What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

This is a request for revision and extension of an existing collection currently in use with OMB approval. The NOAA Health Services Questionnaire NF 57-10-01 is being revised to include supportive questions to document previous sailing dates and clarifying medical information within NF 57-10-01 to ensure OMAO has a complete medical history for all personnel aboard NOAA vessels. These changes are minimal and not expected to increase the burden for completing this form. The National Oceanic and Atmospheric Administration's (NOAA) Office of Marine and Aviation Operations (OMAO) manages and operates NOAA's fleet of 15 research and survey ships and nine specialized environmental data-collecting aircraft . Comprised of civilians and officers of the NOAA Commissioned Officer Corps , OMAO also manages the NOAA Diving Program , NOAA Small Boat Program , and NOAA Uncrewed Systems Operations Center . The research and survey ships operated, managed, and maintained by OMAO comprise the largest fleet of federal research ships in the nation. Ranging from large oceanographic research vessels capable of exploring the world’s deepest ocean, to smaller ships responsible for charting the shallow bays and inlets of the United States, the fleet supports a wide range of marine activities including fisheries surveys, nautical charting, and ocean and climate studies. This collection covers the forms that are required to make medical readiness recommendations.

Abstract

The Rural Utilities Service (RUS) was established in 1994 by the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994 (Pub. L. 103-354, 108 Stat. 3178, 7 U.S.C. 6941 et. seq.) as successor to the Rural Electrification Administration (REA) with respect to certain programs, including the electric loan and loan guarantee program authorized under the Rural Electrification Act of 1936 (7 U.S.C. 901 et seq., as amended) (RE Act). The RE Act authorizes and empowers the Administrator of RUS to make and guarantee loans to furnish and improve electric service in rural areas. These loans are amortized over a period of up to 35 years and secured by the borrower's electric assets and/or revenue. In the interest of protecting loan security, monitoring compliance with debt covenants, and ensuring that RUS loan funds are used for purposes authorized by law, RUS requires that borrowers prepare and submit for RUS evaluation certain studies and reports. Some of these studies and reports are required only once for each loan application; others must be submitted periodically until the loan is completely repaid. The RE Act also authorizes and empowers the Administrator of RUS to make or cause to be made, studies, investigations, and reports concerning the condition and progress of the electrification of several States and Territories; and to publish and disseminate information with respect thereto. Information supplied by borrowers forms the basis of many of these reports.

Abstract

The Emission Guidelines for Large Municipal Waste Combustors Constructed on or before September 20, 1994 (40 CFR Part 60, Subpart Cb) were proposed on September 20, 1994; promulgated on December 19, 1995; and amended on both August 25, 1997, and May 10, 2006. The Agency received petitions on various aspects of the standards, however, and the 2006 rule was remanded in 2008. EPA is finalizing a rulemaking to address that remand, which includes a reevaluation of maximum achievable control technology (MACT) floors and the next iteration of the 5-year review of the standards as required by the CAA. The EPA is proposing revised requirements to existing subpart Cb (Emissions Guidelines and Compliance Times for Large Municipal Waste Combustors That are Constructed on or Before September 20, 1994) on January 23, 2024. The EPA is proposing the revised requirements in new subpart 40 CFR Part 60, Subpart WWWW (Emission Guidelines and Compliance Times for Large Municipal Waste Combustors Constructed on or Before January 23, 2024). Subpart WWWW applies to existing facilities constructed either on or before January 23, 2024 that own and operate municipal waste combustion (MWC) units with a combustion capacity greater than 250 tons per day of municipal solid waste (large MWC units). In general, all EG standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to the EG. The final amendments reflect the results from the MACT floor reevaluation and the 5-year review; remove startup, shutdown and malfunction exclusions and exceptions; streamline regulatory language; revise recordkeeping and electronic reporting requirements; and clarify requirements for certain air curtain incinerators. Additionally, the amendments re-establish new source and existing source applicability dates. Large MWC units that are currently subject to the New Source Performance Standards (NSPS) of subparts Ea and Eb will become “existing” sources under the amended standards and would be required to meet the revised emission guidelines (EG) under subpart WWWW by the applicable compliance date for the revised guidelines. Burdens associated with the 2006 standards are addressed separately under EPA ICR Number 1847.09 and are not included in this ICR. This ICR applies only to the incremental burden incurred by existing units due to the revisions to these standards. The guidelines do not apply directly to large MWC unit owners and operators, since they are implemented through state plans (SPs). If a state does not develop, adopt, and submit an approved state plan, or if a state’s plan is not approved, the EPA must promulgate a Federal plan to implement the emission guidelines in a state without its own SP. This information is being collected to ensure compliance with the final amendments to 40 CFR Part 60, Subpart Cb.

