What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Section 435.927 outlines state requirements to submit certain data elements on eligibility redeterminations to CMS, and at § 435.928, which requires that for states that fail to meet the requirements at § 435.927 for any fiscal quarter during the compliance period, CMS will reduce the state’s FMAP. Section 430.49 requires that when CMS finds that a state has failed to comply with the Federal redetermination requirements at § 435.916 as well as section 1902(tt)(1) of the Act, CMS may require a corrective action plan (CAP), and if the state fails to comply with the CAP requirement, CMS may take further enforcement action to require the state to suspend some or all procedural terminations and impose civil money penalties (CMPs).

Key Information

Abstract

The synthetic organic chemical manufacturing industry (SOCMI) is regulated by the New Source Performance Standards (NSPS) and National Emission Standards for Hazardous Air Pollutants (NESHAP) standards. The affected entities are subject to the General Provisions of the NSPS at 40 CFR part 60, subpart A, and any changes or additions to the General Provisions specified at 40 CFR part 60, subparts Ka, Kb, VV, VVa, DDD, III, NNN and RRR. The affected entities are also subject to the General Provisions of the NESHAP at 40 CFR part 63, subpart A, and any changes, or additions to the General Provisions specified at 40 CFR part 63, subparts BB, Y, V, F, G, H and I. As an alternative, SOCMI sources may choose to comply with the above standards under the consolidated air rule (CAR) at 40 CFR Part 65 as promulgated December 14, 2000. Synthetic organic chemical manufacturing facilities subject to NSPS requirements must notify EPA of construction, modification, startups, shutdowns, date and results of initial performance test and excess emissions. Semiannual reports are also required. Synthetic organic chemical manufacturing facilities subject to NESHAP requirements must submit one-time-only reports of any physical or operational changes and the results of initial performance tests. Owners or operators are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. Periodic reports are also required semiannually at a minimum. Amendments to the new source performance standards (NSPS) to reduce volatile organic compound (VOC) emissions from storage vessels as 40 CFR Part 60, Subpart Kb are being finalized to reduce burden on storage vessel owners or operators. The revisions apply only to affected storage vessels that have IFRs or EFRs. However, the anticipated reduction in burden is anticipated to be realized only by vessels with an IFR. For IFR storage vessels with a liquid-mounted or mechanical shoe primary seal, visual inspections of the floating roof conducted through manholes and roof hatches on the fixed roof (referred to as top-side inspections) are required at least every 12 months. Inspection of the floating roof from within the fixed roof storage vessel (referred to as internal inspections) is required every time the storage vessel is emptied and degassed, but at no time at intervals greater than once every 10 years. IFR storage vessels with double (vapor mounted) seals must either comply with the annual top-side inspection and an internal inspection (as described above) at least once every 10 years, or alternatively conduct internal inspection of the floating roof every time the storage vessel is emptied and degassed, but at no time at intervals greater than once every 5 years. The revisions will remove the time period thresholds for emptying and degassing events, so internal inspections are only required when the storage vessel is emptied and degassed regardless of the interval between degassing events. Other portions of the NSPS remain unchanged.

The CSB Rebates Program currently collects information under an existing ICR; namely the Diesel Emissions Reduction Act (DERA) and Clean School Bus (CSB) Rebate Program ICR No. 2060-0686. The Environmental Protection Agency currently uses ICR No. 2060-0686 to collect information for the CSB Program, but the Agency now needs additional information to ensure successful administration and management of the Clean School Bus Program. The USA Staffing online application collects supplemental information to a candidate's USAJOBS application. This information assists USPTO Human Resource Specialists and Hiring Managers in determining whether an applicant possesses the basic qualification requirements for a patent examiner position. From the information collected, the USA staffing system creates an electronic real-time candidate inventory on applicants' expertise and technical knowledge, which allows USPTO to immediately review applications from multiple applicants.

In enacting section 713, Congress generally required that video programming be closed captioned, regardless of distribution technology, to ensure access to persons who are deaf and hard of hearing. Abstract

A 21st century statistical system must provide information about the dynamic economy quickly, using data assets efficiently while minimizing the burden of collecting and providing data and fully preserving confidentiality. The Census Bureau’s Longitudinal Employer-Household Dynamics (LEHD) program has demonstrated the power and usefulness of linking multiple business and employee data sets with state-of-the-art confidentiality protections to build a longitudinal national frame of jobs. This program supports the Department of Commerce plan to improve American competitiveness and measures of innovation. It provides federal, state, and local policymakers and planners, businesses, private sector decision makers, and Congress with comprehensive and timely national, state, and local information on the dynamic nature of employers and employees. The LEHD program significantly reduces the overall effort for the generation of its quarterly data product by: • Leveraging exiting federal administrative and state data • Avoiding costs required to expand existing surveys to collect the information directly • Reducing respondent burden by limiting the number of required resources to just the owners of the required data The LEHD program is a member of a partnership between the US Census Bureau and the Labor Market Information (LMI) agencies from 49 states, the District of Columbia, and the territories of Puerto Rico and the Virgin Islands. This partnership supports the development, promotion, and distribution of the following data products: • QWI Public Use—The flagship data product of the LEHD program is the QWI Public Use which provides 32 statistical indicators on employment, job creation and destruction, accessions (hires and recalls), and separations (e.g. exits and layoffs). These statistics are released for the following by-groups for all quarters for which data are available for each partner state: - County, metropolitan, and workforce investment area - Age, sex, race, and ethnicity categories - Detailed industry (i.e., type, firm age, firm size) • LEHD Origin Destination Employment Statistics (LODES)—LODES data provide detailed spatial distributions of workers’ employment and residential locations and the relation between the two at the Census Block level. LODES also provides characteristic detail on age, earnings, industry distributions, and local workforce indicators. • Job-to-Job Flows (J2J)—Job-to-Job Flows (J2J) is a new set of statistics on worker reallocation in the United States constructed from the LEHD data. The initial release of national data distinguishes hires and separations associated with job change from hires and separations to non-employment. Future releases will be published at more detailed levels of aggregations, and will tabulate the origin and destination job characteristics of workers changing jobs. These data products highlight state and local labor market dynamics that cannot be learned from other statistical sources and are therefore used in many different arenas. For example, the QWI can be used as local-labor-market controls in regression analysis; to identify long-term trends; to provide local context in performance evaluations, and a host of other applications.

