Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

Museums for All is an initiative of the Institute of Museum and Library Services (IMLS), administered through a cooperative agreement with the Association of Children's Museums (ACM), with the goal of reducing barriers to museum access through free or reduced-price admission for families facing financial need. An evaluation conducted in 2017 and published in 2018 found that the initiative helped participating institutions expand their audiences, reach diverse visitors, and strengthen relationships with their communities. Since this previous evaluation, participation in Museums for All has increased from 228 to over 1,200 institutions across the U.S., representing all 50 states, the District of Columbia, and the U.S. Virgin Islands. In response to the initiative's expansion, ACM and IMLS have funded an updated evaluation, conducted by Knology, to better understand the impacts of Museums for All on participating institutions and to inform future improvements to the initiative.

Foreign Institution Reporting Requirements under the CARES Act

Key Information

Abstract

The Department of Education (the Department) is requesting a reinstatement information collection, 1845-0161, Foreign Institution Reporting Requirements under the CARES Act, be made available for full clearance with public comment. Section 3510(a) of the CARES Act, Pub. L. No. 116-136 (March 27, 2020), authorized the Secretary of Education (Secretary) to permit a foreign institution, in the case of a public health emergency, major disaster or emergency, or national emergency declared by the applicable government authorities in the country in which the foreign institution is located, to provide any part of an otherwise eligible program to be offered via distance education for the duration of such emergency or disaster and the following payment period for purposes of title IV of the Higher Education Act of 1965 (20 U.S.C. 1070 et seq.). Additionally, under Section 3510(d) of the CARES Act, the Secretary may allow a foreign institution to enter into a written arrangement with an institution of higher education located in the United States that participates in the Federal Direct Loan Program under part D of title IV of the Higher Education Act of 1965 (20 U.S.C. 1087a et seq.) for the purpose of allowing a student of the foreign institution who is a borrower of a loan made under such part to take courses from the institution of higher education located in the United States. The CARES Act requires foreign institutions that use either type of authority described above to report such use to the Secretary. Institutions are required to report use of either distance education or written arrangements to the Department no later than 30 days after it begins offering coursework online to Direct Loan recipients. The Department must also collect specific information from a school that requests a waiver in order to determine if the school is eligible to receive the waiver. On May 12, 2020, Federal Student Aid, an Office of the Department, notified foreign institutions of the new authority and requested that any foreign institution who wished to utilize this new authority to respond with information specified in the email. This information collection was discontinued following the discontinuation of the national COVID-19 emergency status. However, due to other global situations we are now requesting a new collection to allow for the on-going use of the CARES Act waiver.

Abstract

Completed by applicants as the basis of a criminal history check to establish that an individual is suitable for Federal employment or should be granted a security clearance. Executive Order 10450, as amended, requires that investigations be conducted on all persons entering Federal service. E.O. 10450, as amended, also requires that each investigation include a check of the Federal Bureau of Investigation's (FBI) fingerprint files to identify any criminal records on the subject. Although roughly 60% of all submissions are received electronically, the need remains to conduct checks based on hardcopy requests. The Standard Form (SF) 87 is a fingerprint chart submitted to the FBI in order to fulfill that part of the background investigation. The SF 87 is a fingerprint card, which is utilized to conduct a national criminal history check, which is a component of the background investigation. The SF 87 is completed by individuals who are under consideration for appointment to or retention in a Federal position or performance of work on behalf of the Government. The SF 87 fingerprint chart is used in background investigations to establish that such persons are eligible for logical and physical access to Government facilities and systems; suitable or fit to perform work for, on behalf of, the Federal Government; suitable for employment or retention in a public trust position, suitable for employment or retention in a national security position, and/or eligible for access to classified national security information. The SF 87 form is only utilized when a hardcopy fingerprint chart must be obtained, as opposed to the electronic collection of fingerprints. Due to the SF 87 form’s small size and the fact that it may be maintained in multiple systems of records, it does not list all potentially applicable routine uses under the Privacy Act. Accordingly 5 U.S.C. 552a(e)(3)(C) requires that an agency issuing the SF 87 form must also give the subject a copy of the routine uses for the applicable system of records and FBI’s Privacy Act Notice and Privacy Rights.

This information collection request requires operators of gas service lines who do not maintain their customers’ buried piping between service lines and building walls or gas utilization equipment to send written notices to their customers prescribing the proper maintenance of these gas lines and of the potential hazards of not properly maintaining these gas lines. Operators also have to maintain records that include a copy of the notice currently in use and evidence that notices were sent to customers within the previous 3 years. The purpose of the collection is to prevent pipeline safety failures and to enforce regulatory compliance. Examples of written notices include informational inserts included in customer's billing statements. For multi-family residences such as mobile parks, housing projects, or apartment complexes, the requirement allows master meter operators to post a general notice in a predominant location frequented by customers rather than issuing individual notices to each customer. The time frames for developing notices are immediate and operators must retain proof of notice for 3 years.

