What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

On January 30, 2020, the Commission adopted a Report and Order, FCC 20-8, in MB Docket Nos. 19-165 and 17-105 (Report and Order). The Report and Order updated the Commission’s notification rules for cable operators and direct broadcast satellite providers by transitioning certain written notices from paper to electronic delivery via e-mail. Abstract

The National Survey of the Use of Booster Seats (NSUBS) is a voluntary collection of restraint use information for children under 13. NSUBS is a biennial collection. Data collectors observe restraint use for all passenger vehicle occupants included in the survey and for those vehicles that voluntarily participate, the data collectors conduct a brief interview with the vehicle driver or other knowledgeable adult to determine the age, height, weight, race, and ethnicity of the child occupants and age of the driver. Data collectors do not collect personal identifying information such as names, addresses, phone number of participating vehicle occupants. Data collectors use paper forms to collect information at fast food restaurants, gas stations, day care centers, and recreation centers where vehicles are mostly likely to have child occupants. The contractor supplies an electronic file of the data collected to National Highway Traffic Safety Administration (NHTSA). The contractor creates replicate weights, derives analytic variables, and adds auxiliary information on state laws. NHTSA uses the NSUBS data to estimate booster seat use among 4- to 7-year-old children. It also estimates restraint use for all children under 13, race and ethnicity breakouts of restraint use among all occupants in a vehicle, and estimates the extent to which children are “prematurely transitioned” from one restraint type to others that are inappropriate for their age as well as height and weight. The survey produces biennial estimates of: • Restraint use by Age Group • Restraint use by Weight Group • Restraint use by Height Group • Restraint use by Office of Management and Budget (OMB) categories for Race/Ethnicity NHTSA also asks the adult drivers their age to analyze the impact of driver age on driver seat belt use and child restraint use. NHTSA will tabulate the survey data, analyze the results, and publish the data in technical reports. NHTSA plans to release the results and the electronic file of the data collected to the public. NHTSA uses the NSUBS information to design outreach programs to help ensure that more of the nation’s children are using restraints that will protect them in motor vehicle crashes. The survey data will allow programs to better reach the caretakers whose children are unrestrained or not using the best restraint choice for their children’s sizes. The findings may also be of interest to State legislatures wanting to strengthen their child restraint laws by enacting mandatory or enhanced booster seat use provisions. The survey was previously approved as OMB Control No. 2127-0644 (current expiration date: 06/30/2022). The new collection will increase the number of respondents from 4,800 drivers to 5,300 drivers based on the average number of drivers interviewed over the last three surveys. This increases the burden hours by 36 hours (from 340 hours to 376 hours). NHTSA continues to estimate that there are no costs associated with the information collection.

Abstract

Multichannel Video Programming Distributors (MVPDs) provide their programming over a closed system and, thus, may use all frequencies to do so. They must, however, prevent leakage of those signals from the system and guard against and minimize any harm to aeronautical communications should leak occur. Part of the regime for protecting aeronautical frequencies from interference and resolving interference is notification of the Commission of use of those frequencies and that proper frequency offsets and other precautions are taken. Form 321 is used for this purpose. Under 47 CFR 76.1804, an MVPD shall notify the Commission before transmitting any digital signal with average power exceeding 10-5 watts across a 30 kHz bandwidth in a 2.5 millisecond time period, or for other signal types, any carrier of other signal components with an average power level across a 25 kHz bandwidth in any 160 microsecond time period equal to or greater than 10−4 watts at any point in the cable distribution system on any new frequency or frequencies in the aeronautical radio frequency bands (108-137 MHz, 225-400 MHz). The notification shall be made on FCC Form 321.

The information collection is mandatory reporting requirements and consists of 3 information collection instruments. IC-1, Form MCS-150, Motor Carrier Identification Report is filed by all motor carriers conducting operations in interstate or international commerce before beginning operations. Information collected through the Contractor Information Worksheet is necessary to meet: ● The Office of Management and Budget (OMB) Guidance M-05-24 for Homeland Security Presidential Directive (HSPD) 12 which authorizes Federal departments and agencies to ensure that contractors/their employees have limited/controlled access to facilities and information systems, and ● GSA Directive CIO P 2181.1 Homeland Security Presidential Directive-12 Personal Identity Verification and Credentialing which states that GSA contractors/their employees must undergo a minimum of a FBI National Criminal Information Check (NCIC) to receive unescorted physical access. GSA requires the collection of the information in the Contractor Information Worksheet to authorize and initiate background check requests for GSA contractor employees and for them to obtain a GSA access card. The background checks are carried out by the Office of Personnel Management, Facilities, Security & Contracting-Personnel Security (OPM FSC) and the credentialing process is carried out by the GSA’s Managed Service Office (MSO) in accordance with the terms and conditions of separate Memoranda of Agreement (MOAs). 2. Use of the Information. The GSA requesting official, referred to as “Sponsor,” collects and inputs the Contractor Information Worksheet data into the GSA Credential and Identity Management System (GCIMS). GSA Office of Mission Assurance (OMA) Identity, Credential and Access Management (ICAM) Division then uploads the relevant contractor data from GCIMS to the OPM e-QIP system for initiation of the contractor background investigation process. GCIMS automatically sends relevant data to the MSO for enrollment, including digital fingerprints for investigation and GSA access card, if needed. The OPM FSC performs the required background checks for GSA contractor employees once the applicant completes the e-QIP and fingerprinting process. The requesting official is responsible for requesting the investigation and/or GSA access card. Often the GSA requesting official is the Contracting Officer’s Representative (COR) for the contract, but this role may be fulfilled by a project manager, Public Buildings Service (PBS) building manager, or local Access Card Point of Contact (POC) as appropriate. If the applicant has a prior background check, OPM FSC uses the information in e-QIP to verify the prior determination. When OPM FSC makes an access determination, they notify the OMA ICAM Division. The OMA ICAM Division will input the results into GCIMS and notify the applicant, GSA sponsor, GSA POCs, and contractor’s point of contact.

