What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Big Cat Public Safety Act Requirements

Abstract

This is a request for a new control number in conjunction with an emergency clearance request associated with the requirement to register prohibited wildlife species (also referred to as “big cats” under the authority of 16 U.S.C. § 3372(e), pursuant to the Big Cat Public Safety Act (BCPSA), Pub. L. 117-243, December 20, 2022, 136 Stat. 2336 (amending the Captive Wildlife Safety Act, and Lacey Act Amendments of 1981, 16 U.S.C. §§ 3371-3374 and § 3376, and 7 U.S.C. § 1997). The Service intends to seek emergency clearance of a new information collection under the authority of the BCPSA. “Prohibited wildlife species” (also referred to as “big cats”) is defined as “any live species of lion, tiger, leopard, cheetah, jaguar, or cougar or any hybrid of such species” (16 U.S.C. § 3371(h)). This includes any of the following species, or hybrids of any of these species: Lion (Panthera leo), tiger (Panthera tigris), leopard (Panthera pardus), snow leopard (Uncia uncia), clouded leopard (Neofelis nebulosa), jaguar (Panthera onca), cheetah (Acinonyx jubatus), cougar (Puma concolor) (50 CFR 14.252). The BCPSA makes it unlawful for any person to—(A) import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce, or (B) breed or possess any live prohibited wildlife species (16 U.S.C. § 3372(e)(1)). The BCPSA also makes it unlawful for any person to attempt to commit any of these acts with prohibited wildlife species (16 U.S.C. § 3372(a)(4)). Violators of the BCPSA are subject to civil and criminal penalties (16 U.S.C. § 3373), and big cats bred, possessed, imported, exported, transported, sold, received, acquired, or purchased contrary to the provisions of the BCPSA shall be subject to forfeiture to the United States (16 U.S.C. § 3374). The BCPSA also authorizes a limited exception from the prohibition on possession for a person or entity to register live specimens of prohibited wildlife species if certain requirements are met and continue to be met (16 U.S.C. § 3372(e)(2)(E)). The exception is intended to allow current owners of big cats at the time of enactment of the BCPSA to keep their big cats; however, they must register with the Service; are not allowed to breed, acquire, or sell big cats; and cannot allow direct contact between the public and their big cats (H. Rept. No. 117-428, p. 17 (July 22, 2022)). By registering their big cats no later than the statutory deadline (June 18, 2023), the person or entity (registrant) may continue to possess registered big cats that were born before the date of enactment (December 20, 2022) and legally in their possession on or before the date of enactment, as long as the registrant meets and continues to meet all requirements of 16 U.S.C. § 3372(e)(2)(E). To qualify to continue to possess live specimens of prohibited wildlife species (also referred to as “big cats”) under 16 U.S.C. § 3372(e)(2)(E), a registrant must register all live specimens of prohibited wildlife species in their possession with the United States Fish and Wildlife Service no later than June 18, 2023. The purpose of the registration form is to enable owners of big cats who want to continue to possess their big cats in accordance with 16 U.S.C. § 3372(e)(2)(E) to register all live specimens of big cats in their possession with the Service no later than June 18, 2023. The Service will use the information collected to verify eligibility to possess big cats under the BCPSA in accordance with 16 U.S.C. § 3372(e)(2)(E). Big cats bred or possessed in violation of the BCPSA and any big cat that is not registered on or before June 18, 2023, shall be subject to forfeiture for violation of the BCPSA prohibition on possession, unless another limited exception applies in accordance with the BCPSA. (16 U.S.C. §§ 3372(e)(2)(A) - (D), 3374(a)).

Basic Requirements for Special Exemption Permits and Authorizations to Take, Import, and Export Marine Mammals, Threatened and Endangered Species, and for Maintaining a Captive

Key Information

Abstract

The National Marine Fisheries Service (NMFS), Office of Protected Resources, Permits and Conservation Division is proposing an extension of the currently approved information collection OMB Control Number 0648-0084, with no changes. This information collection is under the authority of the Marine Mammal Protection Act (16 U.S.C. 1361 et seq.; MMPA), the Fur Seal Act (16 U.S.C. 1151 et seq.; FSA), and the Endangered Species Act (16 U.S.C. 1531 et seq.; ESA). The MMPA, FSA, and ESA prohibit “take” (e.g., to harass or harm), import, and export of marine mammals and endangered and threatened species, with limited exceptions. Pursuant to Section 104 of the MMPA and Section 10(a)(1)(A) of the ESA, persons or institutions may apply for special exception permits to take, import, or export marine mammals or endangered or threatened species for scientific research or enhancement purposes. Section 104 of the MMPA also allows for Letters of Confirmation under a General Authorization for scientific research, permits for commercial and educational photography of marine mammals, and permits for capture or import of marine mammals for public display. Issuance of permits is a federal action subject to the provisions of the National Environmental Policy Act (NEPA). Persons or institutions seeking to take, import, or export protected species are required to apply for a permit or authorization and demonstrate that the applicable statutory and regulatory requirements are met. The information required in this collection is used by NMFS to make the determinations under the MMPA, FSA, ESA, NEPA, and their implementing regulations prior to issuing a permit or authorization; to evaluate the impacts on protected species; to establish appropriate permit conditions relative to the activity proposed; and, to ensure compliance with the Acts. Information required includes the name, affiliation, contact information and qualifications; the purpose of the request; the species, age, sex, and number of animals; the proposed methods and mitigation to minimize impacts to the species; a description of the impacts to the species and environment; and the requested time frame of the permit. Permit and authorization holders must submit reports on the activities they carry out. Also, the MMPA mandates NMFS maintain an inventory of marine mammals in public display facilities and for those facilities to report certain information about the marine mammals to NMFS (via the National Inventory of Marine Mammals [NIMM]).

