Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Under 49 CFR part 239, FRA requires railroads to meet minimum Federal standards for the preparation, adoption, and implementation of emergency preparedness plans (EPP) connected with the operation of passenger trains, including freight railroads hosting passenger rail service operations. The information collected is necessary for compliance with the regulation and contributes to rail safety. Because of this information collection, FRA reviews and approves the EPPs of covered railroads. Consequently, it can ensure that railroads have comprehensive emergency preparedness plans. This information collection is mandatory, submitted as needed, and there is a requirement for record keeping.

Key Information

Abstract

We developed a proposed rule (RIN 1018-BF08) to update to the regulations for the taking of migratory birds for subsistence uses in Alaska during the spring and summer, and to add a secondary method (permit) for Tribal councils to invite certain family members living in excluded areas to participate in the customary spring-summery subsistence harvest of migratory birds in a village’s subsistence area. We developed these regulations under a co-management process involving the Service, the Alaska Department of Fish and Game, and Alaska Native representatives. The proposed changes would update the regulations to incorporate revisions requested by these partners. We developed the permit and harvest reporting materials in collaboration with the AMBCC local partner, the Sun’aq Tribe.

Abstract

The CHIPS Incentives Program Facilities for Semiconductor Materials and Manufacturing Equipment Notice of Funding Opportunity (NOFO) seeks applications that will support investments in the construction, expansion, or modernization of commercial facilities in the United States for semiconductor materials and manufacturing equipment for which the capital investment falls below $300 million. This NOFO seeks applications in the following categories. Semiconductor Materials Facilities for the manufacture or production, including growth or extraction, of materials used to manufacture semiconductors, which are the chemicals, gases, raw and intermediate materials, and other consumables used in semiconductor manufacturing. Abstract

Public Housing Agencies (PHAs) apply for funding to assist low-income families to lease housing. One of the programs through which PHAs provide housing assistance is the Housing Choice Voucher (HCV) Program, a tenant-based rental assistance program. This program operates by providing vouchers that cover a portion of the contract rent for a unit. Some PHAs project-base their vouchers (the rental assistance is tied to the unit, instead of the family). Project-based vouchers (PBVs) are becoming a larger percentage of PHAs overall HCV portfolios. HUD currently collects information on individual participants in the HCV program who are in PBV units and Project certificate (PBC) housing through the PIC system. In addition, HUD collects aggregate information on the total number of PBVs under contract at the PHA level but does not collect information at the project level.

Various provisions of the Interstate Commerce Act require rail carriers and noncarriers to file applications with the Board to seek licensing authority to construct or abandon a line of railroad, transfer rights in a line of railroad, or consolidate ownership in a railroad through a merger or common-control arrangement under 49 U.S.C. §§ 10901-05 and 11323, or to obtain an exemption (through a petition or notice) from filing such an application under 49 U.S.C. § 10502. Pursuant to 49 C.F.R. § 1121.3(d), the Board requires that if a proposed transaction to acquire (by sale or lease) or operate a rail line includes an agreement containing an interchange commitment(whether through restrictions or incentives), the party seeking Board authorization for such transaction must identify the presence of such an interchange commitment and must file with the Board a confidential, unredacted copy of that sales or lease agreement and any related documents containing the terms of such commitment.

42 CFR 422.502 describes CMS' regulatory authority to evaluate, through inspection or other means, Medicare Advantage Part C organizations. These records include books, contracts, medical records, patient care documentation and other records that pertain to any aspect of services performed, reconciliation of benefit liabilities, and determination of amounts payable. 42 CFR 423.503 states that CMS must oversee a Part D plan sponsor's continued compliance with the requirements for a Part D plan sponsor. 423.514 states that the Part D plan sponsor must have an effective procedure to develop, compile, evaluate, and report to CMS, to its enrollees, and to the general public, at the times and in the manner that CMS requires, statistics regarding areas such as cost of operations, patterns of utilization availability, accessibility, and acceptability of services. CMS developed a strategy to address our oversight and audit responsibilities within the context of limited audit/oversight resources. We have combined all Part C and Part D guides into one universal guide promoting efficiency and effectiveness and reducing financial and time burdens for both CMS and Medicare-contracting entities.

Abstract

The Department of State Bureau of Population, Refugees, and Migration (PRM) is responsible for coordinating and managing the U.S. Refugee Admissions Program (USRAP). PRM coordinates within the Department of State, as well as with the Department of Homeland Security's U.S. Citizenship and Immigration Services (DHS/USCIS), in carrying out this responsibility. A critical part of the State Department's responsibility is determining which individuals, from among millions of refugees worldwide, will have access to U.S. resettlement consideration. PRM and DHS/USCIS are now assisting with the preparation of a White House directive to initiate an in-country program to provide a means for certain persons in the United States who are lawfully present ("anchor parents") to claim a relationship with child(ren) in Honduras, El Salvador, and Guatemala and to assist the U.S. Department of State in determining whether those child(ren) are qualified to apply for access to the USRAP for family reunification purposes. This form also assists DHS/USCIS to verify parent-child relationships during refugee case adjudication. The main purpose of the DS-7699 is for the anchor parent to provide biographical information about his/her child(ren) in the qualifying countries who may subsequently seek access to the USRAP for verification by the U.S. government.

Abstract

The Federal Communications Commission (FCC) adopted the Expanding the Economic and Innovation Opportunities of Spectrum Through Incentive Auctions Report and Order, FCC 14-50, on May 15, 2014, published at 79 FR 48442 (Aug. 15, 2014). In the Report and Order, the Commission adopts rules to implement the broadcast television spectrum incentive auction. Our central objective in designing this incentive auction is to harness the economics of demand for spectrum in order to allow market forces to determine its highest and best use, which will benefit consumers of telecommunications services. The FCC seeks continued approval for three years from the Office of Management and Budget (OMB) for some of the information collection requirements that are contained in the Report and Order, FCC 14-50, with this submission to OMB.

Abstract

The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA) amended the Social Security Act (“the Act”) to require the U.S. Department of Health and Human Services, Office of Child Support Services (“OCSS”) to establish and maintain in the Federal Parent Locator Service (FPLS) the Federal Case Registry of Child Support Orders (“Federal Case Registry or FCR”). The FCR is a national database of state-provided abstracts of IV-D child support cases and non-IV-D cases, including orders that are entered or modified by courts or other tribunals after October 1, 1998. The PRWORA also amended the Act to require each state to have a “State Case Registry” (SCR) that includes information on individuals involved in child support cases. IV-D cases are those in which the state is currently providing child support services as directed by the state’s IV-D program. A non IV D case is one in which the state has no current application for services or is not receiving services from any other state program. Each state is required to transmit SCR information to the FCR, which serves as an electronic information exchange system within the FPLS. The FCR contains key information, including an order indicator and case and participant data received from each of the SCRs. Using the FCR allows authorized state agencies to determine whether any state has an interest in the same individuals, thereby enhancing the nation’s child support enforcement efforts and avoiding duplication of efforts.
