What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Evaluation of the Supportive Services Demonstration

Key Information

Abstract

The U.S. Department of Housing and Urban Development (HUD)’s Office of Policy Research and Development is undertaking an evaluation of the Supportive Services Demonstration (demonstration, or SSD). SSD is designed to test the impact of housing-based supportive services on the healthcare utilization and housing stability of low-income adults aged 62 and over. The demonstration offers grant funding to HUD-assisted multifamily property owners to implement the Integrated Wellness in Supportive Housing (IWISH) model over the demonstration period. The IWISH model features a full-time on-site Resident Wellness Director with a part-time Wellness Nurse at each property funded to implement IWISH. The Resident Wellness Director and Wellness Nurse work together to implement a formal strategy for coordinating services to help residents meet their long-term care needs and successfully age in place. HUD designed the SSD as a cluster-randomized controlled trial to allow rigorous measurement of impacts. HUD published a Notice of Funding Availability (NOFA) in January 2016 for the demonstration, received more than 700 responses, and applied screening and ranking criteria described in the NOFA to identify 185 properties across seven states as eligible for random assignment. HUD assigned properties to three groups: a treatment group that received grant funding to hire the Resident Wellness Director and Wellness Nurse and implement the demonstration; an active control group that did not receive funding for implementation but received an incentive for participating in the evaluation; and a passive control group that received neither an implementation grant nor an incentive. The final demonstration sample is 124 HUD-assisted properties: 40 in the treatment group (also known as IWISH properties), 40 in the active control group, and 44 in the passive control group. All properties serve households headed by people aged 62 or over, either predominantly or exclusively. The properties are in the following states: California, Illinois, Maryland, Massachusetts, Michigan, New Jersey, and South Carolina. Each state has treatment, active control, and passive control properties. The demonstration formally began October 1, 2017. The 40 properties in the treatment group implemented IWISH for an initial three-year demonstration period between October 2017 and September 2020. The Continuing Appropriations Act, 2021 and Other Extensions Act and the Consolidated Appropriations Act, 2021 provided additional funds and authorization to extend the demonstration for an additional two years (2021 – 2023).

Abstract

The BE-140 Benchmark Survey of Insurance Transactions by U.S. Insurance Companies with Foreign Persons is necessary to obtain complete and accurate data used by the Bureau of Economic Analysis (BEA) to produce the International Transactions Accounts (ITAs) of the United States. The data collected on the BE-140 survey are needed to monitor U.S. trade in insurance services, to analyze the impact of these cross-border services on the U.S. and foreign economies, to compile and improve the U.S. economic accounts, to support U.S. commercial policy on trade in services, to conduct trade promotion, and to improve the ability of U.S. businesses to identify and evaluate market opportunities. The data are used in estimating the trade in insurance services component of the U.S. international transactions accounts (ITAs) and national income and product accounts (NIPAs). The ITAs are used extensively by both government and private organizations for national and international economic policy support and for analytical purposes. The services transactions accounts are contained within the current account of the ITAs and are divided into several major components. The insurance services transactions covered by this survey accounted for 2.4 percent of U.S. exports and 8.5 percent of U.S. imports of services in 2022. The proposed information collection, BE-140 Benchmark Survey of Insurance Transactions by U.S. Insurance Companies with Foreign Persons is necessary to provide baseline information on U.S. trade in insurance services. The survey would ask U.S. companies to report their insurance transactions with foreign persons.

Abstract

Section 4d(c) of the Commodity Exchange Act (“CEA”), 7 U.S.C. 6d(c), requires the CFTC to consult with the Securities and Exchange Commission (“SEC”) and issue such rules, regulations, or orders as are necessary to avoid duplicative or conflicting regulations applicable to firms that are fully registered with the SEC as brokers or dealers and the CFTC as futures commission merchants involving provisions of the CEA that pertain to the treatment of customer funds. The CFTC, jointly with the SEC, issued regulations requiring such dually-registered firms to make choices as to how its customers’ transactions in security futures products will be treated, either as securities transactions held in a securities account or as futures transactions held in a futures account. How an account is treated is important in the unlikely event of the insolvency of the firm. Only securities accounts receive insurance protection under provisions of the Securities Investor Protection Act. By contrast, only futures accounts are subject to the protections provided by the segregation requirements of the CEA.