49 CFR Part 193 requires operators of liquefied natural gas (LNG) facilities to maintain records, as needed, pertaining to facility design, operations, maintenance, and personnel training. The purpose of this mandatory information collection request is to ensure compliance with the record keeping requirements prescribed in the federal pipeline safety regulations. LNG operators must make and maintain records as described and have those records available for compliance inspection by PHMSA staff upon request. Examples of such records include the results of personnel training activities; records of materials used for components, buildings, foundations, and LNG support systems; maps; and various facility maintenance activities. Most records of the required records are to be kept for as long as the facility is in service. The purpose of these programs is to enhance safety by identifying and reducing pipeline integrity risks. Abstract

This collection of information is necessary for the FAA to confirm compliance with fuel efficiency requirements for certification of certain airplanes. These certification requirements are proposed as new part 38 to 14 CFR, and are intended to implement the emissions standards adopted by the Environmental Protection Agency (EPA), allowing manufacturers to certificate their aircraft for fuel efficiency in the United States. The establishment of these standards by the EPA and their implementation by the FAA are required under the Clean Air Act. Further, these standards were initially established by the International Civil Aviation Organization (ICAO) with the participation of the United States; and, as a signatory to the Chicago Convention, the United States is adopting these standards that are consistent with those established internationally. The proposed appendix to new part 38 would require the submission of certain fuel efficiency certification test data that would be submitted to the FAA as part of the applicant’s certification test report. The regulation also requires a manufacturer to include one or more values in the flight manual of a certificated airplane.

The OCC's codified guidelines (12 CFR part 30, appendix D) establish minimum standards for the design and implementation of a risk governance framework for insured national banks, insured Federal savings associations, and insured Federal branches of a foreign bank (bank). The guidelines apply to a bank with average total consolidated assets: (i) equal to or greater than $50 billion; (ii) less than $50 billion if that institution's parent company controls at least one insured national bank or insured Federal savings association that has average total consolidated assets of $50 billion or greater; or (iii) less than $50 billion, if the OCC determines such bank's operations are highly complex or otherwise present a heightened risk as to warrant the application of the guidelines (covered banks). The guidelines also establish minimum standards for a board of directors in overseeing the framework's design and implementation. The Truth in Negotiations Act, 10 U.S.C. chapter 271 and 41 U.S.C. chapter 35, requires the Government to obtain certified cost or pricing data from contractors prior to the award of certain contract actions. Contractors may be exempt from this requirement under certain conditions. This clearance covers the information that offerors or contractors must submit to comply with the following FAR requirements: a. Abstract

In order to facilitate the financing of projects that provide for new telecommunications services and other telecommunications services not ordinarily financed by the Rural Utilities Service (RUS), the agency is willing to consider accommodating the Government's lien on telecommunications borrowers' systems in an expedited manner based on the financial strength of the borrowers operations. The information collected for lien accommodation requests is used by RUS to ascertain a borrower's level of financial stability and, upon agency approval of the lien accommodation, ensures the government's loan security interest is protected.

VA Advance Directive - Durable Power of Attorney for Health Care and Living Will (VA Form 10-0137)

Abstract

Section 7331 of title 38, United States Code (U.S.C.), requires, in relevant part, that the Secretary of Veterans Affairs, upon the recommendation of the Under Secretary for Health, prescribe regulations to ensure, to the maximum extent practicable, that all VA patient care be carried out only with the full and informed consent of the patient, or in appropriate cases, a representative thereof. Based on VA’s interpretation of this statute and our mandate in 38 U.S.C. 7301(b) to provide a complete medical and hospital service, we recognize that patients with decision-making capacity have the right to state their treatment preferences in a VA or other valid advance directive. The VA advance directive form (both English and Spanish language versions) is VA Form 10-0137. These forms have a current OMB Paperwork Reduction Act (PRA) clearance under OMB Control Number 2900-0556. In addition, 2900-0556 includes the collection of a “Close Personal Friend Statement” for incapacitated Veterans who have not completed an Advance Directive and are in need of health care. When a Veteran is incapacitated and does not have an Advance Directive, the VA regulations allow a statement to be submitted from a “Close Personal Friend” who will be responsible for making health care decisions on behalf of the Veteran. It is estimated that 300 such statements will be collected annually.
