour management plans and voluntary agreements for purposes of meeting the mandate of NPATMA and for monitoring compliance with conditions and limitations of air tour management plans. The data has and also will be used to assist FAA and NPS in developing and publishing an annual list of parks with 50 or fewer air tour operations a year which was an amendment provision to NPATMA in the FAA Modernization and Reform Act of 2012.

Annual Performance Report for the State Grant for Assistive Technology Program

Key Information

Abstract

Information collected through this data collection instrument is necessary for ACL and states to comply with Sections 4 and 8 of the 21st Century Assistive Technology Act (AT Act). Section 4 of the AT Act authorizes grants to public agencies in the 50 states and the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Marianas (states and territories). With these funds, the 56 states and territories operate “Statewide AT Programs” that conduct activities to increase access to and acquisition of assistive technology (AT) for individuals with disabilities and older Americans. These comprehensive activities are divided into two categories: “State-level Activities” and “State Leadership Activities.” According to Section 4 of the AT Act, as a condition of receiving a grant to support their Statewide AT Programs, the 56 states and territories must provide to ACL: (1) applications and (2) annual progress reports on their activities. Section 8(d) of the AT Act requires that ACL submit to Congress an annual report on the activities conducted under the Act and an analysis of the progress of the states and territories in meeting their measurable goals. This report must include a compilation and summary of the data collected under Section 4(f). In order to make this possible, states and territories must provide their data uniformly. This data collection instrument was developed to ensure that all 56 states and outlying areas report data in a consistent manner in alignment with the requirements of Section 4(f). This data collection provides a way for all 56 grantees—50 U.S. states, D.C., Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands to collect and report data on their performance in a consistent manner.

Abstract

The purpose of this study is to collect information on burden of heat strain among miners as well as factors related to personal risk and core body temperature that contribute to individual variability in heat tolerance and to declines in heat-related worker performance. The goal of the study is to assess the following: (1) whether a core body temperature threshold exists at which cognitive performance beings to decline, (2) factors that contribute to inter- and intra- individual variability in cognitive physiologic responses to heat, and (2) patterns of heat strain among miners in both surface and underground mines. The intended use for this data is to develop guidance and strategies to mitigate risk of heat strain among miners. This guidance will build on the strategies currently used by mining but will include information on how to incorporate personal factors and physiologic measurements into current heat strain monitoring and prevention practices.

Abstract

Section 109(a) of the Tax Relief and Health Care Act of 2006 (TRHCA) (Pub. L. 109-432) amended section 1833(t) of the Social Security Act by adding a new subsection (17) that affects the payment rate update applicable to Outpatient Prospective Payment System (OPPS) payments for services furnished by hospitals in outpatient settings on or after January 1, 2009. Section 1833(t)(17)(A) of the Social Security Act, which applies to hospitals as defined under section 1886(d)(1)(B) of the Social Security Act, requires that hospitals that fail to report data required for quality measures selected by the Secretary in the form and manner required by the Secretary under section 1833(t)(17)(B) of the Social Security Act will incur a reduction in their annual payment update (APU) factor to the hospital outpatient department fee schedule by 2.0 percentage points. Hospital OQR Program payment determinations are made based on Hospital OQR Program quality measure data reported and supporting forms submitted by hospitals as specified through rulemaking. To reduce burden, a variety of different data collection mechanisms are employed, with every consideration taken to employ existing data and data collection systems.