Rule 18a-3, 17 CFR 240.18a-3, establishes minimum margin requirements for nonbank security-based swap dealers (“SBSDs”) and nonbank major security-based swap participants (“MSBSPs”) for non-cleared security-based swaps. Under Rule 18a-3(e), nonbank SBSDs are required to monitor the risk of each account that holds non-cleared security based swaps for a counterparty and to establish, maintain, and document procedures and guidelines for monitoring the risk of accounts as part of its risk management control system required under Exchange Act Rule 15c3-4. In addition, Rule 18a-3(d)(2) provides that a nonbank SBSD seeking approval to use a model to calculate initial margin will be subject to an application process consistent with Exchange Act Rule 15c3-1e and Exchange Act Rule 18a-1(d), as applicable, governing the use of internal models to compute net capital. The information collections in Rule 18a-3 are recordkeeping requirements and are designed to facilitate the collection of adequate levels of margin assets by nonbank SBSDs to protect them against counterparty default on both current and potential future exposures.

Key Information

Abstract

This non-substantive change request on OMB Control No. 2126-0001 corrects the CFR citations in the two information collections. The Hours of Service (HOS) rules apply to both property and passenger motor carriers. The HOS rules set limits on the on-duty time and driving time of CMV drivers, and mandate the amount and frequency of the time off-duty that such drivers must receive. Two types of information are collected under this IC: (1) drivers’ daily record of duty status (RODS) (electronic records or, in some cases, paper logbooks), and (2) supporting documents, such as fuel and toll receipts, that may be used by motor carriers to verify the accuracy of the RODS and to document expense deductions taken in the determination of taxable income. The information is collected on an annual basis. The purpose of the collection of the RODS and supporting documents of the HOS rules is to provide the Agency with its most effective tool in combating driver fatigue. Enforcement officials at roadside employ the RODS and supporting documents to determine the amount of time a driver has spent off duty prior to the driver’s current duty day. They also determine the amount of time the driver has been on duty that duty day, and the amount of time the driver has been behind the wheel driving during the duty day. Enforcement officials examine the RODS for seven of the immediately preceding days to determine compliance with the HOS rules. The RODS are an invaluable tool used to detect inaccurate and falsified logs that facilitates removing fatigued, unsafe drivers off the road. Enforcement officials employ the RODS and supporting documents retained by the motor carrier when conducting on-site investigative reviews of motor carriers. The safety assessments that result from such reviews are public information, and many shippers routinely examine the assessments, as well as crash and regulatory compliance records, when selecting a motor carrier. The Motor Carrier Safety Assistance Program (MCSAP) requires States, as a condition of receiving grant funding, to adopt and enforce State CMV safety laws and regulations that are compatible with the FMCSRs and these include the HOS rules. States embrace the Federal enforcement scheme for regulating safety in the operation of CMVs, and work closely with Federal investigators in enforcing the HOS rules. Motor carriers also help FMCSA detect fatigued drivers. It is in their interest to be proactive in detecting inaccuracy or falsification of RODS by their CMV drivers to avoid the penalties resulting from such infractions. Replacing paper RODS with electronic RODS enhances the accuracy and minimizes the falsification of RODS. Motor carriers will continue to examine the supporting documents, such as fuel receipts, toll receipts, bills of lading, repair invoices, and compare them to the entries on the RODS. Comparing supporting documents to the RODS helps the motor carrier verify the accuracy of the HOS reported by their CMV drivers. Motor carrier use of the RODS and driver-supplied supporting documents enhances driver adherence to the HOS rules, keeps fatigued drivers off the road, and helps FMCSA protect the public. This ICR supports the Department of Transportation’s Strategic Goal of Safety because the information helps the Agency improve the safety of drivers operating CMVs on our Nation’s highways.

