Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

The Board’s Regulation R - Exceptions for Banks from the Definition of Broker in the Securities Exchange Act of 1934 (12 CFR Part 218) implements certain exceptions for banks from the definition of broker under section 3(a)(4) of the Securities Exchange Act of 1934 (Exchange Act). For purposes of the Exchange Act and this Supporting Statement, “banks” include banking institutions organized in the United States, including members of the Federal Reserve System, Federal savings associations, and other commercial banks, savings associations, and nondepository trust companies that are organized under the laws of a state or the United States and subject to supervision and examination by state or federal authorities having supervision over banks and savings associations. Sections 701, 723, and 741 of Regulation R contain certain recordkeeping provisions for banks that utilize the exceptions in the Exchange Act and certain customer and counterparty disclosure requirements.

Key Information

Abstract

The Charter Service program ensures that private charter bus providers (who register on FTA's Charter Registration Website) are given the first opportunity to provide charter bus service and protects them from unauthorized competition from public transit providers that receive federal funding from FTA. This is a voluntary collection of information from private charter bus companies and transit agencies. The collection of information from private charter bus companies is conducted during their initial registration on FTA’s Charter Service Registration website. Registration allows the company to be notified electronically of third-party charter service request in their geographic region that are submitted to FTA grantees. The companies are requested to update their information every two years. Although, private charter companies are given priority, a FTA grant recipient may also provide charter service. However, they are required to electronically report such information on a quarterly basis. The Charter Service program was unchanged with the passing of the Bipartisan Infrastructure Law (BIL) however, this information collection request reflects a decrease in the respondents from 2180 in 2020 to 2,000 currently. This decrease was not associated with any federal regulation or action but the result of consolidation among charter bus respondents and some private bus operators no longer doing business due to the pandemic. This submission also includes updates in cost to the respondents based on the 2022 Bureau of Labor Statistics wage rates and the federal costs which were updated as a result of the 2024 OPM salary table.

Abstract

The Responsible Appliance Disposal program (RAD) is a voluntary partnership program sponsored by the Environmental Protection Agency (EPA) that encourages Partners to reduce emissions of ozone-depleting substances (ODS) and their alternatives (e.g., hydrofluorocarbons (HFCs)) that can be attributed to improper disposal of appliances. Appliances may contain ODS or HFC refrigerants and foams as well as universal wastes such as mercury, used oil, and polychlorinated biphenyls (PCBs). Federal law requires refrigerant recovery and proper management of universal waste but does not require the recovery of appliance foam. The RAD Program works with utilities, retailers, manufacturers, federal agencies/states/municipalities, waste removal service providers, affiliates, and others to dispose of appliances using best environmental practices. To encourage reductions in emissions associated with appliance disposal in the United States, EPA launched the RAD Program. The RAD Program supports Section 608 of the Clean Air Act (CAA) and is an important component of EPA’s mission to protect the ozone layer by reducing emissions of ODS. These efforts also support the American Innovation and Manufacturing (AIM) Act. RAD Program Partners reduce emissions of ODS and HFCs and realize other benefits through recovery and destruction/reclamation of refrigerants and foam blowing agents–the latter of which is not covered under existing Federal regulations–and by ensuring that all other hazardous and recyclable materials are handled using best environmental practices. Greenhouse gas (GHG) emissions are avoided through recovery of both ODS, HFCs, and other foam blowing agents. Additionally, through the RAD Program, EPA is partnering with utilities, retailers, manufacturers, federal agencies/state/municipalities, waste removal service providers, and others to promote the retirement of old appliances and permanently remove energy inefficient units from the electricity grid, providing energy savings to consumers. Participation in the Program begins with completion of a mutually agreed upon Partnership Agreement that outlines mutual responsibilities for participation in the RAD Program. By voluntarily joining the Program, a Partner agrees to complete an annual reporting form identifying the number and types of appliances handled and the fates of their individual components. The electronic reporting form automatically generates feedback for the user on the results of their participation in terms of emissions avoided, quantity of used oil/PCBs/mercury destroyed or recycled, energy savings achieved, and consumer savings realized. An annual report provides Partners with information on their progress towards achieving emissions reductions and information about developments in the latest recycling technologies and practices. Through recognition of Partner efforts, and the Program’s promotion of recycling best practices through webinars, web updates, fact sheets, and presentations, non-Partners become aware of recycling best practices and can evaluate what best practices could work for them. The RAD Program largely serves to disseminate information on recycling best practices and creates a platform for information sharing on recycling and waste management practices. The data collected are used as an indicator of whether industry is reducing emissions from end-of-life appliances.