Abstract

The purpose of this ICR is to help fill data gaps for EPAs risk evaluations and risk management of existing chemicals under section 6 of TSCA. In accordance with TSCA section 26, EPA must make TSCA section 6 risk evaluation and risk management decisions consistent with the best available science and based on the weight of the scientific evidence. To carry out its statutory obligations, EPA needs sufficient information about chemicals undergoing risk evaluation and risk management, including information related to the chemicals conditions of use, hazards, exposures, potentially exposed or susceptible subpopulations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information. The collection of such information is subject to TSCAs strict statutory timeframes (set forth in section 6). Therefore, EPA is seeking approval for a generic information collection request (ICR) to conduct surveys of chemical users, processors, distributors, manufacturers (including importers), and recyclers, chemical waste handlers, consumers of chemical-containing products, employees who may be exposed to the chemical evaluated, state and local regulators, non-governmental organizations, industry experts, and knowledgeable members of the public (including potentially exposed or susceptible subpopulations) related to information collection for TSCA chemical risk evaluation and risk management. Surveys are defined as the collection of information from a common group through interviews or the application of questionnaires to a representative sample of that group. These information collection efforts are intended to supplement other reasonably available information on chemicals in commerce and will provide support for the Agencys policy and regulatory activities regarding existing chemicals under TSCA section 6. By learning more about the conditions of use, hazards, exposures, potentially exposed or susceptible subpopulations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information for chemicals being evaluated or regulated, EPA would be able to more precisely and effectively carry out its risk evaluation and risk management obligations under TSCA.

The U.S. Environmental Protection Agency (EPA) makes competitive financial assistance awards to support projects that tackle environmental, public health, and energy challenges across the country. This is accomplished by working directly with community-based organizations (CBOs) and state, local, territorial, and tribal governments that have strong ties to the communities in which they are working. EPA fosters a collaborative approach to tackling some of the most critical challenges in the most overburdened communities by encouraging projects that involve multiple stakeholders including States, local governments, and tribal governments. To help get resources and funding to underserved and overburdened communities EPA offers Environmental Justice Collaborative Problem Solving (EJCPS) and Environmental Justice Government to Government (EJG2G) cooperative agreement programs. With this Information Collection Request (ICR), EPA seeks authorization to collect post-award information in the form of semi-annual progress reports and final reports from each grantee to track their progress, with respect to effectiveness (e.g., the extent to which projects achieved their objectives, goals, and targets), efficiency (e.g., the extent to which projects delivered activities and outputs on schedule and within budget), and equity (e.g., the extent to which investments and benefits flowed to disadvantaged communities that are marginalized, underserved, and overburdened by pollution). To help get resources and funding to underserved and overburdened communities, the Inflation Reduction Act (IRA) created the Environmental and Climate Justice Block Grant Program (ECJP)the largest investment in environmental and climate justice in U.S. historywhen it was signed into law by President Biden on August 16, 2022. The Community Change Grants (CCG) are the final and most comprehensive piece of EPAs implementation of ECJP IRA funding. The CCG program will provide funding to communities and their partners to design, develop, and implement multi-faceted, community-driven projects to protect public health and the environment. Abstract

This ICR covers the information collection activities associated with the pesticide container design and residue removal requirements and containment structure requirements. With respect to the container design and residue removal requirements, the information collection activities are associated with the requirement that businesses subject to the container regulations (pesticide registrants) and repackaging regulations (pesticide registrants and refillers) maintain records of test data, cleaning procedures, certain data when a container is refilled, and other supporting information. These records are subject to both call-in by EPA and on-site inspection by EPA and its representatives. EPA has not established a regular schedule for the collection of these records, and there is no reporting. With respect to the containment structure requirements, the information collection activities are associated with the requirement that businesses subject to the containment structure regulations maintain records of the: (1) Monthly inspection and maintenance of each containment structure and all stationary bulk containers; (2) Duration over which non-stationary bulk containers holding pesticide and not protected by a secondary containment unit remain at the same location; and (3) Construction date of the containment structure. The businesses subject to the containment structure regulations include agrichemical retailers and refilling establishments, custom blenders and commercial applicators of agricultural pesticides. The records have to be maintained by the owners and operators of such businesses and made available to inspectors to ensure that businesses are in compliance with containment requirements. These inspections are generally conducted by the states, which enforce FIFRA regulations through cooperative agreements with EPA.

The National Defense Authorization Act (NDAA) for Fiscal Year 2010 (Public Law 111–84, enacted October 28, 2009) requires an expanded effort to recruit U.S. and other eligible workers for employment on Guam military base realignment construction projects. This reporting structure features electronic posting of construction job opportunities on an Internet job banks site with national coverage, posting job opportunities on several state workforce agency job banks, and documentation of worker recruitment results reports that will be submitted to the Guam Department of Labor (GDOL). All data collection and reporting will be done by military base construction contractors, and the data and recruitment results in a report that will be submitted to the GDOL. These recruitment requirements help fulfill the responsibilities assigned to the Secretary of Labor in the provisions of the NDAA of 2010 and increase employment opportunities for U.S. construction workers.

Abstract

This Information Collection Request (ICR) covers the paperwork burden hours and costs associated with the information collection activities under the pesticide registration fee programs implemented through the Office of Pesticide Programs (OPP), Environmental Protection Agency (EPA). Pesticide registrants are required by statute to pay an annual registration maintenance fee for all products registered under Section 3 and Section 24(c) of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Additionally, Section 33 of FIFRA establishes statutory fees and timeframes for EPAs review of covered applications. PRIA 5 which was enacted December 2022, did many things including that it extended the authority to collect pesticide maintenance fees through FY2027 and the authority to collect pesticide registration service fees through FY2029.This ICR specifically covers the activities related to the collection of the annual registration maintenance fees, the registration service fees, and the burden associated with the submission of requests for fees to be waived.