Key Information

Abstract

Part 583 in title 30 of the Code of Federal Regulations addresses the use of Outer Continental Shelf (OCS) sand, gravel, and shell resources for shore protection, beach restoration, or coastal wetlands restoration projects by Federal, State, or local government agencies, or for use in construction projects authorized by or funded in whole or in part by the Federal Government. The OCS Lands Act, 43 U.S.C. 1331 et seq., authorizes the Secretary of the Interior to prescribe rules and regulations to administer leasing of mineral resources on the OCS. Section 1337(k)(2) of title 43 authorizes the Secretary to “…negotiate with any person an agreement for the use of Outer Continental Shelf sand, gravel and shell resources—(i) for use in a program of, or project for, shore protection, beach restoration, or coastal wetlands restoration undertaken by a Federal, State, or local government agency; or (ii) for use in a construction project…that is funded in whole or in part by or authorized by the Federal Government.” The Secretary delegated this authority to BOEM. This information collection relates to the requirements for negotiated noncompetitive agreements for use of OCS sand, gravel, and shell resources to support construction of governmental project for beach nourishment, shore protection, and wetland enhancement, or any such project authorized by the federal government.

ACF-800: Child Care and Development Fund (CCDF) Annual Aggregate Report

Key Information

Abstract

The ACF-800 form is an approved collection with an expiration date of March 31, 2025. Section 658K of the Child Care and Development Block Grant (CCDBG) Act (42 U.S.C. 9858, as amended by Public Law 113-186) requires that states and territories submit annual aggregate data on the children and families receiving direct services under the CCDF. The implementing regulations for the statutorily required reporting are at 45 CFR 98.70 and 98.71. The ACF-800 collects information on the number and characteristics of families and children served, and the providers that serve them, including information on the funds used to provide the child care services. States who pool the funds to provide child care services report a pooling factor on the ACF-800 (data element #13), which indicates the percent of CCDF funds that make up the pool. If the percent is less than 100%, the state is pooling its funds to provide child care services and is reporting all families and children served. OCC uses the pooling factor to calculate the families and children served funded with CCDF dollars. OCC provides technical assistance to states to ensure that they accurately report the pooling factor. As currently reported, OCC can see if funds are pooled and how the percentages change from year to year but does not have an understanding for why there is fluctuation from year to year. To that end, OCC is interested in asking states to describe the reason when there is a change greater than or equal to five percent (>= +/- 5%) to the pooling factor as compared to last year. This information will assist OCC in understanding why pooled funding fluctuates from year to year and identifying states who may need further technical assistance when calculating the pooling factor. This follow-up question will allow OCC to fulfill the uses of the data collection as already approved (See supporting statement A for described purposes and uses of the data collected).

Subtitle C, Section 22001 of IRA amended Section 9003 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8103) by adding new subsection (h). Through the passing of IRA, the Powering Affordable Clean Energy (PACE) Program was established with the goal of supporting clean, affordable energy growth across America. The PACE Program will be administered by the Rural Utilities Service (RUS), a Rural Development (RD) Agency of the United States Department of Agriculture (USDA), that provides mortgage loans and loan guarantees to electric systems to provide and improve electric service in rural areas pursuant to the Rural Electrification Act of 1936, as amended (7 U.S.C. 901 et seq., RE Act). Section 22001 of IRA provided the Agency with $1,000,000,000 in Budget Authority (BA), to remain available until September 30, 2031. With this BA, the Agency through the PACE Program, will provide loans to eligible entities, with varying levels of loan forgiveness, for Projects that generate and/or store electricity from Renewable Energy Resource (RER) systems.

The information collection implements section 721(a) of the Federal Food Drug, and Cosmetic Act (the act) (21 U.S.C. 379e(a) providing that a color additive shall be deemed unsafe unless it meets the requirement of a listing regulation including any requirement for batch certification. FDA lists color additives that have been shown to be safe for their intended uses in Title 21 of the Code of Federal regulations.( CFR). FDA requires batch certification for all color additives provisionally listed in 21 CFR part 82. Color additives listed in 21 CFR part 73 are exempted from certification. The requirements for color additive certification are described in 21 CFR part 80.

The collection of this information is part of the government-wide effort to improve the performance and accountability of all federal programs, under 34 CFR 75.210, the Uniform Guidance, and the Education Department General Administrative Regulations (EDGAR). The U.S. Department of Education (ED) developed performance measures at every program level to quantify and report program progress required by the Elementary and Secondary Education Act of 1965 (ESEA), as amended. Under the Uniform Guidance and EDGAR, recipients of federal awards are required to submit performance and financial expenditure information. The program-level performance measure (established under Section 4625(4)(C) of the Elementary and Secondary Education Act of 1965, as amended), the 13 additional program indicators (established through a Notice of Final Priorities, Requirements, Definitions, and Selection Criteria (NFP) published in the Federal Register on July 13, 2022 87 FR 41675)), and budget information for the Full-Service Community Schools (FSCS) Program are reported in the Annual Performance Report (APR). The APR is required under 2 CFR 200.328 and 34 CFR 75.118 and 75.590. It provides data on the status of funded projects that correspond to the scope and objectives established in the approved applications and any amendments. To ensure that accurate and reliable data are reported to Congress on program implementation and performance outcomes, the FSCS APR collects data from grantees in a consistent format to calculate these data in the aggregate.