Key Information

Abstract

The EPA has established a suite of PM2.5 standards based on numerous health studies and other evidence demonstrating that serious health effects are associated with exposure to elevated levels of PM2.5. Estimates show that attainment of the PM2.5 standards would result in tens of thousands fewer premature deaths each year, tens of thousands fewer hospital admissions each year, and hundreds of thousands fewer doctor visits, absences from work and school, and respiratory illnesses in children annually. EPA initially established annual and 24-hour PM2.5 standards in 1997. The 24-hour standard was subsequently revised in 2006, and the primary annual standard was revised in 2012. The EPA finalized the PM2.5 NAAQS State Implementation Plan (SIP) Requirements Rule (81 FR 58010) effective October 24, 2016, to describe the Clean Air Act (CAA) requirements that must be met by states with nonattainment areas to develop plans for attaining and maintaining the NAAQS. The intended effect of the PM2.5 NAAQS SIP Requirements Rule is to provide certainty to states regarding their planning obligations related to SIP development. Only states with nonattainment areas are required to submit SIPs that meet the requirements of the rule. The information collection activities in this proposed renewal have been submitted for approval to the Office of Management and Budget (OMB) under the Paperwork Reduction Act (PRA). The PRA requires the EPA to assess the administrative burden (in hours and dollars) for state air agencies to develop plans to attain the PM2.5 NAAQS, and for EPA to review and take action on such plans.

The operating permit program requires owners or operators of units that emit air pollutants to submit annual compliance certifications and monitoring results at least semi-annually, and to report deviations promptly, but no implementation guidance is provided within the operating permit program. The CAM program ensures sources that use active air emission control devices pay attention to those devices by monitoring their performance on an ongoing basis. The CAM rule establishes the requirements to implement that monitoring for the operating permit program in a cost-effective manner.

Abstract

The GSA “Equity Study on Remote Identity Proofing” will assess the impact of ethnicity, race, gender, income, and other demographic factors on the multiple components of identity proofing, which is the process of verifying that a person is who they say they are. GSA will test remote identity-proofing tools provided by multiple vendors that include both biometric checks using facial verification technology as well as non-biometric methods like mobile-device account ownership and credit history. The guidelines from National Institute of Standards and Technology’s (NIST) Special Publication (SP) 800-63A for remote one-to-one identity proofing serve as a framework for the study. Insights from this information collection will enable GSA to make data driven decisions GSA in the development of identity services needed for secure access to crucial government services.

Abstract

This is an extension request to continue to collect data past the current expiration date. This effort supports the NIH Path to Excellence and Innovation (PEI) Program formed in accordance with Presidential Executive Order 13779, The White House Initiative to Promote Excellence and Innovation at Historically Black Colleges and Universities (HBCUs). The HBCU pre-solicitation portal is a tool to collect NIH contracts and grants data that HBCUs and their business teaming partners may be interested in pursuing. The portal provides a streamlined platform for NIH funding opportunities that consolidate information from four different Federal websites. Additionally, this tool has a social networking component that creates a space for HBCUs and businesses to collaborate as they pursue of NIH funding opportunities. Through the collection and analysis of this information, the National Institutes of Health (NIH) Small Business Program Office (SBPO) assists in strengthening HBCUs’ ability to equitably participate in Federal funding programs.

Abstract

The Federal Cigarette Labeling and Advertising Act, 15 U.S.C. § 1333 et. seq., sets forth certain warnings that are required to appear on cigarette packaging and advertising. The Act requires cigarette manufacturers and importers to rotate these warnings on a quarterly basis. See id. However, under certain circumstances, manufacturers and importers with sales below a specified threshold can apply for equalization with respect to the rotation of the warnings on their packaging—meaning that they only need to display the statutorily prescribed warnings an equal number of times over the course of a year—instead of rotation “with respect to a brand style of cigarettes.” See 15 U.S.C. § 1333(c)(1) and (c)(2). Regardless of whether a manufacturer or importer chooses to apply for equalization, it must submit a plan, which is subject to the FTC’s approval and must establish how the manufacturer or importer plans to comply with the statutory labeling and advertising (if it intends to engage in advertising) requirements. See 15 U.S.C. § 1333(a). The applicant must also keep records demonstrating its compliance with the plan approved by the FTC. Manufacturers and importers may apply for equalization if “(i) the number of cigarettes of such brand style sold in the fiscal year of the manufacturer or importer preceding the submission of the application is less than one-fourth of 1 percent of all the cigarettes sold in the United States in such year, and (ii) more than one-half of the cigarettes manufactured or imported by such manufacturer or importer for sale in the United States are packaged into brand styles which meet the requirements of clause (i).” See 15 U.S.C. § 1333(c)(2)(A). Additionally, as part of this application, the manufacturer or importer must include “a plan describing how the manufacturer plans to achieve equalization within the twelve-month period.” See 15 U.S.C. § 1333(c)(2)(B). If the FTC approves the application for equalization, that approval is valid for one year from the date of the approval. See 15 U.S.C. § 1333(c)(2)(C). A manufacturer or importer that has received approval for quarterly rotation of the warnings on its packages does not need further approval from the Commission unless it intends to add new brands or brand styles to its previously-approved plan. Similarly, approval for an advertising plan does not expire, although the manufacturer or importer will need additional approval for new brands, types of advertising, or sizes of advertising formats.