Abstract

Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Environmental Protection Agency (EPA) regulates the importation of pesticides and pesticide devices into the United States. FIFRAs definition of pesticides is broad and includes any substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest (e.g., rodenticides, insecticides, herbicides, fungicides, and antimicrobials) and certain other substances such as plant growth regulators and any nitrogen stabilizers; the definition also includes substances imported for pesticide research and development purposes. FIFRAs definition of pesticide devices include any instrument or contrivance (other than a firearm) which is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life. FIFRA section 17(c) governs the importation process for pesticides and pesticide devices into the U.S., while FIFRA 17(e) authorizes the U.S. Department of the Treasury, in consultation with the EPA, to promulgate regulations implementing pesticide and device trade enforcement. This authority was delegated to the Department of Homeland Security's U.S. Customs and Border Protection (CBP) in 2003. CBP regulations, developed in concert with the EPA, give the EPA specific roles in the importation process.

The Environmental Protection Agency (EPA) proposed a rule under section 6 of the Toxic Substances Control Act (TSCA) to address the unreasonable risk to human health presented by C.I. Pigment Violet 29 (PV29) under its conditions of use. The proposed rule would: require prescriptive controls for certain occupational conditions of use of PV29; and establish recordkeeping and downstream notification requirements. The information collection activities contained in the proposed rule are: downstream notification requirements through Safety Data Sheets (SDS) and labels; prescriptive controls information generation, recordkeeping, and notification requirements, including: development of documentation for appropriate respiratory protection and related recordkeeping; development and notification to potentially exposed persons (employees and others in the workplace) about appropriate respiratory protection and usage and related recordkeeping; and development and notification to potential exposed persons (employees and other in the workplace) about an equipment and area cleaning plan, and related recordkeeping, including but not limited to implementation records and documentation. The proposed rule would require that records be retained for 5 years from the date of generation.

Abstract

The Office of Resource Conservation and Recovery (ORCR) Resource Conservation and Sustainability Division (RCSD) requires the ability to collect consistent and timely information from grant recipients receiving EPA funding originating from the Bipartisan Infrastructure Law, (also known as the Infrastructure Investment and Jobs Act (IIJA)). Additionally, in order to carry out the Agency’s obligations under Resource Conservation and Recovery Act (RCRA), RCSD needs broad-based national information on waste streams and materials management practices. This ICR covers two related information collections that are essential for RCSD to properly understand current conditions and promote interventions that can lead to a more sustainable future. One is based on the collection of progress and final reports from Solid Waste Infrastructure for Recycling (SWIFR) and Recycling Education and Outreach (REO) grant recipients. The reports provide the Agency with necessary administrative information, documentation of grant outputs and outcomes, and for many grantees, data on the volume of materials and types of waste management methods they employ. EPA plans to use a web-based data management system to facilitate the collection and processing of these reports from grantees. The second proposed information collection is a voluntary annual survey to gather detailed information from all U.S. states and territories about their existing waste management programs, capacities, and throughputs. Survey respondents will also be grant recipients and the same electronic data management system can be used to collect and process survey results.

TSCA Section 8(b) Reporting Requirements for TSCA Inventory Notifications (renewal)

Abstract

This information collection request (ICR) addresses the reporting and recordkeeping requirements under section 8(b) of the Toxic Substance Control Act (TSCA) that are associated with the TSCA Chemical Substance Inventory (TSCA Inventory), as codified in 40 CFR Part 710. TSCA section 8(b) specifically requires that EPA compile and keep current a list of chemical substances manufactured or processed for commercial purposes in the United States. That mandate was amended in 2016 and TSCA section 8(b)(4) requires EPA to designate chemical substances on the TSCA Chemical Substance Inventory as either active or inactive in U.S. commerce. The first TSCA Inventory with all chemical substances designated as active or inactive published in February 2019. Starting August 5, 2019, manufacturers and processors are required to notify EPA before reintroducing inactive substances into U.S. commerce. The implementing regulations allow manufacturers and processors to notify EPA that it must change the commercial activity designation of the subject chemical substance from inactive to active on the TSCA Inventory. In March 2020, EPA amended 40 CFR part 710 to revise the requirements for companies to substantiate their confidential business information (CBI) claims for the specific chemical identities of substances on the TSCA inventory. The burden and activities in that amendment are covered by a rule related addendum to this ICR identified under OMB Control No. 2070-0210 (EPA ICR No. 2594.03). At this time, the information collection activities covered in the existing ICR related to the time-limited one time reporting (EPA Form No. 9600-05; Notice of Activity Form A), and the retrospective substantiation of CBI imposed by the 2020 amendment that is covered by the ICR addendum identified under OMB Control No. 2070-0210 (EPA ICR No. 2594.03) are now complete and are not included in this ICR.