Key Information

Abstract

The Minimum Data Set (MDS) is a uniform instrument used in every Medicare/Medicaid certified nursing home in the United States to assess resident condition. It was developed in response to the Landmark Institute of Medicine (IOM) Report on Nursing Home Quality in 1987 where the MDS was seen as a critical component in efforts to improve the quality of care in nursing homes. The Omnibus Reconciliation Act of 1987 (OBRA 1987) also set forth new provisions for Medicare and Medicaid related to new standards for care in the nursing home setting. From its inception, the MDS was intended to serve several purposes: (1) Collect data to inform care plans (2) To generate quality indicators to evaluate nursing homes and guide improvement interventions (3) To serve as a data source for nursing home payment systems. Pursuant to sections 4204(b) and 4214(d) of OBRA 1987, the current requirements related to the submission and retention of resident assessment data are not subject to the Paperwork Reduction Act (PRA), but it has been determined that requirements for SNF staff performing, encoding and patient assessment data necessary administer the payment rate methodology described in 413.337, are subject to the PRA. The SNF QRP was established in CMS-1622-F (August 4, 2015; 80 FR 46390) and began collecting data from SNFs in fiscal year (FY) 2016 using the MDS. As described in section 1899B (b)(1)(B) of the Social Security Act (the Act), SNFs are required to submit standardized patient assessment data with respect to the following categories: • Functional Status • Cognitive Function • Special Services, Treatments, and Interventions • Medical Conditions and Comorbidities • Impairments • Other categories deemed necessary and appropriate by the Secretary Both the Patient Driven Payment Model (PDPM) in the SNF PPS and the SNF QRP collect data through the MDS 3.0. The PDPM was described and adopted for SNFs and Swing Beds in CMS-1696-F (August 8, 2018; 83 FR 39162). This package is a request for a revision to the current Minimum Data Set (MDS) assessment instrument for the Skilled Nursing Facility (SNF). This package represents a request from the Centers for Medicare & Medicaid Services (CMS) to implement the MDS 3.0 v1.18.11 beginning October 1, 2023 to October 1, 2026 in order to meet the requirements of policies finalized in the Federal Fiscal Year (FY) 2020 Skilled Nursing Facility (SNF) Prospective Payment System (PPS) final rule (CMS-1718-F, RIN 0938-AT75). A PRA package was submitted at the time of the finalized policies and approved on 11/22/2019, but the compliance date for the finalized policies (10/01/2020) was delayed due to the COVID-19 public health emergency (PHE). Please note, however, the burden was never retracted, and the implementation of the instrument was simply delayed. While there has been no change in assessment-level burden since the approval of the MDS 3.0 v1.17.2, there has been a change in total burden since 2019 when the package was originally approved due to a decrease in the number of MDS assessments completed and a change in the hourly rate for clinicians completing the assessment.

Key Information

Abstract

Section 15C of the Securities Exchange Act of 1934 (the Act) establishes federal regulation of brokers and dealers of government securities, including banks and other financial institutions, and directs those brokers and dealers to keep certain records. These requirements are implemented for state member banks in section 208.34 of the Board’s Regulation H - Membership of State Banking Institutions in the Federal Reserve System (12 CFR Part 208), which requires that non-exempt state member banks effecting securities transactions for customers establish and maintain a system of records of these transactions, furnish confirmations of transactions to customers that disclose certain information, and establish written policies and procedures relating to securities trading. Regulation H also indirectly imposes certain disclosure requirements on certain state member bank employees and officers.

Low Income Home Energy Assistance Program (LIHEAP) Detailed Model Plan Application