CMS is performing a "Survey of Retail Prices: Payment and Utilization Rates, and Performance Rankings." This study is divided into two parts. Part I focuses on the retail community pharmacy consumer prices. It also includes reporting by the States of payment and utilization rates for the 50 most widely prescribed drugs, and comparing State drug payment rates with the national retail survey prices. The template for States to use to complete (Effective July 1, 2013, CMS has suspended Part I of the nationwide retail survey for collecting information about consumer purchase prices, pending funding decisions.) Part II of this contract focuses on the retail community pharmacy ingredient costs. This segment provides for a survey of the average acquisition costs of all covered outpatient drugs purchased by retail community pharmacies. The prices will be updated on at least a monthly basis.

Abstract

The EAC Office of Grants Management (EAC/OGM) is responsible for distributing, monitoring, and providing technical assistance to states and grantees on the use of federal HAVA funds. EAC/OGM also reports on how the funds are spent, negotiates indirect cost rates with grantees, and resolves audit findings on the use of HAVA funds. The EAC-PR has been developed for both interim and final progress reports for grants issued under HAVA authority. This revised format builds upon our current approved report for the separate grant awards given by EAC. This revision includes the request of data for expenses related to HAVA awards. The revised PR will directly benefit award recipients by making it easier for them to administer federal grant and cooperative agreement programs through standardization of the types of information required in progress reports- thereby reducing their administrative effort and costs. In addition, this PR will derive necessary data for reporting to Congress on HAVA activities. The population for the data collection is the 56 states and territories (EAC grantees) receiving HAVA grants. The recipients of this funding are finite. EAC will post the guidance on our website for easy location and access on our website. EAC will also offer technical assistance as requested in completing and submitting progress reporting.

Abstract

Section 5b(a) of the Commodity Exchange Act (“CEA”) provides that a clearing organization may not perform the functions of a derivatives clearing organization (“DCO”) unless the clearing organization is registered with the Commission. In order to register and maintain registration with the Commission, a DCO must comply with the DCO Core Principles and all applicable Commission regulations. This information collection, as a whole, covers the burden associated with Part 39 of the Commission’s regulations applicable to registered DCOs, including requirements related to DCO governance. On July 13, 2023, the Commission adopted the final rule titled “Governance Requirements for Derivatives Clearing Organizations” (“Final Rule”), which amends § 39.24 to require DCOs to establish and consult with one or more risk management committees (“RMCs”) comprised of clearing members and customers of clearing members on matters that could materially affect the risk profile of the DCO. See 88 FR 44675 (Jul. 13, 2023). In addition, the Final Rule sets minimum requirements for RMC composition and rotation, and requires DCOs to establish and enforce fitness standards for RMC members. The Final Rule also adopts requirements for DCOs to maintain written policies and procedures governing the RMC consultation process and the role of RMC members. Finally, the Final Rule requires DCOs to establish one or more market participant risk advisory working groups (“RWGs”) that must convene at least two times per year, and adopt written policies and procedures related to the formation and role of the RWG. The Commission is revising its burden estimate for OMB control number 3038-0076 to account for new information collections set forth in the Final Rule. Specifically, the Commission believes that the burden under this clearance will increase because the 15 DCOs subject to these requirements will be required under § 39.24(b)(11) to create and maintain minutes of each RMC meeting, and under § 39.24(b)(12) to document and provide to the RMC, at a minimum, a summary of the topics discussed and the main points raised during each meeting of the RWG.

Abstract

This information collection is due to passenger train emergency systems regulations under 49 CFR part 238 that must be followed by Passenger Rail trains. The purpose of this part is to prevent collisions, derailments, and other occurrences involving railroad passenger equipment that cause injury or death to railroad employees, railroad passengers, or the general public, and to mitigate the consequences of such occurrences to the extent they cannot be prevented. This information collection is mandatory and submitted as needed. The information collection is used by FRA inspectors to ensure rail passenger car doors intended for emergency egress are properly labeled and maintained. This collection is also used by members of rail traveling public and rail train and engine employees to safely exit passenger trains if needed. There are no recordkeeping requirements associated with this collection

Citizen science and crowdsourcing are tools that engage, educate and empower the public to apply their curiosity and contribute their talents to a wide range of scientific and societal issues. Citizen Science is a form of open collaboration where the public can participate actively in the scientific process through methods that include asking research questions, collecting and analyzing data, interpreting results, or engaging in problem solving. Crowdsourcing is a process where individuals or organizations submit an open call for contributions of information from a large group of individuals (“the crowd”). NASA uses the vantage point of space to achieve with the science community and our partners a deep scientific understanding of our planet, other planets and solar system bodies, the interplanetary environment, the Sun and its effects on the solar system, and the universe beyond. Abstract

Subsistence migratory bird hunting is authorized in subsistence-eligible areas of Alaska. We collect information on the annual subsistence harvest of 60 species of birds (including geese, ducks, swans, cranes, loons, seabirds, shorebirds, and upland game birds) through surveys of households in the subsistence-eligible areas of Alaska. Data are used to promulgate harvest regulations to provide maximum subsistence harvest opportunity while keeping migratory bird populations at desired levels.