Use of these federal forms is required by 45 CFR 303.7(a)(4) and Section 311(b) of the Uniform Interstate Family Support Act (state law that states must adopt as a condition of receiving federal funding for child support). This information collection was first approved in 1988 and has evolved over time. The current set of forms will expire in February 2026. Currently, there are 13 intergovernmental forms each addressing different case processing actions that may be needed in a case. Some of the forms are for agency use only, while some may be completed by private individuals or entities involved in the case. Training Certification for Entry-Level Commercial Motor Vehicle Operators

Abstract

This non-substantive change request corrects the CFR citations for the two information collections in this ICR. FMCSA is required to develop and establish minimum driver training standards for applicants for a commercial driver’s license (CDL) and/or certain CDL endorsements. These standards are found in 49 CR part 380, subparts F and G, and in five Appendices to part 380. The standards include two separate information collection actions: (1) Training providers must electronically submit information to FMCSA’s Training Provider Registry (TPR) to ensure that they meet the new training provider eligibility requirements and may therefore be listed on a new TPR; and (2) after an individual driver-trainee completes training administered by a training provider listed on the TPR, that training provider must electronically submit training certification information regarding the driver-trainee to the TPR. These FMCSA minimum training requirements for ELDT are intended to enhance the safety of CMV operations on our Nation’s highways. Therefore, this ICR supports the DOT Strategic Goal of Safety. The first portion of this ICR (IC-1), “Training Provider Registration,” collects information from each training provider for each of their training locations by means of the online TPR. The use of an electronic, online, web-based information system for this collection of information is expected to reduce burden on respondents. This information is collected when a training provider is first registering in the TPR, on a biennial basis thereafter, or otherwise when key information changes (training provider name, address, phone number, type(s) of training offered, training provider status, and, if applicable, any change in State licensure, certification, or accreditation status). The “Training Provider Registration” information is used by FMCSA to ensure that training providers meet the training provider eligibility requirements found in 49 CFR part 380, and can therefore be listed on the TPR. From the “Training Provider Registration” information submitted by training providers, certain basic identifying information (e.g., company name, location, contact information, etc.) and descriptive attributes regarding the training offered (e.g., which types of CDL and/or endorsement training are offered, etc.) by each training provider at each training location is made available to the public on the TPR website (unless the training provider chooses to not have this information displayed). This information is used by entry-level drivers looking for training. The second portion of this ICR, (IC-2) “Driver Training Certification,” collects information from training providers after driver-trainees complete training. This “Driver Training Certification” information is used by SDLAs to verify that the required driver training has been completed by the driver-trainee prior to the SDLA administering any skills or knowledge tests that require completion of training prior to their administration. The information collected from training providers is also used by the Agency to improve its understanding of the number of training providers and the types of training they provide, and the number of entry-level drivers and the types of training, CDLs, and endorsements that they obtain. Retrospective review of the data and of the safety performance of drivers that complete ELDT will allow FMCSA to better assess the impact of ELDT on motor carrier safety, and to monitor the effectiveness of individual training providers and identify those that may not be conducting training in compliance with the regulations and that may therefore be candidates for an on-site review by FMCSA. The use of an electronic, online, web-based information system for this collection of information is expected to reduce burden on respondents.

On March 22, 2010, the OCC, the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, and the National Credit Union Administration (the agencies), in conjunction with the Conference of State Bank Supervisors, issued a policy statement on funding and liquidity risk management (Policy Statement). The Policy Statement sets forth guidance and principles for sound liquidity risk management that apply to OCC-supervised national banks, Federal savings associations, and Federal branches and agencies of foreign banking organizations (together, banks). The Policy Statement summarizes and builds on previously issued guidance. In 2023, the agencies supplemented their liquidity risk management guidance with an Addendum to the Policy Statement. The OCC is proposing to revise this information collection to account for all the recordkeeping provisions set forth in the Policy Statement related to liquidity risk management policies, procedures, and assumptions, and Contingency Funding Plans (CFPs). The information collection currently does not account for the recordkeeping provisions related to CFPs and does not fully account for the recordkeeping provisions related to liquidity risk management policies, procedures, and assumptions. We have developed an online application for project collaborators and volunteers to watch video clips that were collected from caribou collars (animal-borne video collars) and enter data about the behaviors and habitats observed in the clips. Information collected from the videos will be analyzed to describe caribou foraging behavior, how it varies across the summer, and the factors that influence it. This information is being collected as part of a long-term project to understand how climate variability influence caribou forage conditions, behaviors, distributions, and population dynamics. Results of the analyses will be published in peer-reviewed scientific publications that will be available to the public.

Abstract

The Consumer Product Safety Improvement Act of 2008 (CPSIA) mandates that ASTM F963 shall be a mandatory toy safety standard. This toy safety standard sets forth only minimal labeling requirements for aquatic toys such as neck floats. The U.S. Consumer Product Safety Commission (CPSC or Commission) proposes to establish new performance and revised labeling requirements to address potentially deadly hazards associated with neck floats. The Commission is also amending CPSC’s list of notice of requirements (NORs) to include neck floats. This proposed rule contains information collection requirements that are subject to public comment and review by the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995.