Key Information

Abstract

The Low Income Home Energy Assistance Program (LIHEAP) block grant (42 U.S.C. 8621) was established under Title XXVI of the Omnibus Budget Reconciliation Act of 1981, Public Law 97-35. The Office of Community Services (OCS) within the U.S. Department of Health and Human Services (HHS), Administration for Children and Families (ACF) administers LIHEAP at the federal level. Section 2605(c)(1) of the Omnibus Budget Reconciliation Act of 1981, as amended, (LIHEAP statute) provides that “as part of the annual application required…, the chief executive officer of each state shall prepare and furnish to the Secretary, in such format as the Secretary may require, a plan” which addresses several statutorily required data elements (emphasis added). [see also Section 2604(d)(4) regarding the Plan requirement for tribes]. Section 2605(c)(3) of the LIHEAP statute requires the Secretary to make available each fiscal year a model plan for use in the next fiscal year. The regulations require that states and territories (45 C.F.R. § 96.10(c)(2)) and tribes/tribal organizations (45 C.F.R. § 96.42(e)) that wish to administer a Low Income Home Energy Assistance Program (LIHEAP) must submit an application for funds each year by September 1. Indian tribes and tribal organizations must submit their LIHEAP Plans by the required deadline unless the State(s) in which the tribe or organization is located agrees in writing to a specific later submission date. Section 2605(c)(3) of the Omnibus Budget Reconciliation Act of 1981, as amended, provides that the Secretary shall make available a model LIHEAP Plan which may be used to prepare the application required under Sections 2605(a)(1) and (c)(1) (42 U.S.C. § 8624(a)(1) and (c)(1)). OCS has responsibility to review and accept LIHEAP Plan submissions on behalf of ACF, which is the agency that administers LIHEAP at the federal level. The LIHEAP Detailed Model Plan Application was most recently approved by OMB on February 25, 2024. During the 30-day comment period, the Office of Community Services received a number of comments and would like to post responses to these public comments publicly for transparency. This request is to upload OCS’s responses to public comments received during the 30-day comment period.

This information collection renewal request is needed to provide a method through which State DOTs may submit a request to transfer highway funds to other States and agencies and among programs/projects, per legislatively provided flexibilities. This collection is utilized by the State DOTs on an as needed basis to best meet their surface transportation needs. The information is utilized by FHWA to review, approve, and process the requested transfer requests. Since last approved, most of the requests have been automated within FHWA’s Fiscal Information Management System (FMIS) to create efficiencies and streamline the process. FHWA continues to work to streamline the remainder.

Abstract

Completed by applicants as the basis of a criminal history check to establish that an individual is suitable for Federal employment or should be granted a security clearance. Executive Order 10450, as amended, requires that investigations be conducted on all persons entering Federal service. E.O. 10450, as amended, also requires that each investigation include a check of the Federal Bureau of Investigation's (FBI) fingerprint files to identify any criminal records on the subject. Although roughly 60% of all submissions are received electronically, the need remains to conduct checks based on hardcopy requests. The Standard Form (SF) 87 is a fingerprint chart submitted to the FBI in order to fulfill that part of the background investigation. The SF 87 is a fingerprint card, which is utilized to conduct a national criminal history check, which is a component of the background investigation. The SF 87 is completed by individuals who are under consideration for appointment to or retention in a Federal position or performance of work on behalf of the Government. The SF 87 fingerprint chart is used in background investigations to establish that such persons are eligible for logical and physical access to Government facilities and systems; suitable or fit to perform work for, on behalf of, the Federal Government; suitable for employment or retention in a public trust position, suitable for employment or retention in a national security position, and/or eligible for access to classified national security information. The SF 87 form is only utilized when a hardcopy fingerprint chart must be obtained, as opposed to the electronic collection of fingerprints. Due to the SF 87 form’s small size and the fact that it may be maintained in multiple systems of records, it does not list all potentially applicable routine uses under the Privacy Act. Accordingly 5 U.S.C. 552a(e)(3)(C) requires that an agency issuing the SF 87 form must also give the subject a copy of the routine uses for the applicable system of records and FBI’s Privacy Act Notice and Privacy Rights.

Museums for All Program Evaluation

Key Information

Abstract

Museums for All is an initiative of the Institute of Museum and Library Services (IMLS), administered through a cooperative agreement with the Association of Children's Museums (ACM), with the goal of reducing barriers to museum access through free or reduced-price admission for families facing financial need. An evaluation conducted in 2017 and published in 2018 found that the initiative helped participating institutions expand their audiences, reach diverse visitors, and strengthen relationships with their communities. Since this previous evaluation, participation in Museums for All has increased from 228 to over 1,200 institutions across the U.S., representing all 50 states, the District of Columbia, and the U.S. Virgin Islands. In response to the initiative's expansion, ACM and IMLS have funded an updated evaluation, conducted by Knology, to better understand the impacts of Museums for All on participating institutions and to inform future improvements to the initiative.