Control of Evaporative Emissions from New and In-Use Portable Gasoline Containers (Renewal)

Abstract

EPA is required under Section 183(e) of the Clean Air Act to regulate Volatile Organic Compound (VOC) emissions from the use of consumer and commercial products. Under regulations promulgated on February 26, 2007 (72 FR 8428) manufacturers of new portable gasoline containers are required to obtain certificates of conformity with the Clean Air Act, effective January 1, 2009. This ICR covers the burdens associated with this certification process. EPA reviews information submitted in a manufacturers application for certification to determine if the gasoline container design conforms to applicable regulatory requirements and to verify that the required testing has been performed. The certificate holder is required to keep records on the testing and collect and keep warranty and defect information for annual reporting on in-use performance of their products. The respondent must also retain records on the units produced, apply serial numbers to individual containers, and track the serial numbers to their certificates of conformity. Any information submitted for which a claim of confidentiality is made is safeguarded according to EPA regulations at 40 CFR 2.201 et seq.

EPA's ENERGY STAR Program in the Commercial and Industrial Sectors (Renewal)

Abstract

The U.S. Environmental Protection Agency (EPA) created ENERGY STAR as a voluntary program to help businesses and individuals protect the environment through superior energy efficiency. Over time, EPA has streamlined the reporting requirements of ENERGY STAR and focused on providing recognition incentives for improvements (e.g., ENERGY STAR Awards program). EPA also makes tools and resources available over the web to help the public overcome the barriers to evaluating their energy performance and investing in profitable improvements. For several reasons, the publics participation in the ENERGY STAR program for commercial and industrial sectors has continued to increase over the past several years, and EPA expects their participation to rise even more in the coming years. A growing number of state and local governments are leveraging ENERGY STAR as a way for the public to respond to rising energy costs and greenhouse gas emissions. As of the end of 2022, 45 state and local governments rely on Portfolio Manager as the foundation for their energy benchmarking and transparency policies. Use of Portfolio Manager is also increasing as Building Performance Standards are increasingly being implemented. Participation in ENERGY STAR has also risen dramatically because of the efforts of trade associations, utilities, and third-party providers in promoting the program to the public. As participation has increased, EPA has taken measures to reduce the burden on participants that take advantage of the benefits of ENERGY STAR. In a recent year, the ENERGY STAR program for commercial buildings and industrial plants helped businesses and organizations save 230 billion kilowatt-hours of electricity, avoid $14 billion in energy costs, and achieve 170 million metric tons of greenhouse gas reductions. On average, ENERGY STAR certified buildings use 35% less energy and generate 35% fewer greenhouse gas emissions than their peers.

Abstract

FRA is amending its regulations related to occupational noise exposure in three ways. First, in response to a Congressional mandate, FRA is expanding those regulations to require that railroads provide an appropriate atmosphere-supplying emergency escape breathing apparatus to every train crew member and certain other employees while they are occupying a locomotive cab of a freight train transporting a hazardous material that would pose an inhalation hazard in the event of release during an accident. Second, FRA is changing the name of this part of its regulations from “Occupational Noise Exposure” to “Occupational Safety and Health in the Locomotive Cab” to reflect the additional subject matter of this final rule and to make other conforming amendments. Third, FRA is removing the provision stating the preemptive effect of this part of FRA’s regulations because it is unnecessary. The information collection will enable FRA to ensure compliance with the Congressional mandate requiring railroads to provide suitable emergency escape breathing apparatus that covers the head and neck and offers respiratory protection for all covered employees. Additionally, FRA will use the collected information to verify that railroads properly inspect, maintain, repair, and replace EEBAs and provide the necessary EEBA instruction/training to all employees covered by this regulation. This information collection is mandatory, submitted to FRA as needed, and there is a requirement for reporting and recordkeeping.

Abstract

The purpose of this Information Collection Request (ICR) is to conduct three surveys as part of the evaluation of the Centers for Medicare & Medicaid Services (CMS) Network of Quality Improvement and Innovation Contractors (NQIIC). This ICR focuses on data collection to assess satisfaction and use of program resources among nursing homes and outpatient clinicians through contracts with Quality Innovation Network-Quality Improvement Organizations (QIN-QIO) and in hospitals through contracts with Hospital Quality Improvement Contractors (HQICs). The surveys will target outpatient clinicians, as well as administrators for nursing homes and hospitals demonstrating a range of participation in order to evaluate the effect of the program on quality improvement efforts. As required by Sections 1152-1154 of the Social Security Act, CMS directs the QIN-QIO Program, one of the largest federal programs dedicated to improving healthcare quality for Medicare beneficiaries. QIOs help Medicare providers with quality improvement throughout the spectrum of care, including with review of quality concerns for the protection of beneficiaries and the Medicare Trust Fund. This program is a key component of the U.S. Department of Health and Human Services' National Quality Strategy and the CMS Quality Strategy, with the overarching goals to achieve better health care and better health, and to lower the costs of care.
